How to apply for a school
According to the provisions of the Law on the Promotion of Private Education, in the process of bidding for private schools, in addition to the requirements stipulated by law and the conditions stipulated by educational laws, regulations and rules, applicants should also pay attention to the following matters:

(a) about the examination and approval authority of private schools. According to Article 11 of the Law on the Promotion of Private Education, private schools shall be examined and approved by the administrative departments of education, labor and social security according to their respective authorities. Among them, the establishment of private schools that implement cultural education such as academic education, preschool education and self-study exams shall be examined and approved by the education administrative department of the people's government at or above the county level; The establishment and implementation of vocational qualification training and vocational skills training in private schools shall be examined and approved by the administrative department of labor and social security at or above the county level and copied to the administrative department of education at the same level for the record.

(two) the materials that should be submitted to apply for a private school. According to the Law on the Promotion of Private Education, there are two situations to apply for the establishment of private schools, one is to apply for the establishment of private schools, and the other is to apply for the formal establishment of private schools. The materials needed in these two cases are different.

1. To apply for the establishment of a private school, the sponsor shall submit the following materials:

(1) bid report;

(2) The name and address of the promoter or the name and address;

(3) the source of assets, the amount of funds and valid documents, and indicate the property rights.

(4) Donation agreement must be submitted for school property in the form of donation, indicating the name of the donor, the amount, purpose, management method and relevant valid documents of the donated assets.

2, after the preparation, to apply for the formal establishment of private schools, the organizers shall submit the following materials:

(1) ready for approval;

(2) Report on the preparation;

(3) the articles of association of the school, and the list of members of the first school council, board of directors or other decision-making bodies;

(4) valid certification documents of school assets;

(5) Qualification certificates of principals, teachers and accountants.

3. If a direct application is made for the formal establishment of a private school, the sponsor shall submit all the materials specified in 1 and the materials specified in items (3), (4) and (5) of Article 2.

(3) Examination and approval of private schools

According to the provisions of the Law on the Promotion of Private Education, if an application is made for the establishment of a private school, the examination and approval authority shall, within 30 days from the date of accepting the application, make a written decision on whether to approve it and serve it on the applicant. Agree to the establishment and issue a letter of approval for the establishment; If it does not agree to the establishment, the examination and approval authority shall explain the reasons for the disagreement.

To apply for the formal establishment of a private school, the examination and approval authority shall make a written decision on whether to approve it within 3 months from the date of acceptance and serve it on the applicant; If an application is made for the formal establishment of a private institution of higher learning, the examination and approval authority shall make a written decision on whether to approve it within 6 months from the date of acceptance and serve it on the applicant. The examination and approval authority shall issue a school-running license to a privately-run school that has been formally established. If it has not been formally established, it shall give a written explanation.

(4) Registration of private schools

After obtaining a school license, a private school shall register in accordance with Article 18 of the Regulations for the Implementation of the Law on the Promotion of Private Education and the Provisional Regulations on the Registration and Administration of Private Non-enterprise Units, and provide the following materials to the registration authority:

1, application for registration;

2. School license;

3. The identity certificate of the proposed legal representative;

4. school charter.

After receiving the above materials, the civil affairs department or the administrative department for industry and commerce that accepts the application shall complete the registration procedures within the specified time and issue the corresponding registration certificate for private non-enterprise units.
