Second, the performance bond and service fee standards

1. According to the national regulations, when an operating company signs a labor contract or other forms of agreement for expatriates, there are some clauses that require payment of performance bond and service fee. Performance bond is a deposit that you must work abroad according to the provisions of the overseas labor service contract and employment contract. The performance bond will be directly handed over to the operating company that sent people abroad, and the operating company will give a receipt. After completing the labor service contract and returning to China, the operating company will return the principal and interest of the performance bond (calculated according to the interest of demand deposits during the labor service abroad) to. If you don't perform your obligations according to the contract, you have no right to ask for a refund of the deposit. Service fee refers to the expenses incurred by operating companies and units to provide organizational management services for overseas labor services.

2. According to the national regulations, the performance bond can't exceed 20% of the total contract salary (excluding overtime pay, the same below) obtained during your working abroad. To maintain a labor contract relationship with a domestic work unit, the service fee shall not exceed 25% of the total contract salary earned during working abroad; If there is no work unit during the dispatch period or the original unit is separated from the labor contract, the service fee shall not exceed 12.5% of the total contract salary earned during the work abroad. The specific payment should be calculated carefully according to the contract. Please note that you must ask for a receipt and keep it as the basis for asking for a refund in the future.

However, there is no specific amount, just a percentage of the contract salary. The specific contract can be paid by both parties. Some of the expenses of going abroad for labor services can be refunded, while others are not refunded by the cashier himself. This needs attention. If you can return it, you must keep the relevant bills and reimburse them again.
