According to Article 9 of the Labor Contract Law, the employer shall not detain the employee's identity card and other documents, and shall not require the employee to provide a guarantee or collect property from the employee in other names. Article 22 Where an employing unit provides special training fees and professional technical training for laborers, it may conclude an agreement with the laborers to stipulate the service period. If the laborer violates the service period agreement, he shall pay liquidated damages to the employer in accordance with the agreement. The amount of liquidated damages shall not exceed the training expenses provided by the employer. The liquidated damages that the employer requires the laborer to pay shall not exceed the training expenses that should be shared for the unfinished part of the service period. Therefore, the forklift training organized by the company and the certificates obtained belong to the employees themselves; If an individual employee wants to leave his/her job halfway, he/she must pay his/her share of the training expenses to the company. The forklift license obtained is only the qualification to drive a forklift, and there is generally no skill subsidy. You can ask the company to get the forklift license back. If the company doesn't give it, you can complain to the local labor administrative department. Otherwise, according to the provisions of Article 84 of the Labor Contract Law, if the employer violates the provisions of this law and detains the employee's resident identity card and other documents, the labor administrative department shall order it to return the employee within a time limit and impose penalties in accordance with relevant laws and regulations.
