Provisions on the administration of entry-exit inspection and quarantine officers
Chapter I General Principles
Article 1 In order to strengthen the management of entry-exit inspection and quarantine personnel (hereinafter referred to as inspection personnel), standardize the inspection behavior of inspection personnel, and maintain the normal inspection work order, according to the People's Republic of China (PRC) Import and Export Commodity Inspection Law and its implementing regulations, the People's Republic of China (PRC) Entry-Exit Animal and Plant Quarantine Law and its implementing regulations, the People's Republic of China (PRC) Frontier Health and Quarantine Law and its implementing regulations, and the People's Republic of China (PRC) Frontier Health and Quarantine Law.
Article 2 The term "inspection and quarantine personnel" as mentioned in these Provisions refers to those who have obtained the qualifications stipulated by the General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as AQSIQ), registered in the entry-exit inspection and quarantine institutions established by AQSIQ, and handled the entry-exit inspection and quarantine business (hereinafter referred to as inspection and quarantine business).
Article 3 The General Administration of Quality Supervision, Inspection and Quarantine shall be in charge of the administration of inspection inspectors nationwide, and the inspection and quarantine institutions shall be responsible for organizing the qualification examination, registration, daily management and regular audit of inspection inspectors.
Article 4 Customs inspectors shall abide by entry-exit inspection and quarantine laws, regulations and relevant provisions when handling inspection and quarantine business, and bear corresponding legal responsibilities.
Chapter II Qualification of Inspectors
Article 5 The qualification of inspectors shall be subject to a unified national examination system. Measures for the unified national examination of inspector qualifications shall be formulated separately by the AQSIQ.
Article 6 Personnel who take the qualification examination for inspection and quarantine officers shall meet the following requirements:
(a) at least 18 years old, with full capacity for civil conduct;
(2) Having good conduct;
(3) Having a high school or secondary specialized school education or above;
(4) Other conditions stipulated by the AQSIQ.
Article 7 Those who have passed the qualification examination shall obtain the inspector qualification certificate. If you have not been engaged in inspection business within 2 years, the certificate of inspection inspector will automatically become invalid.
Chapter III Registration of Inspectors
Article 8 Only those who have obtained the Qualification Certificate of the Commissioner of Customs can apply for the registration of the Commissioner of Customs.
Article 9 An enterprise that has been registered by an inspection and quarantine institution and obtained the code of the inspection and quarantine institution shall apply to the inspection and quarantine institution at the place of registration and submit the following materials:
(a) an application for registration of inspectors;
(2) The registration certificate of the enterprise to which the inspector belongs in the inspection and quarantine institution;
(3) Qualification certificate of the inspector to be appointed; (4) Other documents required by the inspection and quarantine institution.
Article 10 The inspection and quarantine institution shall examine the submitted materials, and if they pass the examination, register them and issue an inspector's certificate.
Article 11 The inspection inspector's certificate is the identity certificate of the inspection inspector and may not be lent or altered.
Those who have not obtained the Inspection Certificate shall not engage in inspection business.
Article 12 Where inspection and quarantine personnel are transferred to other local enterprises to engage in inspection and quarantine business, they shall go through the formalities of change with the issuing inspection and quarantine institution with the supporting documents of the transferred enterprises; Where an enterprise is transferred to another place to engage in inspection and quarantine business, it shall go through the cancellation procedures with the inspection and quarantine institution in the transferred place, and re-register with the inspection and quarantine institution in the place where the transferred enterprise is located with the cancellation certificate. After approval, the inspection and quarantine institution shall issue a new inspector certificate.
Article 13 Inspectors of inspection institutions shall not concurrently serve as inspection agents of more than two inspection institutions.
The inspector of a self-care inspection unit shall not concurrently serve as the inspection work of more than two self-care units.
Article 14 If an inspector loses his inspector's certificate, he shall submit a statement to the issuing inspection and quarantine institution within 7 days and declare it invalid in the newspaper. Within the validity period, the inspection and quarantine institution shall reissue it. The inspector shall not apply for inspection before re-issuing the inspector certificate.
Fifteenth in any of the following circumstances, the enterprise to which the inspector belongs shall withdraw its Inspector Certificate and apply in writing to the local inspection and quarantine institution for cancellation of the Inspector Certificate:
(a) the inspector is no longer engaged in inspection business;
(2) The enterprise stops the inspection business for some reason;
(3) The enterprise dismisses the inspector.
The legal liability arising from the failure to handle the cancellation procedures of the inspector's certificate shall be borne by the enterprise to which the inspector belongs.
Chapter IV Duties of Inspectors
Article 16 Inspection inspectors shall handle inspection business on behalf of affiliated enterprises according to law. Inspection inspectors have the right to refuse to handle the inspection business with false documents and incomplete procedures assigned by affiliated enterprises.
Article 17 An inspector shall be responsible for his subordinate enterprise, accept the guidance and supervision of the inspection and quarantine institution, and perform the following obligations:
(a) comply with the relevant laws and regulations and inspection and quarantine regulations;
(2) When handling the inspection and quarantine business, provide true data and complete and valid documents in strict accordance with the regulations, fill in the inspection and quarantine form accurately and clearly, and pay relevant fees within the specified time;
(three) to participate in the inspection and quarantine business training organized by the inspection and quarantine institutions;
(four) to assist subordinate enterprises to keep all kinds of inspection documents, bills, letters and telegrams;
(five) to undertake other work related to the inspection and quarantine business.
Chapter V Supervision and Administration
Eighteenth inspection and quarantine institutions are responsible for the professional training, daily management and regular audit of registered inspectors.
Nineteenth inspection and quarantine institutions shall implement the error registration system for the management of inspection inspectors.
Article 20 The validity period of the Certificate for Inspection Inspector is 2 years, and 0 months before the expiration, the inspection inspector shall submit an application for examination to the inspection and quarantine institution that issued the certificate.
Twenty-first inspection and quarantine institutions shall examine the inspection inspectors in combination with the daily inspection records.
After passing the examination, the validity period of the "inspector certificate" is extended for 2 years.
If the inspection fails, the inspector shall participate in the inspection business training organized by the inspection and quarantine institution. After passing the examination, the validity of the inspector's certificate will be extended for 2 years.
If the applicant fails to apply for the examination or fails the training examination, the validity period of the inspector's certificate shall not be extended.
Article 22 If a customs inspector commits any of the following acts, the inspection and quarantine institution shall suspend his qualification for inspection for three or six months:
(a) does not fulfill the provisions of article seventeenth, if the circumstances are serious;
(2) There are more than three errors in the inspection report within1year, and the circumstances are serious;
(3) Lending or altering the inspector's certificate.
Article 23 If an inspector commits any of the following acts, the inspection and quarantine institution shall cancel his qualification for inspection and revoke his certificate:
(1) Failing to declare the inspection truthfully, thus causing serious consequences;
(2) Providing false contracts, invoices, bills of lading and other documents;
(3) Forging, altering, buying, selling, stealing or altering inspection and quarantine clearance forms, inspection and quarantine certificates, seals, marks, seals and quality certification marks;
(four) other violations of inspection and quarantine laws and regulations, the circumstances are serious.
Twenty-fourth inspectors in the inspection business activities have other illegal acts, in accordance with relevant laws and regulations.
Chapter VI Supplementary Provisions
Article 25 The Inspector Qualification Certificate and Inspector Certificate shall be uniformly printed by the AQSIQ.
Article 26 The AQSIQ shall be responsible for the interpretation of these Provisions.
Article 27 These Provisions shall come into force as of June 1 day, 2003.
