Article 1 In order to strengthen the protection of intangible cultural heritage and standardize the declaration and evaluation of national intangible cultural heritage, these Measures are formulated in accordance with Article 22 of the Constitution of People's Republic of China (PRC), "The State protects scenic spots and historical sites, precious cultural relics and other important historical and cultural heritage" and relevant laws and regulations.
Article 2 Intangible cultural heritage refers to various forms of traditional cultural expressions (such as folk activities, performing arts, traditional knowledge and skills, and related utensils, articles, handicrafts, etc.). ) and the cultural space that people of all ethnic groups have passed down from generation to generation and are closely related to people's lives.
Article 3 Intangible cultural heritage is divided into two categories: (1) traditional cultural expressions, such as folk activities, performing arts, traditional knowledge and skills; (2) Cultural space, that is, a place where traditional cultural activities are held regularly or traditional cultural expressions are concentrated, is both spatial and timely.
The scope of intangible cultural heritage includes:
(1) Oral tradition, including language as a cultural carrier;
(2) Traditional performing arts;
(3) Folk activities, ceremonies and festivals;
(4) Folk traditional knowledge and practice about nature and the universe;
(5) Traditional handicraft skills;
(six) the cultural space related to the above forms of expression.
Article 4 The purpose of establishing the representative list of national intangible cultural heritage is:
(a) to promote the rescue, protection and inheritance of China's intangible cultural heritage;
(two) to enhance the cultural consciousness and cultural identity of the Chinese nation, and to improve the understanding of the integrity and historical continuity of Chinese culture;
(3) Respecting and highlighting the contributions of relevant communities, groups and individuals to China culture, and demonstrating the richness of China's humanistic tradition;
(four) to encourage citizens, enterprises and institutions, cultural education and scientific research institutions and other social organizations to actively participate in the protection of intangible cultural heritage;
(5) Fulfill the Convention for the Protection of Intangible Cultural Heritage, enhance the international community's understanding of China's intangible cultural heritage, promote international cultural exchanges and cooperation, and make due contributions to human cultural diversity and its sustainable development.
Article 5 The declaration and evaluation of national intangible cultural heritage representatives shall be implemented by the Office of the Inter-Ministerial Joint Conference on the Protection of Intangible Cultural Heritage (hereinafter referred to as the Inter-Ministerial Joint Conference). The office of the inter-ministerial joint meeting shall cooperate and coordinate with all relevant departments, units and social organizations.
Article 6 The application items of representative works of national intangible cultural heritage shall be the expressions of folk traditional culture or cultural space with outstanding value; Or it has typical significance in intangible cultural heritage; Or it is of great value in history, art, ethnology, folklore, sociology, anthropology, linguistics, literature and so on.
Specific evaluation criteria are as follows:
(a) has the outstanding value of highlighting the cultural creativity of the Chinese nation;
(two) rooted in the cultural traditions of the relevant communities, handed down from generation to generation, with distinctive local characteristics;
(3) It has the functions of enhancing the cultural identity of the Chinese nation, enhancing social cohesion, and promoting national unity and social stability, and is an important link for cultural exchanges;
(four) excellent use of traditional skills, reflecting the superb level;
(5) It has the unique value of witnessing the living cultural tradition of the Chinese nation;
(6) it is of great significance to maintain the cultural heritage of the Chinese nation, and at the same time it is in danger of disappearing due to social changes or lack of protective measures.
Seventh declared projects must put forward a practical ten-year protection plan, and promise to take corresponding concrete measures to effectively protect. These measures mainly include:
(1) Archiving: establishing a complete file for the declared project by means of collection, recording, classification and cataloging;
(2) Preservation: A true, comprehensive and systematic record of the protected object is made through writing, audio recording, video recording and digital multimedia. Actively collect relevant physical data, and select relevant institutions for proper preservation and rational utilization;
(3) Inheritance: through social education and school education, intangible cultural heritage can be passed down and carried forward as a living cultural tradition in relevant communities, especially among teenagers;
(4) Dissemination: Through festivals, exhibitions, observation, training, professional seminars and other forms, through the publicity of mass media and the Internet, let the public have a deeper understanding of this heritage and promote social sharing;
(5) Protection: Take practical and concrete measures to ensure the preservation, inheritance and development of intangible cultural heritage and its intellectual achievements, and protect the rights and interests enjoyed by the inheritors (groups) of the heritage on their cultural expressions and cultural spaces handed down from generation to generation, especially to prevent misunderstanding, distortion or abuse of intangible cultural heritage.
Eighth citizens, enterprises and institutions, social organizations, etc. , you can apply to the administrative department of culture in the administrative region, and the administrative department of culture will report it step by step. If the reporting subject is a non-reporting project inheritor (group), the reporting subject shall be authorized by the reporting project inheritor (group).
Article 9 The provincial cultural administrative department shall summarize and screen the items declared by the representatives of intangible cultural heritage within its administrative area, and submit the application materials to the office of the Inter-ministerial Joint Conference after being approved by the people's government at the same level. Units directly under the central government can directly report to the office of the inter-ministerial joint meeting.
Article 10 An applicant shall submit the following materials:
(a) application report: a brief description of the project name, the applicant, the purpose and significance of the application;
(2) Project declaration: a description of the history, present situation, value and endangered status of the declared project;
(3) Protection planning: explain the protection objectives, measures, steps and management mechanism in the next decade;
(four) other necessary materials to help explain the declared project.
Eleventh similar projects inherited from different regions and shared by different communities and groups can be jointly declared; The parties to the joint statement shall submit an agreement agreeing to the joint statement.
Article 12 The Office of the Inter-Ministerial Joint Conference shall, in accordance with the provisions of Article 10 of these Measures, examine the application materials and submit the qualified application materials to the review committee.
Thirteenth evaluation committee is composed of relevant responsible comrades and experts in related fields from the national cultural administrative department, and undertakes the evaluation and professional consultation of national intangible cultural heritage representatives. The term of office of a jury is four years. The review committee shall have one director and several vice-directors, and the director shall be the relevant responsible comrades of the state department for cultural administration.
Fourteenth evaluation work should adhere to the principles of science, democracy and justice.
Article 15 According to the provisions of Articles 6 and 7 of these Measures, the evaluation committee puts forward the recommended projects of national intangible cultural heritage representatives and submits them to the Office of the Inter-ministerial Joint Conference.
Article 16 The Office of the Inter-Ministerial Joint Conference shall publicize the recommended national intangible cultural heritage projects for 30 days through the media.
Article 17 The Office of the Inter-Ministerial Joint Conference shall, according to the evaluation opinions and publicity results of the evaluation committee, draw up a list of national intangible cultural heritage representatives, which shall be approved by the Inter-Ministerial Joint Conference and submitted to the State Council for approval and promulgation.
Eighteenth the State Council every two years to approve and publish a national intangible cultural heritage representative list.
Article 19 Governments at all levels shall give corresponding support to the projects listed in the representative list of national intangible cultural heritage. At the same time, the applicant must fulfill all the commitments in its protection plan and submit an implementation report to the Inter-Ministerial Joint Conference Office every year.
Article 20 The Office of the Inter-Ministerial Joint Conference shall organize experts to evaluate, inspect and supervise the projects listed in the representative list of national intangible cultural heritage. Those who fail to fulfill their protection commitments and have problems will be given warnings, serious warnings or even delisting according to different degrees.
Twenty-first of the "Interim Measures" by the inter ministerial joint meeting office is responsible for the interpretation of.
Twenty-second the Interim Measures shall come into force as of the date of promulgation.
