Interim provisions on the property manager system

Chapter I General Provisions

Article 1 In order to standardize property management behavior, improve the quality of property management professionals, and safeguard the interests of owners and users of houses, these Provisions are formulated in accordance with the relevant provisions of the Property Management Regulations and the national vocational qualification certificate system.

Article 2 These Provisions shall apply to professional managers engaged in property management in property management enterprises.

Article 3 The term "property managers" as mentioned in these Provisions refers to professional managers who have passed the national unified examination, obtained the Qualification Certificate of People's Republic of China (PRC) Property Managers (hereinafter referred to as the Qualification Certificate), and registered and obtained the Registration Certificate of People's Republic of China (PRC) Property Managers (hereinafter referred to as the Registration Certificate) according to law, and are engaged in property management.

Article 4 The state shall implement a professional access system for professional managers engaged in property management, and bring it into the unified planning of the national professional and technical personnel's professional qualification certificate system.

Chapter II Examination

Article 6 The qualification of property managers shall be subject to the examination system of unified outline and unified proposition throughout the country, which shall be held once a year in principle.

Article 7 The Ministry of Construction shall organize the establishment of an expert committee for the qualification examination of property managers, which shall be responsible for drawing up the examination subjects and syllabus, organizing the proposition, and establishing and managing the examination question bank.

Article 8 The Ministry of Personnel shall organize experts to examine and approve examination subjects, examination outlines and examination questions, and organize the implementation of examinations; In conjunction with the Ministry of construction, study and determine the qualified standards, and guide, supervise and inspect the examination work.

Ninth People's Republic of China (PRC) citizens, abide by national laws and regulations, abide by professional ethics, meet one of the following conditions, you can apply to participate in the property management qualification examination:

(1) Obtained technical secondary school education in economics, management science and engineering or civil engineering, and worked for 10 years, including 8 years in property management.

(two) to obtain a college degree in economics, management science and engineering or civil engineering, and to work for 6 years, including 4 years in property management.

(three) to obtain a bachelor's degree in economics, management science and engineering or civil engineering, and have worked for 4 years, including 3 years in property management.

(4) Graduated from a double bachelor's degree or postgraduate program in economics, management science and engineering or civil engineering, and worked for 3 years, including 2 years in property management.

Article 10 If a property manager passes the qualification examination, the Ministry of Personnel and the Ministry of Construction shall entrust the personnel administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government to issue a qualification certificate uniformly printed by the Ministry of Personnel and stamped with the seals of the Ministry of Personnel and the Ministry of Construction. The certificate is valid nationwide.

Article 11 Where a qualification certificate is obtained by improper means, the personnel administrative department of the people's government of a province, autonomous region or municipality directly under the Central Government shall withdraw the qualification certificate. From the date of withdrawing the qualification certificate, you may not take the property manager qualification examination again within 3 years.

Chapter III Registration

Twelfth people who have obtained the Qualification Certificate can practice in the name of property management personnel after registration.

Article 13 The Ministry of Construction is the examination and approval authority for the qualification registration of property managers. The real estate departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government are the registration and examination institutions for the qualifications of property management personnel.

Fourteenth persons who have obtained qualification certificates and applied for registration shall be employed by enterprises with property management qualifications, and apply for registration at the provincial registration examination institution where the enterprise is located in industrial and commercial registration.

Article 15 After receiving the applicant's registration application materials, the registration examination institution shall inform the applicant of all the contents that need to be corrected on the spot or within five working days if the application materials are incomplete or do not conform to the statutory form. If it is not submitted within the time limit, it will be accepted as of the date of receipt of the application materials.

To accept or reject an application for registration, a written certificate stamped with the special seal of the registration examination institution and dated shall be issued.

Article 16 The registration examination institution shall, within 20 working days from the date of accepting the application for registration, complete the examination of the application materials in accordance with the prescribed conditions and procedures, and report the materials and examination opinions of the registration applicant to the registration examination and approval institution for examination and approval.

The registration examination and approval authority shall make a decision within 20 working days from the date of accepting the materials of the registration applicant. If a decision cannot be made within the prescribed time limit, the applicant shall be informed of the reasons for extending the time limit.

If the decision of approval is made, it shall be delivered to the applicant for registration within 10 working days from the date of approval, and a registration certificate shall be issued. If a decision on disapproval is made, the reasons shall be explained in writing, and the applicant shall be informed of the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.

Seventeenth property management qualification registration is valid for 3 years. "Registration Certificate" is the practice certificate of property management personnel within the validity period, which is kept and used by the holder.

Article 18 An initial registrant may apply for registration within 1 year from the date of obtaining the qualification certificate. Those who fail to apply within the time limit must meet the requirements of continuing education in these Provisions when applying for initial registration.

The following materials are required for initial registration:

(a) People's Republic of China (PRC) property management initial registration application form;

(2) qualification certificate;

(3) The labor contract signed with the employing unit;

(four) the continuing education certification materials of those who apply for initial registration within the time limit.

Article 19 Anyone who needs to continue practicing after the expiration of registration shall apply for renewal of registration in accordance with the procedures stipulated in Article 14 of these Provisions within 30 working days before the expiration of registration. The registration examination and approval authority shall, according to the application of the applicant, make a decision to renew the registration within the prescribed time limit; If no decision is made within the time limit, it shall be deemed that the renewal of registration has been granted.

The following materials need to be submitted when renewing the registration:

(a) the application form for renewal of registration of People's Republic of China (PRC) property manager;

(two) the labor contract signed with the employer;

(3) Proof materials that meet the requirements of continuing education during the registration period.

Twentieth in the period of registration, property management division to change the practice unit, shall go through the registration of change in accordance with the provisions of Article fourteenth of these measures. After the change of registration, its registration certificate shall remain valid within the original registration period.

The following materials need to be submitted when changing the registration:

(a) the application form for the change of registration of People's Republic of China (PRC) property manager;

(two) the labor contract signed with the new employer;

(three) the certificate of job transfer or the certificate of termination of the labor contract with the original employer, and the retirement certificate of the retirees.

Twenty-first property managers lose their capacity for civil conduct, die or are declared missing, and their registration certificates are invalid.

Twenty-second registration applicants in any of the following circumstances, the registration examination and approval authority shall not register:

(a) does not have full capacity for civil conduct;

(two) the criminal punishment has not been completed;

(3) Having received criminal punishment in property management activities, and it has not been more than 2 years since the date of execution of criminal punishment to the date of application for registration;

(4) Other circumstances in which registration is not allowed by laws and regulations.

Twenty-third property managers or employers in any of the following circumstances, I or the employer shall apply to the local registration examination institution according to the prescribed procedures, and after the approval of the registration examination institution, go through the cancellation procedures and recover the registration certificate.

(a) does not have full capacity for civil conduct;

(2) applying for cancellation of registration;

(three) the termination of labor relations with the employer;

(4) Failing to renew the registration upon the expiration of the registration period;

(5) The registration has been cancelled according to law;

(six) causing major accidents or being punished by criminal punishment in property management projects;

(seven) the business license of the employer is revoked;

(eight) the employing unit has its property management qualification certificate revoked;

(nine) the employer is bankrupt;

(ten) other circumstances that should cancel the registration.

Article 24 Where an applicant for registration obtains registration by improper means, the registration examination and approval authority shall cancel the registration and impose administrative punishment according to law; The parties shall not apply for registration again within 3 years; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 25 A person whose registration has been cancelled or unregistered may apply for registration in accordance with the procedures stipulated in Article 14 of these Provisions if he meets the initial registration conditions and the conditions for continuing education.

Twenty-sixth registration and examination and approval authorities shall regularly publish the relevant information of registration. If a party refuses to accept the cancellation of registration, refusal to register or cancellation of registration, it may apply for administrative reconsideration or bring an administrative lawsuit according to law.

Chapter IV Practice

Twenty-seventh property management personnel in accordance with the "Property Management Regulations" and related laws, regulations and rules to carry out business activities.

Article 28 The person in charge of a property management project shall be a property manager. Property management personnel can only be responsible for the management of property management projects in enterprises with property management qualifications.

Twenty-ninth property management personnel should have the ability to practice:

(a) to master the professional knowledge of property management, construction engineering, real estate development and management;

(two) have a certain knowledge of economics, management, sociology, psychology and other related disciplines;

(3) Being able to skillfully use the laws, regulations and relevant provisions related to property management;

(4) Having rich practical experience in property management.

Thirtieth property management division's scope of practice:

(a) to formulate and organize the implementation of the property management plan;

(two) to review and supervise the implementation of the financial budget of property management;

(three) inspection * * * housing, * * housing facilities and related information;

(four) responsible for the maintenance, conservation and management of houses and supporting facilities and equipment and related sites;

(five) to maintain the environmental sanitation and order of the property management area;

(six) other matters stipulated by laws and regulations and the property management contract.

Thirty-first key documents in property management project management must be implemented after being signed by the property manager, and bear corresponding legal responsibilities.

Thirty-second property managers should properly handle the problems in property management activities, in accordance with the provisions of the property service contract, honest and trustworthy, to provide property management services consistent with the quality and price for the owners.

Thirty-third property management personnel should receive continuing education, update their knowledge, and constantly improve their professional level. Receive continuing education for at least 40 hours every year.

Chapter V Supplementary Provisions

Thirty-fourth professional managers who have been engaged in property management for a long time before the promulgation of these regulations, have rich practical experience in property management and meet the examination conditions, can obtain the qualification of property manager through the examination.

Thirty-fifth people who have obtained the "qualification certificate", the employer may appoint an economist according to the needs of the work.

Thirty-sixth Hong Kong and Macao residents who meet the registration requirements for the examination may apply for taking the qualification examination for property managers. The applicant shall submit his/her identity certificate, corresponding professional education or degree certificate recognized by the education administrative department of the State Council, and relevant years of work and property management at the time of registration. Measures for professional and technical personnel in Taiwan Province Province to take the examination shall be formulated separately.

Measures for the administration of foreign professionals applying for the qualification examination, registration and practice of property managers shall be formulated separately.

Article 37 The content of continuing education for property management personnel, the number of property management personnel equipped by property management enterprises and the specific measures for registration management shall be formulated separately by the Ministry of Construction.

Article 38 Personnel administrative departments at all levels, real estate administrative departments, property manager qualification examinations and other institutions, in the process of implementing the property manager system, should compensate the legitimate rights and interests of professional managers according to the relevant provisions of the state, and can recover from the relevant responsible persons.

Thirty-ninth personnel administrative departments at all levels, real estate administrative departments and property management qualification examinations and other institutions staff, do not perform their duties, poor supervision, for their own or others to seek personal gain. Give administrative sanctions according to the seriousness of the case. If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 40 These Provisions shall come into force as of June 5, 2005+February 6+10/October 5.

Measures for the implementation of the qualification examination for property managers

Article 1 The Ministry of Personnel and the Ministry of Construction jointly set up the Property Manager Qualification Examination Office (hereinafter referred to as the Examination Office, located in the Ministry of Construction), which is responsible for the research and management of relevant examination policies. The specific examination work is entrusted to the examination center of the Ministry of Personnel.

The examination work of all provinces, autonomous regions and municipalities directly under the Central Government shall be organized and implemented by the local personnel administrative department in conjunction with the real estate administrative department, and the specific division of responsibilities shall be determined through consultation.

Second property management practitioners qualification examination subjects for the basic system and policy of property management, property management practice, comprehensive ability of property management and property management.

Article 3 The qualification examination lasts for four and a half days. The examination time of Basic System and Policy of Property Management, Property Management and Comprehensive Ability of Property Management is 2.5 hours, and the examination time of Property Management Practice is 3 hours.

Article 4 Anyone who meets the relevant registration requirements of the Interim Provisions on the Property Manager System (hereinafter referred to as the Interim Provisions) may register for the qualification examination of property managers.

Article 5 Those who meet the relevant registration conditions in the Interim Provisions, have been evaluated and engaged in senior professional and technical positions in engineering or economy before February 36, 2004, and have been engaged in property management for more than 65 days, may be exempted from the two subjects of Basic System and Policy of Property Management and Property Management, and only participate in the internship of property management.

Article 6 The examination results shall be managed in a rolling way, with a period of two years. Those who take all the four subjects must pass all the subjects in two consecutive examination years. Those who are exempt from some subjects must pass the examination subjects within one examination year.

Article 7 When I apply for taking the exam, I shall bring the relevant certificates and materials issued by my unit to the local examination management institution for registration. Examination management institutions shall issue admission tickets after passing the examination in accordance with the prescribed procedures and registration conditions. Participants take the exam at the designated time and place with the admission ticket.

Professional managers of all departments and subordinate units of central management enterprises in the State Council signed up for the examination according to the principle of territoriality.

Article 8 The examination date is the third quarter of each year. In principle, the test sites are located in universities, technical secondary schools or designated schools for college entrance examination in provincial capital cities and municipalities directly under the Central Government. If it is really necessary to set up in other cities, it must be approved by the Ministry of Construction and the Ministry of Personnel.

Ninth property management qualification examination and related fees, must be approved by the local administrative department of price, and announced to the public, accept the supervision of the masses.

Tenth adhere to the principle of separation of examination and training. Anyone who participates in the examination work (including life, examination and organization and management) shall not participate in the examination and hold training related to the examination content. Candidates attend relevant training and adhere to the principle of voluntariness.

Eleventh examination work should strictly implement the relevant rules and regulations of examination work, conscientiously do a good job of confidentiality in the process of making, printing and sending test papers, strictly abide by the confidentiality system, and prevent leakage.

Twelfth examination staff should strictly abide by the examination work discipline, conscientiously implement the examination avoidance system. Violation of examination discipline and relevant regulations shall be dealt with in accordance with the Provisions on Disciplinary Handling of Qualification Examination for Professional and Technical Personnel (Order No.3 of the Ministry of Personnel).
