Regulations of Zhejiang Province on Hydrological Management
Article 1 In order to strengthen hydrological management, develop hydrological undertakings, serve disaster prevention and mitigation, water resources management and public infrastructure construction, and promote sustainable economic and social development, these Regulations are formulated in accordance with the Hydrological Regulations of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to hydrological activities and their management within the administrative area of this province.

Hydrological activities mentioned in these Regulations refer to activities such as planning and construction of hydrological station network, hydrological monitoring and forecasting, investigation and evaluation of water resources, collection, storage and utilization of hydrological monitoring data, hydrological facilities and environmental protection of hydrological monitoring. Article 3 Hydrological undertakings are basic public welfare undertakings for national economic and social development. The people's governments at or above the county level shall incorporate hydrological undertakings into the national economic and social development plan, and the required funds into the fiscal budget at the corresponding level, strengthen the construction of hydrological infrastructure and professional teams, and ensure that hydrological undertakings are compatible with economic and social development.

The people's governments at or above the county level shall strengthen and guarantee the construction and operation of hydrological infrastructure in underdeveloped areas. Article 4 The water administrative department of the people's government at or above the county level shall be in charge of the hydrological work within its administrative area, and the hydrological institutions directly under it shall be specifically responsible for organizing and implementing the management work.

The provincial administrative department and the hydrological institutions directly under it shall strengthen the guidance and supervision of the hydrological institutions of cities and counties (cities, districts) with districts, coordinate the hydrological work in the whole province, and ensure the integrity, consistency and accuracy of hydrological monitoring activities.

Development and reform, finance, land and resources, environmental protection, housing and urban and rural construction, transportation, marine and fishery, meteorology, electric power and other departments shall do a good job in relevant work within their respective responsibilities. Article 5 The provincial water administrative department shall organize the compilation of the hydrological development plan of the whole province, and after soliciting the opinions of relevant provincial departments, submit it to the provincial people's government for approval and implementation, and report it to the water administrative department of the State Council for the record.

The water administrative departments of cities and counties (cities, districts) divided into districts shall, according to the needs of the province's hydrological development planning and economic and social development, organize the preparation of hydrological development planning in their respective administrative areas, solicit the opinions of the water administrative departments at the next higher level, and report to the people's government at the same level for approval and implementation. Sixth provincial hydrological institutions shall, according to the provincial hydrological development planning, organize the preparation of hydrological station network construction planning, and solicit the opinions of the provincial land and resources, environmental protection, transportation, marine and fishery, meteorology, electric power and other departments. , the provincial development and reform, the water administrative department for approval before implementation. Modifying the construction plan of hydrological station network shall be reported to the original approval authority for approval.

Hydrological station network construction planning mainly includes planning objectives, station network functions, hydrological station network layout, monitoring items, testing methods, hydrological monitoring facilities and monitoring network construction. Provincial departments of land and resources, environmental protection, transportation, ocean and fishery, meteorology, electric power, etc. shall solicit the opinions of provincial hydrological institutions when planning and constructing hydrological stations and hydrological monitoring facilities, and link them with the planning of hydrological station network construction. Article 7 Hydrological stations shall be set up in rivers with frequent flood disasters, important towns for flood control, large and medium-sized reservoirs, hydropower stations, large sluices and important intake (outlet) ports according to the requirements of hydrological station network construction planning.

Small reservoirs and hydropower stations undertaking flood control, typhoon prevention and drought relief tasks shall be equipped with hydrological monitoring facilities. Article 8 Hydrological stations are divided into national basic hydrological stations and special hydrological stations.

The establishment of special hydrological stations shall not be duplicated with the national basic hydrological stations. If it is really necessary to set up a special hydrological station in the area covered by the national basic hydrological station, it shall be approved by the provincial hydrological institution.

If it is necessary to set up a special hydrological station for traffic and environmental protection, it shall be approved by the relevant competent department; The relevant competent departments shall solicit the opinions of the provincial hydrological institutions before approval.

The cancellation of a special hydrological station shall be reported to the original approval authority for approval. Ninth hydrological station network construction in accordance with the national fixed assets investment project construction procedures to organize the implementation.

National basic hydrological stations, special hydrological stations and hydrological monitoring facilities that provide public services for flood control, typhoon prevention and drought relief, water resources management and water ecological protection shall be guaranteed by finance.

The construction and operation management funds of hydrological stations and hydrological monitoring facilities that provide services for basic engineering facilities such as water conservancy and hydropower are included in the project construction budget and operation management funds respectively. Tenth hydrological institutions at or above the county level shall strengthen the industry management of hydrological monitoring activities, strengthen the professional and technical training of hydrological monitoring personnel, and improve the quality of hydrological monitoring work.

Hydrological institutions at or above the county level may entrust relevant units or individuals to undertake hydrological monitoring projects such as rainfall and water level. The entrusted unit or individual shall engage in project monitoring in accordance with the entrusted matters and requirements.

Units and individuals engaged in hydrological monitoring activities shall abide by national and provincial hydrological technical standards, norms and procedures, ensure the objectivity and truth of monitoring data, and shall not suspend or reduce monitoring items without authorization, and shall not omit, delay, conceal or lie about hydrological monitoring information, and shall not forge hydrological monitoring data. Article 11 People's governments at or above the county level shall organize water administrative departments, hydrological institutions and relevant departments to establish flood control monitoring and early warning systems, strengthen the monitoring and early warning of regional floods in important river sections and sudden flash floods in small and medium-sized basins, and improve the ability of disaster prevention and mitigation.

Hydrological stations and water project management units undertaking flood control, typhoon prevention and drought relief tasks shall, in accordance with the provisions of the state and the province, timely and accurately provide hydrological monitoring information and dispatching operation information to hydrological institutions and flood control, typhoon prevention and drought relief headquarters.
