The establishment of private training and education institutions, the recruitment of school-age children and adolescents in kindergartens, primary and secondary schools, and other cultural and educational activities related to school cultural and educational courses or remedial tutoring related to further studies and examinations shall be subject to examination and approval by the education administrative department of the people's government at or above the county level in accordance with the provisions of Article 12 of the Law on the Promotion of Private Education.

The establishment of private training and education institutions that carry out language ability, art, sports, science and technology, research and other education and teaching activities conducive to quality improvement and personality development, and private training and education institutions that carry out cultural education and adult non-academic continuing education may directly apply for legal person registration, but may not carry out cultural and educational activities as stipulated in the first paragraph. Where there are other provisions in laws, regulations and administrative normative documents of the State Council, such provisions shall prevail.

Private training and education institutions should have venues, facilities and equipment, school funds, management capabilities, curriculum resources and teaching staff with corresponding qualifications that are suitable for the educational activities implemented. The specific measures shall be formulated by the education administrative department of the provincial people's government in conjunction with relevant departments.

To apply for the establishment or formal establishment of a private educational institution and apply for a school license, the following materials shall be submitted:
