The company may conclude an agreement and stipulate the service period by providing special expenses for external training and conducting special technical training for the workers. If an employee resigns within the agreed service period, he/she shall pay the company the liquidated damages that should be shared for the unexpired part of the service period and not exceed the training expenses as agreed. For example, the company provides workers with a special technical training fee of 4,000 yuan and an agreed service period of two years. If the laborer resigns after working for one year, he shall pay the company a penalty of 2,000 yuan.

Article 22 Where an employing unit provides special training fees and professional technical training for laborers, it may conclude an agreement with the laborers to stipulate the service period.

If the laborer violates the service period agreement, he shall pay liquidated damages to the employer in accordance with the agreement. The amount of liquidated damages shall not exceed the training expenses provided by the employer. The liquidated damages that the employer requires the workers to pay shall not exceed the training expenses that should be shared for the unfinished part of the service period.
