Article 5 The municipal and district people's governments shall strengthen their leadership in the management of hospital safety order within their respective administrative areas, provide guarantee for hospital safety order, guide and supervise health and public security departments to perform their duties according to law, improve and perfect the information notification of medical complaints, mediation of medical disputes and linkage mechanism between doctors and police, and make overall plans to solve related problems in the management of hospital safety order. Article 6 The health department shall perform the following duties:
(a) improve medical and health service measures, improve the quality of medical services, guide and supervise hospitals to prevent and properly handle medical disputes;
(two) to develop hospital safety order management norms, establish and improve the hospital safety order management assessment mechanism, and carry out hospital safety order management inspection;
(three) to guide and supervise the hospital to formulate safety and risk management systems and emergency plans, and to carry out safety education and training and emergency drills;
(four) in conjunction with the relevant departments to deal with medical complaints and reports in a timely manner, organize and guide hospitals to deal with major medical safety incidents, and release information in a timely manner. Article 7 Public security organs shall perform the following duties:
(a) to guide the hospital to formulate internal security system, and urge the hospital to implement public security measures;
(two) to inspect and guide the construction and safety inspection of civil air defense, physical defense and technical defense in hospitals;
(three) the organization of daily patrol prevention and control in the hospital, and timely police, rapid disposal, punishment according to law.
The municipal public security organ shall, jointly with the municipal public health department, formulate and publish a list of items prohibited and restricted by the hospital. Article 8 A hospital sponsor shall perform the following duties:
(1) Strengthen the investment in the construction of hospital safety facilities, provide the necessary guarantee for the management of hospital safety order, supervise and inspect the implementation of hospital safety management measures, and eliminate and reduce the hidden dangers of hospital safety order;
(two) to urge hospitals to carry out safety education and training to improve emergency response and risk prevention capabilities;
(three) to assist the relevant departments to deal with major medical safety incidents. Article 9 A hospital shall perform the following duties:
(a) the implementation of real-name registration system medical and non emergency appointment registration, improve the medical environment, enhance the medical experience, improve the quality of medical services;
(two) to establish and improve the hospital safety management system, improve the mechanism and plan for grading medical safety incidents, and organize emergency response drills;
(3) Establish a security system for medical personnel, strengthen the education, training and management of medical personnel, improve their professional ethics, professional quality and medical service level, and enhance their own awareness and ability of security;
(four) the establishment of medical dispute risk assessment system, regular analysis of medical disputes, to prevent, reduce and properly solve medical disputes;
(five) clear public security specialized agencies, organize daily maintenance of public security order;
(six) when a medical safety incident occurs, immediately start the emergency plan and quickly carry out emergency treatment. Article 10 The municipal and district health departments, public security organs, hospitals and public security police stations shall establish a joint meeting system, discuss and report information, analyze the public security situation of hospitals, conduct investigation and mediation of contradictions and disputes, conduct risk assessment and early warning, and jointly handle medical safety incidents. Article 11 The health department shall, jointly with the public security organs and other units, establish a hospital safety information platform in the whole city, and enjoy medical dispute information, high-risk medical personnel information, medical-related 1 10 alarm information, and medical-related criminal data. Twelfth public security organs should intervene in advance in medical disputes and other medical safety risks that may lead to public security or criminal cases, carry out preventive treatment, educate the parties in the legal system and warn them of the consequences of their actions. Thirteenth public security organs should set up police offices in hospitals above the second level in accordance with the regulations, equipped with the necessary police force; The police office and the public security department of the hospital work together. The hospital should provide necessary working conditions for the police room.
The police in the police room should strengthen the inspection and guidance on the daily safety and security work of the hospital, urge the hospital to do a good job in the construction of safety prevention system, and carry out patrol, prevention and control, and disposal work.
For hospitals without police offices, local police stations and hospital security departments should establish daily working mechanisms and implement security duties. Fourteenth hospitals should establish and improve the complaint reception system, standardize complaint handling procedures, do a good job in publicity and guidance, and guide complainants to resolve disputes through legal channels such as consultation, mediation and litigation.
When a medical dispute occurs, the hospital doctor-patient relationship mediation department shall immediately send personnel to communicate with patients or their close relatives and actively resolve the dispute; For cases that may lead to public security or criminal cases, the person in charge of the hospital should intervene in time.
