In order to regulate the supervision activities of construction projects in this Municipality and ensure the quality and safety of construction projects, these measures are formulated in accordance with the People's Republic of China (PRC) Construction Law, the Regulations on Quality Management of Construction Projects, the Regulations on Safety in Production of Construction Projects, the Regulations on Management of Shanghai Construction Market and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 (Scope of Application)

These Measures shall apply to the construction project supervision and related supervision and management activities within the administrative area of this Municipality. Article 3 (Definitions)

The term "construction project supervision" as mentioned in these Measures refers to the activities that the construction unit entrusts the construction project supervision unit (hereinafter referred to as the supervision unit) to control the quality, progress and use of funds of the construction project during the construction stage and supervise the safe production of the construction project. Article 4 (Administrative Department)

The municipal construction administrative department is the comprehensive supervision and management department of the city's construction project supervision activities, and is responsible for the supervision and management of relevant professional construction project supervision activities, and specifically performs the following duties:

(a) to organize the formulation of local technical standards for construction project supervision;

(two) to guide and coordinate the supervision and management of the relevant administrative departments of this Municipality on the supervision activities of professional construction projects;

(three) to supervise and manage the supervision activities of housing construction projects, municipal infrastructure projects and highway projects.

Municipal administrative departments of port, water, ocean, greening, civil defense, housing management, etc. Responsible for the supervision and management of construction engineering supervision activities of related majors according to the division of responsibilities.

District and county construction administrative departments and other relevant departments shall be responsible for the supervision and management of construction project supervision activities within their respective administrative areas in accordance with the division of responsibilities.

The administrative departments of development and reform, finance, fire protection and production safety supervision of this Municipality shall, within the scope of their respective duties, coordinate the implementation of these measures. Article 5 (Trade Associations)

Shanghai Construction Engineering Consulting Industry Association (hereinafter referred to as Industry Association) is a self-discipline management organization of construction engineering supervision units, which formulates self-discipline norms according to law, carries out industry training and credit system construction, and safeguards the legitimate rights and interests of its members. For members who violate the industry self-discipline norms, the industry association may take corresponding disciplinary self-discipline measures in accordance with the provisions of the association's articles of association.

The municipal construction administrative department shall guide and supervise the business activities of trade associations. Article 6 (Supervision Insurance)

This Municipality encourages supervision units to participate in supervision liability insurance. Chapter II Supervision Entrustment Article 7 (Qualification of Supervision Units)

Supervision units shall obtain corresponding qualifications in accordance with the relevant provisions of the state, and undertake supervision business within the scope approved by the qualification certificate.

The supervision unit shall not transfer the supervision business. Article 8 (Records of Supervision Units in Other Provinces and Cities)

Supervision units from other provinces and cities shall enter the city to engage in construction project supervision activities, and shall file with the municipal construction administrative department or other relevant departments. Article 9 (Qualifications of Supervisors)

The chief supervision engineer shall obtain the qualification of registered supervision engineer in accordance with the relevant provisions of the state.

Other supervisors shall pass relevant examinations in accordance with the relevant provisions of the state and this Municipality. Article 10 (Construction Project Supervision)

The following construction projects shall be supervised:

(a) national and municipal key construction projects;

(2) Large and medium-sized public utility projects;

(3) Residential projects;

(4) Projects using loans or aid funds from foreign governments or international organizations;

(five) other projects that the state or municipal people's government thinks should be supervised. Article 11 (Supervision fee shall be calculated separately)

For construction projects that must be supervised according to law, the supervision fee standard shall be implemented according to the upper limit stipulated by the state. The supervision fees of other construction projects shall be subject to market-adjusted prices.

The construction unit shall pay the construction project supervision fee separately in the special account for construction projects. The supervision fee shall not be used for other purposes. Article 12 (Direct Entrustment and Bidding by Supervisors)

The construction unit shall entrust a supervision unit with corresponding qualifications to supervise the construction project.

Construction projects in supervision bidding must be carried out in accordance with the law, and the construction unit shall conduct bidding in accordance with relevant regulations, and shall not illegally interfere in bidding activities.

The evaluation criteria of construction project supervision should include the qualification and work experience of the supervision unit, the composition and personnel conditions of the project supervision organization, the work experience and business ability of the chief supervision engineer, the quality of the supervision outline, the facilities, the insurance coverage of supervision liability insurance, etc.

The state or the city's key construction project supervision and bid evaluation should evaluate the professional ability of the chief supervision engineer through the on-site defense of the chief supervision engineer. Article 13 (Requirements for Project Supervision Institutions and Personnel)

The project supervision organization consists of chief supervision engineer, professional supervision engineer and supervision personnel; When necessary, a representative of the chief supervision engineer may be appointed.

A registered supervision engineer who has served as the chief supervision engineer of a construction project shall not be appointed as the supervision engineer of two or more other construction projects at the same time. The chief supervision engineer of the following construction projects shall not be appointed by the supervision unit as the supervision engineer of other construction projects:

(a) construction projects with a single area of more than 20,000 square meters;

(two) the cost of the construction project exceeds 200 million yuan;

(three) affordable housing projects;

(4) Major national or municipal projects.
