Measures for the Administration of Sino-foreign Cooperative Vocational Skills Training in Running Schools
Chapter I General Provisions Article 1 These Measures are formulated for the purpose of implementing the Regulations on Chinese-foreign Cooperation in Running Schools in People's Republic of China (PRC) (hereinafter referred to as the Regulations on Chinese-foreign Cooperation in Running Schools) and regulating the cooperation in vocational skills training between China and foreign countries. Article 2 These Measures shall apply to the establishment, activities and management of vocational skills training institutions and school-running projects jointly organized by educational institutions in China and foreign educational institutions (hereinafter referred to as Chinese-foreign cooperatively-run schools and educational institutions including vocational skills training institutions).

The term "Chinese-foreign cooperative vocational skills training institutions" as mentioned in these Measures refers to non-profit educational institutions organized by Chinese and foreign partners in China in accordance with the Regulations on Chinese-foreign Cooperation in Running Schools and these Measures, with China citizens as the main enrollment targets and implementing vocational skills training.

The term "Sino-foreign cooperative vocational skills training program" as mentioned in these Measures refers to the vocational skills training program conducted by Chinese and foreign partners in accordance with the Regulations on Sino-foreign Cooperative Education and these Measures, instead of establishing a new vocational skills training institution, but in cooperation with existing domestic educational institutions, offering majors (occupations, jobs) and courses with China citizens as the main enrollment targets. Article 3 The State encourages the introduction of high-quality vocational skills training resources that reflect foreign advanced technology and advanced training methods according to the needs and characteristics of economic development and labor market for skilled workers.

The state encourages Chinese-foreign cooperation in running schools in emerging and urgently needed high-skilled vocational fields. Article 4 Chinese-foreign cooperative vocational skill training institutions shall enjoy the support and reward policies given by the state to private schools in accordance with laws and regulations.

The administrative department of labor and social security shall reward and commend social organizations and individuals that have made outstanding contributions to the development of Sino-foreign cooperative vocational skills training and running schools. Article 5 The administrative department of labor and social security of the State Council is responsible for the overall planning, comprehensive coordination and macro-management of Sino-foreign cooperative vocational skills training. The administrative departments of labor and social security of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the administration of Sino-foreign cooperative vocational skills training and running schools within their respective administrative areas. Chapter II Establishment of Chinese-foreign cooperatively-run vocational skills training institutions Article 6 A Chinese-foreign cooperatively-run school shall meet the conditions stipulated in the Regulations on Chinese-foreign Cooperative Education, and have corresponding qualifications and high school quality. Article 7 Chinese-foreign cooperatively-run schools shall sign cooperation agreements on the basis of equal consultation. The cooperation agreement shall include the following contents:

(1) The names and domiciles of the parties to the cooperation and the names, positions and nationalities of the legal representatives;

(two) the name, domicile, training objectives, school purpose, cooperation content and duration of the Chinese-foreign cooperative vocational skills training institution to be established;

(three) the amount, method and payment period of the assets invested by each party;

(four) the ways and procedures for the parties to resolve disputes;

(5) Liability for violating the cooperation agreement;

(six) other matters agreed by the parties to the cooperation.

The cooperation agreement shall be in Chinese. If there is a foreign language text, it shall be consistent with the Chinese text. Article 8 The capital invested by a Chinese-foreign cooperatively-run school shall be commensurate with the level and scale of the Chinese-foreign cooperatively-run vocational skills training institution to be established, and shall be verified by a statutory capital verification institution.

Chinese-foreign cooperatively-run schools shall, in accordance with the cooperation agreement, invest in running schools in full and on time. During the existence of a Chinese-foreign cooperatively-run school, the Chinese-foreign cooperatively-run school shall not withdraw or misappropriate the school funds. Article 9 The prices of physical objects, land use rights, intellectual property rights and other properties invested by Chinese-foreign cooperatively-run schools shall be determined by both parties through consultation in accordance with the principle of fairness and reasonableness, or social intermediary agencies agreed by both parties shall be engaged for evaluation according to law, and relevant property rights transfer procedures shall be handled according to law.

Educational institutions in China that invest in running schools with state-owned assets shall, in accordance with the provisions of the state on the supervision and administration of state-owned assets, employ social intermediary institutions with evaluation qualifications to make an evaluation according to law, reasonably determine the amount of state-owned assets according to the evaluation results, and report to the institutions responsible for the supervision and administration of state-owned assets for the record, and fulfill the obligations of state-owned assets management according to law. Article 10 According to the agreements signed with foreign government departments or at the request of educational institutions in China, the administrative department of labor and social security of the State Council or the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may invite foreign educational institutions to cooperate with educational institutions in China in running schools.

The invited foreign educational institutions should be educational institutions with certain influence in the world or in the host country. Article 11 The establishment of a Chinese-foreign cooperative vocational skill training institution shall be examined and approved by the administrative department of labor security of the people's government of the province, autonomous region or municipality directly under the Central Government where the institution is to be established. Article 12 The establishment of a Chinese-foreign cooperative vocational skill training institution is divided into two steps: preparation and formal establishment. Those who have the conditions for running a school and meet the set standards may directly apply for formal preparation. Thirteenth educational institutions in China to apply for the establishment of Chinese-foreign cooperative vocational skills training institutions, shall submit the documents stipulated in the regulations on Chinese-foreign cooperative education. The bid report shall be filled in according to the contents and format stipulated in the Application Form for Chinese-foreign Cooperative Vocational Skills Training Institutions formulated by the administrative department of labor and social security of the State Council according to Item (1) of Article 14 of the Regulations on Chinese-foreign Cooperative Education.

To apply for the establishment of a Chinese-foreign cooperatively-run vocational skills training institution, the registration certificate of the Chinese-foreign cooperatively-run school and the valid certification documents of its legal representative shall also be submitted in accordance with the relevant provisions of the Regulations on Chinese-foreign cooperatively-run schools, among which the relevant certification documents of foreign cooperatively-run scholars shall be certified by the notary office of the host country.
