The Road Traffic Safety Law is the first basic law in China that comprehensively regulates the rights and obligations of road traffic participants. Under the unified organization of the unit, we concentrated on studying the full text, carefully studied each clause by ourselves, and repeatedly compared with the relevant laws and regulations in the past, and got a new understanding, as follows:

First, the new Road Traffic Safety Law is conducive to further standardizing urban traffic, and more importantly, protecting others and protecting themselves. 1999 Shenyang issued a government order, clearly stipulating for the first time in the country that pedestrians are fully responsible for five kinds of traffic accidents, and drivers who are hit by pedestrians in violation of regulations are irresponsible. Caused a "white collision?" This question is very controversial. This violates the spirit of humanism and the basic principle of legislation-to protect people's lives and property safety and legitimate rights and interests. Human life is above everything else. If it is wrong for pedestrians to violate the rules, they will lose their health and even their lives, and the price will be too high. Isn't it even more wrong for drivers who hit people to deprive others of their right to health and survival? Even if it is not intentional, it shows that the driver's safety vigilance is not high, and his ability to deal with emergencies is not strong, so he should bear the responsibility. Now the new traffic regulations clearly stipulate that if a motor vehicle has a traffic accident with a non-motor vehicle driver or pedestrian, the motor vehicle party shall bear the responsibility; However, if there is evidence that non-motor vehicle drivers and pedestrians violate road traffic safety laws and regulations, and the motor vehicle drivers have taken necessary measures, the responsibility of the motor vehicle party shall be reduced. The loss of traffic accidents is intentionally caused by non-motor vehicle drivers and pedestrians, and the motor vehicle side is not responsible. Completely denying the statement of "white collision" has sounded the alarm for drivers' safety vigilance. In the new traffic law, there are also related penalties for pedestrians' violations, which not only remind drivers, but also restrain pedestrians to some extent. Therefore, the new "Road Traffic Safety Law" should be popularized to the people all over the country, so that the masses can raise their awareness of traffic regulations. The purpose is not only to regulate urban traffic, but more importantly, to protect oneself in order to protect others.

Second, the new "Road Traffic Safety Law" pays more attention to raising the awareness of national traffic norms and promoting the humanitarian spirit of saving lives. After the traffic accident, the injured were lying on the ground dripping with blood, but the surrounding villagers were guarding the scene of the accident to prevent people from destroying it, and they had to wait for the traffic police to deal with it, so the injured could not be treated in time, leading to excessive blood loss and death. It was a great shock to me at that time, not only the innocent death of the injured, but also the ignorance and paranoia of the villagers. This is not the only thing. There are many reasons why traffic accidents are not treated in time. For example, the driver abandoned the injured and fled the scene; After the injured were taken to the hospital, they were not treated because of economic problems and so on. Life that could have been saved was delayed, causing irreparable consequences. In the current road traffic safety law, the humanitarian spirit has also been fully reflected. Article 70 stipulates that if a traffic accident occurs on the road, the driver of the vehicle shall stop immediately to protect the scene; If personal injury or death is caused, the driver of the vehicle shall immediately rescue the injured and report to the traffic police on duty or the traffic management department of the public security organ in time. If the scene is changed due to the rescue of the injured, the location shall be indicated. Passengers, drivers of passing vehicles and passers-by shall give assistance. Moreover, Article 75 stipulates that medical institutions should promptly rescue people injured in traffic accidents, and should not delay treatment because the rescue expenses are not paid in time. If the vehicle involved in the accident participates in compulsory motor vehicle third-party liability insurance, the insurance company shall pay the rescue expenses within the liability limit; Rescue expenses exceed the liability limit, and did not participate in compulsory motor vehicle third-party liability insurance or escape after the accident, the road traffic accident social assistance fund shall advance part or all of the rescue expenses, and the road traffic accident social assistance fund management institution has the right to recover from the person responsible for the traffic accident. In addition to these regulations, a compulsory motor vehicle third-party liability insurance system has been implemented, and a social assistance fund for road traffic accidents has been established. These regulations fully reflect the respect for life and ensure the timely rescue of the injured. They not only put forward requirements for drivers and witnesses, but also made relevant regulations for medical institutions, avoiding regrets and tragedies to the maximum extent. Therefore, while raising the awareness of national traffic norms, we should pay attention to the cultivation of humanistic spirit, improve humanistic quality, and carry forward the humanitarian spirit of saving lives.

Three, the new "Road Traffic Safety Law" focuses on ensuring that traffic police, as law enforcers, can perform their duties fairly and strictly, and will not cause unwarranted damage to pedestrians and motor vehicles. The new law has specially formulated corresponding binding provisions to ensure that motor vehicle drivers will no longer pay "unfair fines". It also stipulates that traffic police will be subject to administrative sanctions if they collect fines privately, illegally detain vehicles, and fail to turn over fines to the state treasury. There has always been a saying that traffic police have a penalty target, how many cars are fined on the road every day, and how many fines are collected. In the past, this statement has also been confirmed by some traffic police. When collecting fees or fines, they are very willing to overcharge or punish them, because the money has direct benefits to institutions and individuals, so these fines are called "unjust fines". The new law clearly stipulates that all localities shall not issue fines to traffic police, and all fines collected according to law shall be turned over to the state treasury. This phenomenon of arbitrary fines has been completely eliminated, and the legitimate rights and interests of drivers have been safeguarded. In addition, the law's handling of illegal drivers also reflects the "people-oriented". If the driver is on the scene, he will be punished according to the regulations, and the trailer is not allowed. The trailer shall not charge the parties. If the trailer is damaged improperly, it shall be compensated according to law.
