Measures for the administration of safety production training
Chapter I General Provisions Article 1 In order to strengthen the management of safety production training, standardize the order of safety production training, ensure the quality of safety production training and promote the healthy development of safety production training, these measures are formulated in accordance with the provisions of the Safety Production Law and relevant laws and administrative regulations. Article 2 These Measures shall apply to safety training institutions, production and business units engaged in safety training (hereinafter referred to as safety training), and supervision and management of safety training by safety production supervision and management departments and coal mine safety supervision institutions. Where laws, administrative regulations and the State Council have other provisions, those provisions shall prevail. Article 3 The term "safety training" as mentioned in these Measures refers to education and training activities aimed at improving the safety quality of safety supervisors, employees of production and business units and personnel engaged in safety production.

The safety supervisors mentioned in the preceding paragraph refer to the safety production supervisors and coal mine safety supervisors engaged in safety supervision and administrative law enforcement sent by the safety production supervision and management departments of the people's governments at or above the county level and coal mine safety supervision institutions at all levels; Employees of production and business operation entities refer to the principal responsible persons, safety production management personnel, special operators and other employees of production and business operation entities; Relevant personnel engaged in safety production refer to teachers engaged in safety education and training, registered personnel of hazardous chemicals, personnel undertaking safety evaluation, consultation, testing and inspection, and registered safety engineers. Article 4 The principles of unified planning, centralized management, graded implementation, classified guidance and separation of teaching and examination shall be applied to safety training.

State administration of work safety (State Administration of Coal Mine Safety) (hereinafter referred to as the State Administration of Work Safety) guides the national safety training, and supervises and manages the national safety training according to law.

The safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government shall supervise and manage the safety training within their respective administrative areas according to law.

Provinces, autonomous regions and municipalities directly under the central government that have established coal mine safety supervision institutions shall supervise and manage the safety training of coal mine enterprises within their respective jurisdictions according to law. Chapter II Safety Training Institutions Article 5 Safety training institutions must obtain corresponding qualification certificates when engaging in safety training activities. The qualification certificate is divided into four grades.

The first-class and second-class qualification certificates are approved and issued by the State Council; Grade III and IV qualification certificates shall be approved and issued by the safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government. The provinces, autonomous regions and municipalities directly under the Central Government that set up coal mine safety supervision institutions are responsible for approving and issuing the third-and fourth-level qualification certificates of training institutions engaged in coal mine safety training activities within their respective jurisdictions. Article 6 The safety training institutions that have obtained the first-class qualification certificate may be the safety production inspectors and coal mine safety inspectors of the safety production supervision and management departments and coal mine safety supervision institutions at or above the provincial level; The main person in charge and safety management personnel of the production and business operation units of the central enterprise corporation, general factory or group company; Registration personnel of hazardous chemicals; Personnel who undertake safety evaluation, consultation, testing and inspection; Training of registered safety engineers and teachers in safety training institutions below the first level. The safety training institution that has obtained the two-level qualification certificate can undertake the work of safety production inspectors of the municipal and county-level safety production supervision and management departments; The main persons in charge and safety production management personnel of provincial production and business units, branches and subsidiaries of central enterprises and their subordinate units; Registration personnel of hazardous chemicals; Personnel who undertake safety evaluation, consultation, testing and inspection; Training for registered safety engineers and teachers in safety training institutions below Grade II.

The safety training institution that has obtained the three-level qualification certificate can undertake special operations personnel; The city (prefecture) is the training ground for the main person in charge of the production and business operation entity and the safety production management personnel.

A safety training institution that has obtained a four-level qualification certificate may undertake the training of employees of production and business units other than the first, second and third paragraphs of this article. A safety training institution at the next higher level may undertake the training of a safety training institution at the next lower level. Article 7 A safety training institution applying for a first-class qualification certificate shall meet the following conditions:

(1) Its registered capital or start-up expenses are more than 6,543,800,000 yuan;

(2) Having full-time management personnel;

(3) Having a sound constitution, management system and working system;

(4) Full-time or part-time teachers with bachelor degree or above 15 or more, including at least 8 full-time teachers with associate senior titles or above who have passed the training and examination of the National Bureau;

(5) Having fixed, independent and relatively centralized teaching and living facilities that can meet the training needs of more than 0/00 people in the same period, of which the use area of special classrooms is more than 0/50 square meters;

(six) other conditions required for safety training. Article 8 A safety training institution shall meet the following conditions when applying for the second-level qualification certificate:

(1) Its registered capital or start-up expenses are more than 800,000 yuan;

(2) Having full-time management personnel;

(3) Having a sound constitution, management system and working system;

(4) There are more than 10 full-time or part-time teachers with bachelor degree or above, and at least 5 full-time teachers with intermediate titles have passed the training and assessment of the National Bureau;

(5) There are fixed, independent and relatively centralized teaching and living facilities that can meet the training needs of more than 80 people in the same period, in which the use area of special classrooms is greater than 1.20 square meters;

(six) other conditions required for safety training.
