Provisions on Administration of Operation Safety of Civil Airports
Chapter I General Provisions Article 1 In order to ensure the safety and normal operation of civil airports, these Provisions are formulated in accordance with the Civil Aviation Law of People's Republic of China (PRC) and other relevant laws and regulations. Article 2 These Provisions shall apply to the operation safety management of civil airports (including the civil part of military-civilian airports). The requirements for aviation safety management of civil airports shall be implemented in accordance with other relevant laws, regulations and rules.

Civil airports mentioned in these Provisions (hereinafter referred to as airports) include transportation airports and general airports. The operational safety management of transport airports shall meet the requirements of these Provisions, and the operational safety management of general airports shall be implemented with reference to these Provisions. Article 3 The General Administration of Civil Aviation of China (hereinafter referred to as the General Administration of Civil Aviation) shall exercise unified supervision and management over the operational safety of airports throughout the country.

The Regional Civil Aviation Administration of China (hereinafter referred to as the Regional Civil Aviation Administration) shall supervise and manage the operation safety of airports within its jurisdiction.

Airport management agencies shall implement unified management of airport operation safety, be responsible for the organization and coordination of airport safety and normal operation, and bear corresponding responsibilities.

Air transport enterprises and other on-site units shall, in accordance with their respective responsibilities, maintain the safety of airport operation and bear corresponding responsibilities. Article 4 Airport management agencies shall sign airport operation safety agreements with air transport enterprises and other on-site units to clarify their respective rights, responsibilities and obligations. Article 5 Airport management agencies, air transport enterprises and other on-site units shall, in accordance with the requirements of relevant national laws and regulations and civil aviation rules and standards, timely maintain their respective facilities and equipment related to airport operation safety and maintain the continuous application of facilities and equipment. Article 6 All units and individuals in the airport shall abide by all laws, regulations and civil aviation rules related to airport management, as well as various management regulations formulated by the airport management agency to ensure flight safety and normal operation of the airport and approved by the competent civil aviation authorities. Article 7 An airport management agency shall organize the establishment of an airport safety management committee. The Airport Safety Management Committee is composed of leaders in charge of safety work of airport management agencies, air transport enterprises or their agents and other on-site units, and the person in charge is the leader in charge of safety work of airport management agencies. The main duties of the Airport Safety Management Committee are:

(a) according to the national laws and regulations, civil aviation regulations, to guide the airport operation safety;

(2) Studying and analyzing the security situation of airport operation and evaluating the security situation of airport operation;

(three) to coordinate and solve the security problems in the operation of the airport;

(four) put forward rectification measures for the hidden dangers and problems of airport operation safety, and urge the relevant units to implement them.

The airport safety management committee shall hold regular meetings.

Airport management agencies, air transport enterprises or their agents and other on-site units shall implement the safety rectification opinions and suggestions put forward by the Airport Safety Management Committee. Article 8 Airport management agencies shall not abuse the management authority conferred by these Provisions to damage the legitimate rights and interests of air transport enterprises or their agents and other on-site units. Chapter II Airport Safety Management Section 1 Airport Safety Management System Article 9 The airport management institution shall establish an airport safety management system.

Airport safety management system mainly includes airport safety management policy, objectives, organization and responsibilities, safety education and training, document management, safety information management, risk management, unsafe incident investigation and disposal, emergency response, airport safety supervision and audit, etc. Article 10 The airport safety management system shall be incorporated into the airport manual.

Airport management agencies shall, according to the actual situation of airport operation, timely organize the evaluation of the conformity and effectiveness of the airport safety management system, and timely adjust and improve it. Section 2 Airport Safety Management System Article 11 The airport management agency shall hold a regular meeting on safety production at least once a month to analyze and study the problems existing in safety production and make arrangements for safety production; Hold safety production analysis meetings every quarter, every six months and every year to summarize the work in the previous stage and make arrangements for the future work; When there are factors that are not conducive to safe operation or safety accidents in airport operation, a safety production meeting should be held in time to formulate practical safety measures. Article 12 The airport management agency shall organize an annual evaluation of the airport operation safety, including the performance of the duties of the airport management agency and the on-site operation support unit and the status of airport facilities and equipment. The relevant units shall formulate rectification plans for potential safety hazards and weak links found in the assessment, designate departments and personnel to carry out rectification, and the airport management agency shall be responsible for tracking and supervising the implementation of the rectification plan.

Airport management agencies can organize personnel with experience in airport operation and management to conduct evaluation, or entrust professional institutions to conduct evaluation. Personnel undertaking the assessment should be familiar with relevant rules and standards and have experience in airport operation and management.

After the evaluation, the appraisers shall prepare an evaluation report, and the appraisers shall sign the report. The contents of the evaluation report shall be fed back to the airport management organization and the resident unit, and reported to the regional civil aviation administration where the airport is located for the record. The report should be kept for at least five years. Article 13 Airport management agencies shall provide safety guarantee for aircraft in strict accordance with the airport opening scope approved by CAAC or CAAC.

Equipment explicitly prohibited by the state and special equipment for civil aviation without the approval of CAAC shall not be used in civil airports.
