Chapter I General Provisions Article 1 In order to promote the healthy development of private education and safeguard the legitimate rights and interests of private schools and educatees, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Promotion of Private Education and relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 Within the administrative area of this province, these Regulations shall apply to social organizations or individuals other than state institutions who use non-state financial funds to organize activities of schools and other educational institutions (hereinafter referred to as private schools) facing the society. Article 3 Private education is a public welfare undertaking and an integral part of national education. Private schools and public schools have the same legal status.

People's governments at all levels shall guarantee the autonomy of private schools in running schools according to law, and protect the legitimate rights and interests of the organizers, principals, teaching staff and educatees of private schools. Article 4 Private schools should implement the national education policy, fully implement quality education, adhere to the socialist orientation of running schools, ensure the quality of education, and devote themselves to cultivating all kinds of talents for socialist construction.

Private schools should implement the principle of separating education from religion. No organization or individual may use religion to carry out activities that hinder the national education system. Article 5 The people's governments at or above the county level shall strengthen their leadership over private education and incorporate it into the national economic and social development plan.

The administrative departments of education, human resources and social security of the people's governments at or above the county level shall, according to local conditions, formulate specific plans for the development of private education and report them to the people's governments at the same level for approval before implementation. Sixth provincial education administrative departments in charge of private education in the province, responsible for the planning, coordination and management of private education.

The provincial human resources and social security department is responsible for the service, supervision and management of private schools that implement vocational qualification training and vocational skills training.

Provincial civil affairs, finance, price, public security, industry and commerce and other administrative departments are responsible for the relevant work of private education within the scope of their respective duties. Article 7 The people's governments at or above the county level shall establish a joint working conference system for private education, which is attended by the education administrative departments, human resources and social security departments, and mainly coordinate and solve relevant problems in the development of private education. Chapter II Grassroots Organizations in China Article 8 Private schools shall, in accordance with the provisions of the articles of association of China, establish grass-roots organizations, carry out Party activities and strengthen Party building. Ninth the establishment of private schools should meet the needs of the development of education in this province and meet the conditions stipulated by laws and regulations. The specific standards for the establishment of private schools (except higher education) shall be formulated by the provincial people's government. Article 10 The establishment of a private school shall be examined and approved in accordance with the following authorities:

(a) the establishment of ordinary institutions of higher learning and normal and medical colleges shall be examined and approved by the administrative department of education of the State Council;

(two) the establishment of higher vocational schools (excluding normal schools and medical schools) shall be examined and approved by the provincial people's government and reported to the education administrative department of the State Council for the record;

(3) The establishment of privately-funded institutions of higher learning and non-academic institutions of higher education shall be examined and approved by the provincial education administrative department;

(four) the establishment of schools with secondary education or below and pre-school education schools shall be examined and approved by the municipal and county education administrative departments in accordance with the provisions of similar public schools at the same level;

(five) the establishment of cultural education and training schools shall be examined and approved by the education administrative department at the county level;

(six) the establishment of technical schools, approved by the provincial administrative department of human resources and social security; The establishment of vocational skills training schools shall be examined and approved by the administrative departments of human resources and social security of cities and counties.

Private schools approved by the administrative department of human resources and social security shall, within seven working days after approval, send a copy to the education administrative department at the same level for the record. Eleventh private schools approved by the administrative department of education to hold vocational qualifications and vocational skills training shall be approved by the administrative department of human resources and social security at the same level before adding training programs to the school. Private schools approved by the administrative department of human resources and social security shall be approved by the administrative department of education at the same level before adding non-academic cultural education and training programs in the school.

Private schools that implement special non-academic education such as sports and art, if the state has provisions on the examination and approval authority for their establishment, shall be implemented in accordance with state regulations; If there is no provision, it shall be examined and approved by the administrative department of education of the city or county. Article 12 The names of private schools shall conform to the provisions of relevant laws and regulations and shall not harm public interests.

The name of a private school should be preceded by the name of the administrative region where the school is located, and it should be compatible with the educational category, educational level and educational scope of the private school. Without the approval of the administrative department of education at or above the provincial level or the administrative department of human resources and social security, the words with the same meaning as the names of administrative regions at or above the provincial level shall not be used. Article 13 The examination and approval authority shall announce the name, articles of association, address, legal representative, school-running level, category, scale and enrollment scope of the formally established private school to the public through the government website or other media. Article 14 The organizers of private schools may independently choose to set up non-profit or profit-making private schools. However, for-profit private schools that implement compulsory education may not be established.

The organizers of non-profit private schools shall not obtain school income, and all the school balances shall be used for running schools.

The organizers of for-profit private schools can obtain school income, and the school balance shall be handled in accordance with the Company Law and other relevant laws and administrative regulations.
