The term "full-time fire brigade" as mentioned in these Provisions includes the full-time fire brigade of the government and the full-time fire brigade of enterprises and institutions. The government full-time fire brigade refers to the full-time fire brigade established by the township (town) people's government and sub-district offices except the public security fire brigade; The full-time fire brigade of enterprises and institutions refers to the full-time fire brigade established by enterprises and institutions.

Full-time fire brigade shall be established by local people's governments, enterprises and institutions in accordance with fire laws and regulations, combined with the actual needs of the region and the unit. The following areas and units shall establish full-time fire brigades:
(1) townships (towns) with a gross regional product 1 100 million yuan or more and a population of 50,000 or more;
(2) Sub-district offices with a gross regional product 1 100 million yuan or more, a population of 50,000 or more, and a distance from the public security fire brigade;
(3) Nuclear power plants, large power plants, large ports and civil airports; Large enterprises that produce and store inflammable and explosive dangerous goods; Large warehouses and bases for storing important flammable materials; Other large enterprises with greater fire risk and far away from the public security fire brigade; The management unit of the ancient architectural complex listed as the national key cultural relics protection unit far away from the public security fire brigade;
(four) other units that the local people's government believes should establish a full-time fire brigade.
Development zones, bonded zones, industrial zones, science and technology parks, business districts, townships (towns), sub-district offices, enterprises and institutions other than those specified in the preceding paragraph may establish full-time fire brigades independently or jointly.
Article 4
The main responsibilities of the full-time fire brigade are:
(a) the full-time fire brigade of the government is responsible for the fire publicity and training, fire inspection and fire fighting and rescue of the people's government at the corresponding level; The full-time fire brigade of enterprises and institutions is responsible for the fire propaganda and training, fire inspection and fire fighting and rescue of the unit.
(two) to participate in the rescue work of dangerous chemicals leakage accidents, building collapse accidents, traffic accidents, etc. And actively rescue the trapped people and eliminate the danger.
(three) to accept the dispatch and command of the public security fire control institutions in the area, and to participate in the fire fighting in other areas and units.
Article 5
The personnel, barracks construction, equipment and equipment of full-time fire brigade shall be implemented with reference to the construction standards of ordinary fire stations in the National Standards for the Construction of Urban Fire Stations, and the specific standards shall be formulated separately by the Provincial Public Security Department.
Article 6
The full-time fire brigade of enterprises and institutions can be divided into three levels according to the construction scale: detachment, brigade and squadron. Set up more than two full-time fire squadrons or more than 50 people less than 100 people, you can set up a full-time fire brigade; If more than five full-time fire squadrons or more than one hundred people are formed, a full-time fire brigade can be formed. Full-time fire brigade and full-time fire brigade under detachment are called full-time fire squadron.
Article 7
The establishment or cancellation of a full-time fire brigade shall conform to the relevant provisions of the state, be audited by the local public security fire control institution and be submitted to the provincial public security fire control institution for approval.
Article 8
Full-time fire brigades are managed by local people's governments and enterprises and institutions.
Article 9
The local people's government shall include the funds required by the government's full-time fire brigade in the financial budget, and the units shall be responsible for the funds required by the full-time fire brigade in enterprises and institutions, so as to provide financial guarantee for the infrastructure construction, barracks construction, equipment construction, business construction and daily work of the full-time fire brigade.
Article 10
Public security fire control institutions shall give professional guidance to full-time fire brigades. Full-time fire brigade carries out business work under the guidance of public security fire control institutions.
Article 11
Government full-time firefighters are recruited by the people's government at the same level, and full-time firefighters in enterprises and institutions are recruited by enterprises and institutions, and reported to local county-level fire control institutions for the record.
Full-time firefighters implement the labor contract system and sign labor contracts according to law.
Article 12
Full-time firefighters shall meet the following conditions:
(a) love fire control work;
(two) in good health, more than eighteen years old and less than thirty-five;
(3) Having a junior high school education or above.
Article 13
Full-time fire brigade implements the captain responsibility system. Captain (division commander, deputy division commander, battalion chief, deputy division commander, mid-team leader and deputy mid-team leader) is appointed by the people's government at the corresponding level and the unit, and reported to the local public security fire control institutions at or above the county level for the record.
Article 14
Full-time fire brigade captains are trained by provincial public security fire control institutions, and full-time firefighters are trained by municipal public security fire control institutions.
Article 15
Full-time firefighters should wear obvious signs and uniforms when performing tasks.
Article 16
Full-time fire brigade shall implement paramilitary management, establish and improve various rules and regulations, and standardize the order of study, training, work, duty and life.
Article 17
Full-time fire brigade shall implement the system of staying on duty day and night, taking leave from work and handing over on duty. Maintain fire fighting equipment and equipment according to regulations, and keep personnel and equipment in a good emergency state at any time. Fire fighting equipment on duty shall not be used for non-fire fighting work.
Article 18
Full-time fire brigade shall establish and improve the training inspection and assessment system, and actively carry out technical, tactical and physical training.
Article 19
Full-time fire brigade should carry out discipline-abiding education, enhance discipline awareness, consciously abide by national laws and regulations and fire brigade rules and regulations, obey orders and obey management.
Article 20
Full-time fire brigade should actively carry out fire prevention publicity and training, publicize fire prevention knowledge and laws and regulations through various channels, train volunteer firefighters and workers, and improve the self-defense and self-rescue ability of the whole people.
Article 21
Full-time fire brigade shall regularly conduct fire safety inspections in the area under its jurisdiction, and urge relevant units to eliminate fire hazards. If it is still not corrected after being urged, it shall report to the public security fire control institution in time.
Article 22
Full-time fire brigade shall implement the principle of giving priority to saving people, dispatch quickly, save people and evacuate materials in time, report to local public security fire control institutions, and assist public security fire control institutions in investigating and counting the causes of disasters and accidents.
Article 23
After receiving the fire fighting and rescue instruction from the public security fire control institution, the full-time fire brigade shall be dispatched quickly and accept the command of the public security fire control institution.
Article 24
Fire engines used by full-time fire brigades for fire fighting and rescue are exempt from vehicle tolls.
Article 25
Full-time fire brigade duty fire engines (boats) are included in the management scope of special vehicles (boats), and special vehicles (boats) can be licensed, and alarms and signs can be installed and used.
Article 26
Approved by the local public security fire control institutions, the full-time fire brigade is responsible for compensating the expenses of fuel, fire extinguishing agent and damaged fire fighting equipment and equipment required for fire fighting outside the jurisdiction; The local people's government shall give appropriate compensation for the expenses needed to put out residents' fires; The expenses incurred by enterprises, institutions and residential buildings participating in insurance for fire fighting shall be compensated from the rescue expenses paid by insurance companies in accordance with relevant state regulations.
Article 27
The wages of full-time government fire brigade members shall not be lower than the average wage level of employees in local institutions, and enjoy the welfare benefits of employees in institutions; The wages of full-time firefighters in enterprises and institutions shall not be lower than the average wage level of front-line production workers in their own units, and they shall enjoy the welfare benefits of production workers.
Article 28
The establishment unit of full-time fire brigade shall, in accordance with the provisions, handle social insurance for full-time firefighters such as pension, medical care, work injury, unemployment and maternity, and purchase necessary commercial insurance for full-time firefighters.
Article 29
Full-time firefighters should take 20 days off every year according to the vacation system of public security fire brigade members, and enjoy various benefits during the vacation.
Article 30
Full-time firefighters are injured, disabled or sacrificed in business training, fire fighting and rescue and on duty, and the relevant administrative departments, enterprises and institutions shall handle them in accordance with the provisions on labor insurance or casualty compensation; In accordance with the provisions of the Regulations on the Praise of Revolutionary Martyrs, revolutionary martyrs shall be declared in accordance with the prescribed procedures.
Article 31
Full-time fire brigade shall, under the premise of not affecting duty and business training, carry out other vocational skills training in a planned way to create favorable conditions for members to leave the team and re-employment.
Article 32
The local people's governments, enterprises and institutions shall commend and reward full-time fire brigades and firemen who have made outstanding contributions in fire fighting and rescue and fire safety work.
Article 33
In violation of the provisions of any of the following circumstances, according to the seriousness of the case, the directly responsible person in charge and other directly responsible personnel shall be punished; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) the township (town) people's government, street offices, enterprises and institutions failed to establish a full-time fire brigade in accordance with the provisions, resulting in the failure to effectively put out the fire after the fire, resulting in a major fire accident;
(two) the full-time fire brigade was slow to dispatch after receiving the fire alarm, causing heavy casualties and property losses;
(three) the full-time fire brigade does not accept the fire fighting and rescue dispatching command of the public security fire control institutions.
Article 34
These Provisions shall come into force as of February 6, 2009.
