Secret-related personnel management has always been the focus of security work, and it is one of the three major management in security work (secret-related management, network security management and secret-related personnel management). The Secrecy Law clarifies the definition of secret-related personnel and formulates a series of management systems for secret-related personnel before, after and when they leave the country.
Personnel working in classified posts are referred to as classified personnel for short. "Secret-related posts" refer to posts that are generated, managed or frequently contacted and know state secrets in daily work. The personnel working in the above positions are core secret-related personnel, important secret-related personnel and general secret-related personnel.
The appointment and employment of confidential personnel shall be reviewed in accordance with the relevant provisions. Secret-related personnel should have good political quality and conduct, and have the professional quality and working ability required to be competent for secret-related positions.
The appointment and employment of secret-related personnel shall be subject to the examination system, which shall be conducted by the employing unit, and the personnel department shall, in conjunction with the secret-related working institutions, conduct strict pre-job examinations according to the qualifications of the secret-related personnel. The evaluation content generally includes the basic situation, actual performance, main social relations of individuals and families, and contacts with institutions, organizations and personnel outside the country (territory).
Secret-related personnel shall master the knowledge and skills of confidentiality through confidentiality education and training, sign a confidentiality undertaking, strictly abide by confidentiality rules and regulations, and shall not disclose state secrets in any way.
The confidentiality undertaking signed by the secret-related personnel before taking up their posts mainly includes understanding and abiding by various confidentiality systems, knowing and fulfilling confidentiality obligations, voluntarily accepting confidentiality review, and assuming legal responsibilities.
The exit of classified personnel must be approved by the relevant departments. Article 37 of the Secrecy Law stipulates that the exit of secret-related personnel shall be approved by the relevant departments. If the relevant authorities think that the exit of the secret-related personnel will endanger national security or cause great losses to national interests, they shall not be approved to leave the country.
The relevant department refers to the competent department in charge of approving and appointing secret-related personnel in accordance with the cadre personnel management authority. "Relevant organs" refer to public security organs and state security organs.
The relevant departments shall strictly control the exit examination and approval of secret-related personnel, and solicit opinions from public security organs and state security organs when necessary. If the public security organ or the state security organ considers that the exit of classified personnel may cause harm to national security or cause great losses to national interests, the relevant departments shall not approve it.
