The National People's Congress is held once a year and convened by the NPC Standing Committee. If the NPC Standing Committee deems it necessary, or more than one-fifth of the deputies to the National People's Congress propose, a meeting of the National People's Congress may be convened temporarily.
When the National People's Congress is in session, it elects a presidium to preside over the session.
The NPC Standing Committee Conference
The NPC Standing Committee is the permanent organ of the National People's Congress, and is responsible to the National People's Congress and reports its work. The NPC Standing Committee consists of chairman, vice-chairmen, secretary-general and members.
The chairman, vice-chairmen and secretary-general of the NPC Standing Committee form a chairman's meeting to handle the important daily work of the Standing Committee. The term of office of the NPC Standing Committee is the same as that of the National People's Congress.
Chairman the National People's Congress Standing Committee (NPCSC)'s meeting is responsible for handling the National People's Congress Standing Committee (NPCSC)'s important daily work.
Including: deciding the duration of each meeting of the Standing Committee and drawing up the draft agenda of the meeting; Decided to submit the bill submitted to the Standing Committee to the relevant special committee for deliberation or to the plenary meeting of the Standing Committee for deliberation; To guide and coordinate the daily work of the special committees; Handle other important daily work of the Standing Committee.
The National People's Congress exercises the following functions and powers
Amend the constitution;
Supervise the implementation of the Constitution;
To formulate and amend criminal, civil, state institutions and other basic state laws;
To elect President and Vice-President People's Republic of China (PRC);
According to the nomination of President People's Republic of China (PRC), decide the candidates for Premier People's Republic of China (PRC) and Premier the State Council; According to the nomination of Premier the State Council, decide the candidates for Vice Premier the State Council, State Councilor, ministers of ministries, directors of committees, auditor-general and secretary-general;
Elect chairman of the Central Military Commission; According to chairman of the Central Military Commission's nomination, decide the candidates for other members of the Central Military Commission (CMC);
Elect President the Supreme People's Court;
Elect the Attorney General of the Supreme People's Procuratorate;
Review and approve the national economic and social development plan and its implementation report;
To examine and approve the national budget and the report on its implementation;
Changing or revoking inappropriate decisions of the NPC Standing Committee;
To approve the establishment of provinces, autonomous regions and municipalities directly under the Central Government;
To decide on the establishment of special administrative regions and their systems;
Issues that determine war and peace;
Other functions and powers that should be exercised by the highest organ of state power.
The National People's Congress has the power to recall the following persons
Chairman and Vice Chairman People's Republic of China (PRC);
Premier the State Council, Deputy Prime Ministers, State Councillors, Ministers of Ministries, Directors of Committees, Auditor-General and Secretary-General;
Other members from chairman of the Central Military Commission and the Central Military Commission (CMC);
Dean the Supreme People's Court;
Attorney General of the Supreme People's Procuratorate.
Review and approve the national economic and social development plan and its implementation report; Review the central and local budgets and their implementation reports, and approve the central budget and its implementation reports.
Change or cancel inappropriate decisions of the NPC Standing Committee.
To approve the establishment of provinces, autonomous regions and municipalities directly under the Central Government; To decide on the establishment of special administrative regions and their systems; Issues that determine war and peace. Other functions and powers that should be exercised by the highest organ of state power.
The NPC Standing Committee shall exercise the following functions and powers:
Interpret the Constitution and supervise its implementation;
To enact and amend laws other than those that should be enacted by the National People's Congress;
When the National People's Congress is not in session, partially supplement and amend the laws enacted by the National People's Congress, but they shall not contravene the basic principles of the law;
Explain the law;
When the National People's Congress is not in session, examine and approve some adjustment plans that must be made in the implementation of the national economic and social development plan and the national budget;
Supervise the work in the State Council, the Central Military Commission (CMC), the Supreme People's Court and the Supreme People's Procuratorate;
To revoke the administrative regulations, decisions and orders formulated by the State Council that contravene the Constitution and laws;
To annul local regulations and resolutions formulated by the organs of state power of provinces, autonomous regions and municipalities directly under the Central Government that contravene the Constitution, laws and administrative regulations;
When the National People's Congress is not in session, according to the nomination of Premier the State Council, decide the candidates for ministers, committee directors, auditors-general and secretary-general;
When the National People's Congress is not in session, decide the candidates for other members of the Central Military Commission (CMC) on the basis of chairman of the Central Military Commission's nomination;
To appoint and remove the Supreme People's Court's executive vice president, vice presidents, judges, members of judicial committees and presidents of military courts at the request of President the Supreme People's Court;
According to the Supreme People's Procuratorate's request, to appoint and remove the Supreme People's Procuratorate's deputy chief procurators, deputy chief procurators, procurators, members of procuratorial committees and chief procurators of military procuratorates, and to approve the appointment and removal of chief procurators of people's procuratorates of provinces, autonomous regions and municipalities directly under the Central Government;
To decide on the appointment and removal of plenipotentiaries abroad;
To decide on the ratification and abrogation of treaties and important agreements concluded with foreign countries;
To stipulate the military rank system and other special military rank systems for military and diplomatic personnel;
To stipulate and decide on medals and honorary titles awarded to the state;
Decide on Amnesty;
When the National People's Congress is not in session, it may decide to declare a state of war if the country is invaded by armed forces or must fulfill international treaties to prevent aggression;
Decide on national mobilization or local mobilization;
Deciding to put the whole country or individual provinces, autonomous regions and municipalities directly under the Central Government into a state of emergency;
Other functions and powers granted by the National People's Congress.
