How to carry out training to improve the quality and ability of prosecutors
To become a prosecutor, you must meet the following conditions:

(1) Having China nationality;

(2) At least 23 years old;

(3) Supporting the Constitution of People's Republic of China (PRC);

(4) Having good political and professional qualities and good conduct;

(5) Being in good health;

(6) Graduated from an institution of higher learning with a bachelor's degree in law or a non-law major with legal professional knowledge, and engaged in legal work for two years, including serving as the chief procurator of the people's procuratorate of a province, autonomous region or municipality directly under the Central Government or the prosecutor of the Supreme People's Procuratorate, and engaged in legal work for three years; Master's degree, doctor of law or master's degree or doctor's degree of non-law major, with legal professional knowledge, engaged in legal work for one year, among which, those who served as chief procurator or procurator of the people's procuratorate in the Supreme People's Procuratorate, a province, autonomous region or municipality directly under the Central Government, engaged in legal work for two years.

Public procurators before the implementation of this Law who do not meet the requirements specified in Item 6 of the preceding paragraph shall receive training, and the specific measures shall be formulated by the Supreme People's Procuratorate.

If it is really difficult to apply for the academic qualifications specified in Item 6 of the first paragraph, after examination and determination by the Supreme People's Procuratorate, within a certain period of time, the academic qualifications as a prosecutor may be relaxed to graduate from a law college.

Interpretation of this article is about the requirements of being a public prosecutor.

According to the provisions of the first paragraph of this article, a public prosecutor must meet the following conditions:

(1) Having China nationality. That is, prosecutors must be citizens of China, not foreigners or stateless persons. At the same time, according to the provisions of the Nationality Law, China does not recognize dual nationality. Therefore, a public prosecutor may not acquire the nationality of another country while holding the nationality of China, nor may he renounce the nationality of China during his term of office.

(2) At least 23 years old. The 23-year-old here refers to one year old, which is the minimum age requirement for being a prosecutor. Objectively speaking, the professional characteristics of prosecutors require that prosecutors should have rich legal knowledge, social experience, life experience and the ability to deal with various complex problems. If the prosecutor is too young, it may be difficult to be competent for procuratorial work. Therefore, when the Public Prosecutor Law was revised this time, many people suggested that the working age of public prosecutors should be appropriately raised. Considering that the current age standard for judges and prosecutors is the same, they are all over 23 years old, which is also the age stipulated in the Organic Law of the People's Court. Therefore, this issue was not revised when the Public Prosecutor Law was revised this time. In fact, judging from the current situation of appointing prosecutors in the procuratorial system, it is rare to be appointed as prosecutors just after the age of 23.

(3) Support the Constitution of People's Republic of China (PRC). The Constitution is the fundamental law and the basis for making other laws. Advocating the Constitution of People's Republic of China (PRC) requires prosecutors not only to abide by the principles stipulated in the Constitution, but also to always safeguard the dignity of the Constitution in procuratorial activities.

(4) Having good political and professional qualities and good conduct. Prosecutors are staff members of state organs exercising state judicial power. Prosecutors must support the national political system and basic principles stipulated in the Constitution, and have a high degree of political consciousness, keen insight and a strong sense of political responsibility. Only in this way can they accomplish the mission entrusted to them by the Constitution and laws. It can be said that good political quality is the political basis for prosecutors to do a good job. Good professional quality means that prosecutors must be proficient in business, familiar with procuratorial work, and be able to correctly use the power given by law to handle cases. Good conduct means that prosecutors should have good moral quality, words and deeds, consciously safeguard social morality, abide by professional ethics and behave in a civilized manner. Only in this way, can we establish the image of the prosecutor's impartial law enforcement.

(5) good health. This means that when nominated or appointed as a prosecutor, the person should be in good health. That is, the prosecutor's physique should be competent for procuratorial work. This is a requirement for the physical quality of prosecutors.

This is about the regulations on the qualifications and working years of prosecutors. This provision is to further improve the quality of prosecutors, which is an important revision of the law on prosecutors. Article 10, paragraph 1, item 6 of the original Public Prosecutors Law stipulates the qualifications and working years of public prosecutors: "Those who have graduated from a law major in an institution of higher learning or a non-law major in an institution of higher learning and have worked for two years; Or get a bachelor's degree in law and work for one year; Those who have obtained a master's degree in law or a doctor's degree in law may not be restricted by the above-mentioned working years. " With the gradual implementation of the basic strategy of governing the country according to law and the development requirements of legal system construction, procuratorial practice requires prosecutors' professional knowledge more and more, and the new Amendment to the Prosecutor Law has made stricter provisions on the qualifications of prosecutors.
