Provisions of the People's Republic of China on the Administration of Crew Services in Municipalities directly under the Central Government
Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Labor Contract Law of People's Republic of China (PRC), the Regulations of People's Republic of China (PRC) on Seamen and other laws and administrative regulations in order to strengthen the management of seamen's service, standardize seamen's service behavior and safeguard the legitimate rights and interests of seamen and seamen's service agencies. Article 2 These Provisions shall apply to the provision of crew services within the territory of People's Republic of China (PRC).

The term "crew service" as mentioned in these Provisions refers to the relevant procedures of applying for training, examination and certificate (including foreign crew certificate) on behalf of the crew, managing crew affairs on behalf of the crew and providing manning for the ship. Article 3 The Ministry of Transport is in charge of crew service.

The Maritime Safety Administration of the People's Republic of China is responsible for the unified implementation of crew service management.

The maritime administrative agency directly under the Ministry of Transport is responsible for crew service management; The management of inland river ship crew service is specifically responsible for the maritime administrative agencies directly under the Ministry of Transport and local maritime administrative agencies. Article 4 The State encourages the establishment of seafarers' service trade associations, standardizes trade behaviors, improves the service level of the trade, and enhances the self-discipline ability of the trade. Chapter II Qualification of Crew Service Organizations Article 5 Crew service organizations are divided into inland river ship crew service organizations and ocean-going ship crew service organizations; Ocean crew service agencies are divided into Grade A and Grade B. ..

The crew service organization of inland river ships refers to the organization that provides crew service for inland river ships.

A kind of crew service organization refers to an organization that provides various crew services for international and domestic seafarers.

Class B crew service organization refers to the organization that provides crew service for domestic seafarers. Article 6 An institution engaged in crew service of inland river vessels shall meet the following conditions:

(a) a legal person established in People's Republic of China (PRC) according to law;

(2) Having a fixed office space of not less than 100 square meter;

(three) there are more than two full-time managers and more than two full-time business personnel with first-class and second-class inland river vessel driver qualifications;

(4) Establish crew service management systems such as quality management system, personnel and resource guarantee system, education and training system, emergency response system and service business reporting system in accordance with the provisions of People's Republic of China (PRC) and China Maritime Safety Administration. Article 7 An institution engaged in crew service of Class A seagoing vessels shall meet the following conditions:

(a) a legal person established in People's Republic of China (PRC) according to law;

(2) Having a fixed office space of not less than 300 square meters;

(3) Having two or more full-time managers and five or more full-time business personnel with the first-class and first-class seafarers' qualifications;

(four) engaged in class B crew service for more than 3 years, and manning more than 500 domestic coastal ships in the last 3 years;

(5) Establish crew service management systems such as quality management system, personnel and resource guarantee system, education and training system, emergency response system and service business reporting system in accordance with the provisions of People's Republic of China (PRC) and China Maritime Safety Administration. Article 8 An institution engaged in crew service of Class B seagoing vessels shall meet the following conditions:

(a) a legal person established in People's Republic of China (PRC) according to law;

(2) Having a fixed office space of not less than 150 square meters;

(3) Having two or more full-time managers and two or more full-time business personnel with Class A, B and C seafarers' qualifications;

(4) Establish crew service management systems such as quality management system, personnel and resource guarantee system, education and training system, emergency response system and service business reporting system in accordance with the provisions of People's Republic of China (PRC) and China Maritime Safety Administration. Article 9 An institution applying for crew service business shall submit the following materials:

(a) the application documents for the establishment of the crew service organization;

(2) A copy of the business license of the enterprise as a legal person;

(3) A copy of the seaman's competency certificate or relevant certification materials of the full-time management personnel;

(4) Explanations on the personnel composition and responsibilities of the proposed institution;

(5) Documents on the management system related to crew service;

(6) Certification materials for manning domestic coastal ships (only applicable to applicants of Class A crew service agencies);

(7) Other relevant certification materials.

When providing a copy of the business license of an enterprise as a legal person and the seaman's competency certificate of full-time management personnel, the applicant shall present the original to the maritime administrative agency. Article 10 The application and acceptance of crew service agencies shall be handled in accordance with the relevant requirements of the Provisions on Procedures for the Implementation of Traffic Administrative Licensing. Article 11 An application for Class A crew service shall be submitted to the Maritime Safety Administration of the People's Republic of China.

The application for Class B crew service shall be submitted to the maritime administrative agency directly under the Ministry of Transport for industrial and commercial registration. If there is no maritime administrative agency directly under the Ministry of Transport for industrial and commercial registration, it shall be submitted to the maritime administrative agency directly under the Ministry of Transport of the People's Republic of China and the maritime administrative agency designated by the China Maritime Safety Administration.

The application for crew service of inland river vessels shall be submitted to the maritime administrative agency directly under the Ministry of Transport or the local maritime administrative agency registered for industry and commerce.

The maritime administrative agency shall make a decision of approval or disapproval within 30 days from the date of accepting the application. If it is approved, a license shall be issued to the crew service agency; If it is not approved, it shall notify the applicant in writing and explain the reasons.
