When it comes to the amount of refund, the training institution immediately starts all kinds of deductions. First, all kinds of gifts when registering for payment should be converted into cash and deducted from the expenses; Second, online courses and teaching materials are bundled and sold at a high price, which should be deducted from the expenses; Third, the remaining class hours are recorded unilaterally by the school. In the past, all the classes of students' personal leave and sick leave were cancelled, resulting in little expenditure for the remaining classes. Fourth, when it comes to the cancellation of recommendation fees, training institutions have begun to play Tai Chi, and it is unclear which students are recommended.
I am still psychologically prepared for this kind of behavior of training institutions. First, I wrote a different opinion on the handling methods of training institutions, and sent it to the person in charge of the campus on WeChat. After several days, I didn't respond. After the inquiry, I was told that I had reported to the leader and needed to wait for the notice. At first glance, it was the beginning of wrangling, so I immediately sent a lawyer's letter on the first working day after the holiday, solemnly stating our position and never tolerating arbitrary deduction. The original unreasonable training institution, the head of the campus enthusiastically called me the next day to discuss reconciliation. Because the content of the call involves substantive issues, after learning that the other party is the person in charge of the training institution, I called back again and recorded it, fixing the evidence by recording the imperfect facts before. In the end, the training institutions refunded nearly 20,000 yuan, which was more than 6,000 yuan compared with the previous 1.3 million yuan.
The time span of this refund event was not long, and it did not give the other party too many opportunities to prevaricate, and it was handled relatively cleanly. But in the whole process, there are also many experiences, which are now sorted out for parents' reference.
First, you can't go to the training institution to sign before all the expenses are settled clearly.
Some training institutions require parents to sign for a refund. But if you are in a hurry to refund the fee, I'm afraid there will be clauses in many agreements that you have the right to give up when signing the contract, and then discuss with the training institution whether the refund is reasonable after signing the contract. It is estimated that the training institution will refuse to negotiate again on the grounds that the parents have signed for confirmation.
Second, it doesn't matter if the contract is not stamped or lost, as long as there is a payment voucher or transfer record.
Many parents' contracts are only signed by parents, and no training institution seals them. The contract retained by the training institution shall be signed and sealed by both parties. However, this does not affect the exercise of rights. Even if the contract is lost, the existence of payment voucher or transfer record can prove the existence of legal relationship.
Third, how to deal with the gifts, online courses and teaching materials presented at the time of registration?
About all kinds of gifts given at the time of registration
Although training institutions may claim that gifts are conditional gifts, it is certainly unreasonable to ask for all gifts when the course has been consumed by half or even half. If there is no agreement on the gift in the terms of the contract, there is no basis for asking to deduct the gift at the original price when refunding the fee. Even if there is an agreement on the value of the gift in the terms of the contract, it is unreasonable for the training institution to ask for full deduction according to the agreed value when the course has been consumed, not to mention that the pricing of the gift is open to question, and it is impossible for the training institution to say as much as possible.
About the cost of online courses
At present, most training institutions have their own online courses, requiring children to practice at home after class. I strongly disagree with the statement that the training institution requires that each child must deduct 2000 yuan from the online course because the online course of my Erbao has not been activated. Moreover, most training institutions will not mention the online courses when signing contracts with parents to introduce courses, and will deduct extra fees when refunding them in the future.
On the cost of teaching materials
The training institution that I refunded the fee thinks that online courses and teaching materials are tied together. Even if online courses are not enabled, textbooks will still be deducted at 2000 yuan per person. My opinion is that there is no pricing at the back of the two textbooks. At present, training institutions set their own prices at 2000 yuan, which is not in line with the market pricing law, infringes on the legitimate rights and interests of consumers and violates the relevant provisions of price management. Moreover, I have repeatedly stressed that the teaching materials are given to students by training institutions in order to achieve the course objectives, and are also used by students to cooperate with the teaching plan of training institutions, so the fees should not be calculated.
Fourth, don't worry about the "overlord clause" in the contract, which is invalid.
Some parents have a lot of concerns when refunding fees, thinking that the contract has stated that one month's class can't be refunded and so on. For this format text provided unilaterally by training institutions, the "overlord clause" is invalid.
Fifth, the remaining class hours must be personally verified in the computer of the training institution.
At present, every class hour in training institutions is very expensive, about one hour in 200 yuan. If you miss a few classes, parents will lose a lot. Moreover, when calculating the remaining class hours, some training institutions did not count the class hours that children had taken leave before, thus virtually "swallowing" the class hours that children did not consume. Many parents may not pay attention, and some training institutions will clear all the time for children to take leave before the end of the year. The training institution that negotiated with me, because I discovered this problem two years ago, agreed not to give me zero points at the end of each year after strongly protesting with the then campus supervisor, which is why the course Dabao mentioned above has almost been finished, but there are still many remaining courses. Many parents don't know this, so even if they cleaned up at the end of the year, they didn't raise any objections. In fact, after careful calculation, the class fee is really quite a lot.
Sixth, about the fixation and preservation of evidence.
In order to avoid the lack of parents' evidence in future disputes, it is suggested to keep the WeChat chat record with the person in charge of the training institution, and ensure that the person in charge lists the detailed calculation method of expenses and sends it to WeChat to avoid wrangling in the future. In view of the unreasonable calculation method of training institutions, it is suggested to record the focus of disputes by telephone recording, and at the same time propose solutions and clear time limits. Because the recorded evidence is the on-site language negotiation between the two parties, which can better restore the true intentions and ideas of the training institutions, it is necessary to save the relevant evidence in the mobile phone.
In addition, don't delete the WeChat of relevant personnel just because you are angry with the training institution. It is very necessary to save the chat record. Even if all matters are properly resolved, in order to avoid other disputes in the future, we can't delete the WeChat of the staff of the training institution, and we can choose to blacken it.
Seventh, about the settlement of the referral fee.
Most training institutions have referral fees, which are either withdrawn or registered next time. If the referral fee before the refund is not converted into the registration fee, it must be refunded together with the training institution when discussing the refund. Otherwise, when you go back to settle the referral fee after the refund, I'm afraid the training institution will ignore you.
Eighth, about the time limit for refund.
When I sent a lawyer's letter, I advocated that the training institution should pay the corresponding interest from the date when I asked for a refund to the date when I actually paid all the fees. On the day I went to the training institution for refund, I asked the training institution how long it would take to transfer the money to my account. The training institution said that it would take six working days, which is "working days". I said it was too long, and the training institution said it would be urgent for me, but it would take two weeks "working days" at the earliest. I immediately objected, because the annual interest of 1 10,000 yuan can be guaranteed to 2,400 yuan, and if the interest of 20,000 yuan is delayed for one month, I will lose 800 yuan. Then on the third day, the training institution transferred all the expenses and paid them off.
Ninth, the lawyer's letter is small and expensive, but it is worth sending.
Some training institutions are particularly willing to "seesaw". One of the functions of the lawyer's letter is to tell the training institution that if you don't solve it for me, I will sue you, and all expenses will be borne by you. Training institutions certainly don't like litigation, because once the illegality of his behavior and the clear refund method are confirmed by the effective judgment, I am afraid that many parents in similar situations will come to the door.
In short, in the event of a dispute with a training institution, we must pay attention to collecting and retaining relevant evidence, so as to know ourselves and ourselves, so as to effectively safeguard our rights and interests in the negotiation.
The above only represents personal views, and don't spray if you don't like it.
