Five laws of limited space

On March 6, 20 17, state administration of work safety Decree No.89 was promulgated, which will come into force as of the date of promulgation, and five normative documents, such as Regulations on Safe Operation in Limited Space, were abolished.

Law of People's Republic of China (PRC) on Work Safety

Article 1 This Law is formulated with a view to strengthening production safety, preventing and reducing production safety accidents, ensuring the safety of people's lives and property, and promoting sustained and healthy economic and social development.

Article 2 This Law is applicable to the safe production of units engaged in production and business operation in People's Republic of China (PRC) (hereinafter referred to as production and business operation units); Where relevant laws and administrative regulations have other provisions on fire safety and road traffic safety, railway traffic safety, water traffic safety, civil aviation safety, nuclear and radiation safety and special equipment safety, such provisions shall prevail.

Article 3 Work safety in production should be people-oriented, adhere to safe development, adhere to the policy of safety first, prevention first and comprehensive management, strengthen and implement the main responsibility of production and business units, and establish a mechanism in which production and business units are responsible, employees participate, government supervision, industry self-discipline and social supervision.

Article 4 Production and business operation entities must abide by this Law and other laws and regulations concerning safety in production, strengthen the management of safety in production, establish and improve the responsibility system for safety in production and safety rules and regulations, improve the conditions for safety in production, promote the standardization of safety in production, raise the level of safety in production and ensure safety in production.

Article 5 The principal responsible person of a production and business operation entity shall be fully responsible for the safety production of the entity.

Article 6

Employees of production and business units have the right to obtain safety production guarantee according to law, and shall fulfill their obligations of safety production according to law.

Article 7 Trade unions shall supervise the work of production safety according to law. The trade union of a production and business operation entity shall organize employees to participate in the democratic management and supervision of production safety in the entity according to law, and safeguard the legitimate rights and interests of employees in production safety. The production and business operation entities shall listen to the opinions of the trade unions when formulating or amending the rules and regulations related to production safety.

Article 8 the State Council and local people's governments at or above the county level shall formulate safety production plans according to the national economic and social development plans and organize their implementation. Safety production planning should be linked with urban and rural planning. The State Council and the local people's governments at or above the county level shall strengthen their leadership over the work of production safety, support and urge all relevant departments to perform their duties of supervision and administration of production safety according to law, establish and improve the coordination mechanism of production safety, and coordinate and solve major problems existing in the supervision and administration of production safety in a timely manner. The agencies of local people's governments, such as township people's governments, neighborhood offices, development zone management agencies, etc., shall, in accordance with their duties, strengthen supervision and inspection of the safety production of production and business units within their respective administrative areas, and assist the relevant departments of the people's governments at higher levels to perform their duties of supervision and management of safety production according to law.

Article 9 The supervision and administration department of production safety in the State Council shall, in accordance with this Law, exercise comprehensive supervision and administration over the work of production safety throughout the country. The supervision and administration departments of production safety of local people's governments at or above the county level shall, in accordance with this Law, exercise comprehensive supervision and administration over the work of production safety within their respective administrative areas. The relevant departments of the State Council shall, in accordance with the provisions of this Law and other relevant laws and administrative regulations, supervise and manage the work of production safety in relevant industries and fields within their respective functions and duties; The relevant departments of the local people's governments at or above the county level shall, in accordance with the provisions of this law and other relevant laws and regulations, supervise and manage the work safety in related industries and fields within their respective functions and duties. Departments responsible for the supervision and administration of production safety and departments responsible for the supervision and administration of production safety in related industries and fields are collectively referred to as departments responsible for the supervision and administration of production safety.

Article 10 The relevant departments of the State Council shall, according to the requirements of ensuring safe production, formulate relevant national standards or industrial standards in a timely manner according to law, and make timely revisions according to the progress of science and technology and economic development. Production and business units must implement national standards or industry standards formulated according to law to ensure safety in production.

Eleventh people's governments at all levels and their relevant departments should take various forms to strengthen the publicity of safety laws, regulations and knowledge, and enhance the awareness of safety in production in the whole society.

Twelfth relevant associations and organizations shall, in accordance with laws, administrative regulations and articles of association, provide production safety information and training services for production and business units, play a self-discipline role, and promote production and business units to strengthen production safety management.

Article 13 Institutions established according to law to provide technical and management services for safe production shall, in accordance with laws, administrative regulations and industry standards, accept the entrustment of production and business operation entities to provide technical and management services for their safe production. Where a production and business operation entity entrusts an institution specified in the preceding paragraph to provide safe production technology and management services, the responsibility for ensuring safe production shall be borne by the entity.

Article 14 The State implements the system of investigating the responsibility for production safety accidents, and investigates the legal responsibility of the persons responsible for production safety accidents in accordance with this Law and relevant laws and regulations.

Article 15 The State encourages and supports scientific and technological research on production safety and the popularization and application of advanced technologies for production safety, so as to improve the level of production safety.

Article 16 The State shall reward units and individuals that have made remarkable achievements in improving safe production conditions, preventing production safety accidents and participating in emergency rescue.

Chapter II Production Safety Guarantee of Production and Business Units

Article 17 A production and business operation entity shall meet the conditions for safe production as stipulated in this Law and relevant laws, administrative regulations, national standards or industrial standards; Those who do not have the conditions for safe production shall not engage in production and business activities.

Article 18 The principal responsible person of a production and business operation entity shall bear the following responsibilities for the safe production of the entity: (1) Establish and improve the safe production responsibility system of the entity; (two) to organize the formulation of safety production rules and regulations and operating procedures of the unit; (three) to organize the formulation and implementation of the unit's safety production education and training plan; (four) to ensure the effective implementation of the unit's investment in production safety; (five) to supervise and inspect the work safety of the unit, and eliminate the hidden dangers of production safety accidents in time; (six) to organize the formulation and implementation of the emergency rescue plan for production safety accidents in this unit; (seven) timely and truthfully report the production safety accidents.

Article 19 The responsibility system for production safety of production and business operation entities shall specify the responsible personnel, scope of responsibility and assessment criteria. Production and business units shall establish corresponding mechanisms, strengthen supervision and assessment of the implementation of the responsibility system for production safety, and ensure the implementation of the responsibility system for production safety.

Article 20 The capital investment necessary for the conditions of safe production that a production and business operation entity should possess shall be guaranteed by the decision-making organ, principal responsible person or individual investor of the production and business operation entity, and it shall be responsible for the consequences caused by insufficient capital investment necessary for safe production. The relevant production and business units shall, in accordance with the provisions, extract and use the expenses for safe production, which shall be used exclusively to improve the conditions for safe production. The cost of production safety shall be truthfully charged in the cost. Specific measures for the extraction, use, supervision and management of production safety expenses shall be formulated by the finance department of the State Council in conjunction with the production safety supervision and management department of the State Council in consultation with relevant departments of the State Council.

Twenty-first mining, metal smelting, construction, road transport units and dangerous goods production, management and storage units shall set up safety production management institutions or be equipped with full-time safety production management personnel. Where there are more than 100 employees in other production and business units other than those specified in the preceding paragraph, a safety production management institution shall be set up or full-time safety production management personnel shall be equipped; If the number of employees is less than 100, it shall be equipped with full-time or part-time safety production management personnel.

(1) Organizing or participating in the formulation of safety production rules and regulations, operating rules and emergency rescue plans for production safety accidents; (two) to organize or participate in the safety education and training of the unit, and truthfully record the safety education and training; (three) to supervise the implementation of safety management measures for major hazard sources in this unit; (four) to organize or participate in the emergency rescue drills of the unit; (five) to check the safety production situation of the unit, timely investigate the hidden dangers of production safety accidents, and put forward suggestions to improve the safety production management; (six) to stop and correct illegal command, forcing risky operations and violations of operating procedures; (seven) to supervise the implementation of the rectification measures for safety production in this unit.

Twenty-third production safety management institutions and safety management personnel of production and business units shall fulfill their duties and perform their duties according to law. Production and business units shall listen to the opinions of the safety production management institutions and safety production management personnel when making business decisions involving safety production. The production and business operation entity shall not reduce the wages, welfare and other benefits or terminate the labor contract concluded with the safety production management personnel because they perform their duties according to law. The appointment and removal of the person in charge of production safety of dangerous goods production and storage units and mining and metal smelting units shall be notified to the competent department responsible for the supervision and administration of production safety.
