Chapter I General Provisions
Article 1 In order to prevent illegal interference with civil aviation activities, strengthen civil aviation air defense safety and civil aviation anti-terrorism work, maintain civil aviation order and ensure civil aviation safety, these Regulations are formulated in accordance with the Civil Aviation Law of People's Republic of China (PRC) and the Anti-Terrorism Law of People's Republic of China (PRC).
Article 2 Scope of Application These Regulations shall apply to all civil aviation activities and organizations and individuals related to civil aviation activities in People's Republic of China (PRC).
These Regulations shall apply to civil aircraft of People's Republic of China (PRC) nationality engaged in civil aviation activities outside the territory of People's Republic of China (PRC), unless otherwise stipulated in international treaties concluded or acceded to by People's Republic of China (PRC).
Article 3 Division of Duties Civil aviation safety and security work shall follow the principle of unified management and division of responsibilities.
The competent civil aviation authority in the State Council leads the national civil aviation security work, formulates civil aviation security rules, standards and national civil aviation security plans, and implements industry supervision and management.
Local people's governments at or above the municipal level with districts and their relevant departments shall, in accordance with the law, implement territorial management of aviation safety and security work at civil airports within their respective jurisdictions.
Article 4 The competent department of aviation security The competent department of civil aviation of the State Council shall, jointly with the public security department of the State Council, set up a civil aviation public security organ to conduct unified management, inspection and supervision of civil aviation security work.
Article 5 Duties of Civil Aviation Public Security Organs The public security organs of the competent civil aviation authorities in the State Council shall guide, inspect and supervise the civil aviation public security work of the public security organs at civil airports and air police agencies.
Civil airport public security organs and air police agencies are responsible for civil aviation security work in civil airports and aircraft in flight in accordance with regulations.
Article 6 Civil airport management institutions, public air transport enterprises, air traffic management departments and other units shall abide by civil aviation safety laws, regulations and rules and undertake the following tasks:
(a) according to the national civil aviation security plan, formulate the civil aviation security plan of the unit, and report it to the regional civil aviation administration for approval;
(two) strictly implement the relevant measures of civil aviation safety and security, and eliminate the hidden dangers that endanger the safety of civil aviation in a timely manner;
(three) according to the provisions of the competent civil aviation authorities in the State Council, regular civil aviation anti-terrorism and security training and drills;
(four) after the occurrence of illegal interference, measures shall be taken in accordance with the relevant provisions and reported to the competent civil aviation authority. After the incident is handled, a written report shall be made to the competent civil aviation authority of the State Council in a timely manner.
(five) to formulate pre-plan measures to prevent and deal with terrorist activities, equip with updated prevention and disposal equipment and facilities, and conduct regular training and drills.
(six) the implementation of risk assessment, real-time monitoring of security threats, improve internal security management, and regularly report the implementation of preventive measures to the public security organs and competent departments.
The units specified in the preceding paragraph shall set up special civil aviation security institutions to be responsible for the aviation security work of their own units.
Article 7 Guarantee of Personnel, Materials and Funds Relevant departments of the State Council, local people's governments and civil aviation enterprises and institutions shall provide personnel, materials and funds for civil aviation security work, encourage and support the research and innovation of new security technologies, and develop, popularize and use advanced security technologies and equipment.
Article 8 Information Construction The competent civil aviation authorities and public security organs in the State Council shall strengthen the information work of civil aviation safety and improve the ability of anti-terrorism information work.
Civil airport management agencies, public air transport enterprises, service guarantee companies and other units shall strengthen the work of civil aviation security information, obey and cooperate with the State Council civil aviation authorities and public security organs to carry out intelligence information work, and provide information obtained in civil aviation security work in a timely manner in accordance with relevant regulations.
Article 9 Background Investigation Civil aviation practitioners shall accept security background investigation including illegal and criminal situations.
Article 10 Safety protection of overseas institutions and facilities Civil aviation overseas institutions, personnel and important facilities shall take corresponding safety and security measures. Those who have suffered or may suffer from terrorist attacks shall take emergency measures in accordance with the relevant provisions of the state and the competent civil aviation authorities.
Article 11 Other law-abiding passengers, consignors and consignees of goods and other personnel related to civil aviation activities shall abide by the laws, regulations and rules on civil aviation safety management when participating in civil aviation activities.
Twelfth reward citizens have the right to report to the public security organs premeditated hijacking, destruction of civil aircraft or other acts endangering the safety of civil aviation.
Units or individuals that have made outstanding contributions to the maintenance of civil aviation safety shall be rewarded by the relevant people's governments or the competent civil aviation authorities in the State Council.
Thirteenth confidentiality obligations The relevant departments, units and individuals shall keep confidential the state secrets, business secrets and personal privacy they know in the process of performing their duties and obligations in security work.
Anyone who divulges state secrets, business secrets and personal privacy in violation of regulations shall be investigated for legal responsibility according to law.
Chapter II Safety of Civil Air Transport Airports
Article 14 Safety Requirements for Airport Operation A civil air transport airport shall meet the following safety requirements:
(1) Having the safety guarantee facilities and equipment of the civil air transport airport that meet the standards;
(two) the establishment of airport control area, equipped with special security personnel;
(3) The public security organ stationed at the airport and equipped with personnel and equipment suitable for the passenger flow at the airport;
(4) Having a safety inspection agency, equipped with personnel and equipment suitable for the airport passenger flow;
(5) Having a full-time fire fighting organization, and being equipped with personnel and equipment according to the airport fire fighting level;
(6) Having an airport security plan that meets the requirements stipulated by the competent civil aviation authority of the State Council;
(seven) to formulate plans and measures for the prevention and disposal of terrorist activities, and to equip them with updated prevention and disposal equipment and facilities;
(eight) to formulate emergency plans for aviation safety, equipped with necessary emergency rescue facilities and equipment;
(9) Other conditions that should be met.
Fifteenth anti-terrorism funds guarantee the State Council and the local people's governments at or above the county level shall, according to their duties, include the airport anti-terrorism funds in the fiscal budget at the same level, and provide financial guarantee.
Article 16 The superior competent unit that coordinates and cooperates with the airport management institution shall strengthen the leadership over the security work of the civil air transport airport, urge the airport management institution to perform the security management duties according to law, and coordinate and solve the problems in the airport security work.
Article 17 Airport Security Committee A civil air transport airport with on-site units shall set up an airport aviation security committee.
Eighteenth airport control areas should take strict safety measures for management, and implement closed zoning management. Personnel, articles and vehicles entering the airport control area shall be subject to security inspection.
Personnel and vehicles entering the airport control area shall hold passports of the airport control area. The specific administrative measures shall be formulated by the competent civil aviation authority of the State Council.
Article 19 Persons who enter the airport control area with control area certificates shall apply to the airport public security organ for an airport control area pass. The airport public security organ shall, in accordance with the relevant provisions of the competent civil aviation department of the State Council, conduct background investigation on the personnel entering the control area, issue certificates, and implement supervision and management.
Article 20 Civil aircraft safely parked at the airport on the ground shall take safety measures to prevent unauthorized personnel from contacting them.
Twenty-first the following facilities and equipment security key parts should implement the corresponding aviation security measures:
(1) Tower and regional control center;
(2) Navigation facilities;
(3) Airport oil supply facilities;
(4) Airport main and standby power supply;
(5) Computer Network Information Center;
(six) other facilities and equipment that will cause great damage to the airport function.
Article 22 Acts prohibited in the airport The following acts are prohibited in the airport:
(1) Climbing (drilling) over or damaging airport protective fences and other safety protection facilities;
(two) in violation of the provisions of the apron, runway and taxiway;
(3) forcibly boarding (occupying) or intercepting an aircraft;
(four) blocking, preempting, impacting the check-in counter, security inspection channel, boarding gate (channel);
(five) lying about the danger and creating chaos;
(6) Entering an airport control area without an airport control area pass and using another person's or vehicle's airport control area pass;
(7) Stealing or intentionally damaging or moving aviation facilities and equipment in use;
(eight) using boarding passes to enter the airport control area to engage in acts unrelated to air travel.
Chapter III Public Air Transport Safety
Article 23 A public air transport enterprise shall bear corresponding safety responsibilities for the passengers, luggage, mail or goods it transports.
Article 24 Issuance and management of aircrew boarding passes Pilots, flight attendants and aviation safety officers shall carry aircrew boarding passes when performing tasks. The issuance, use and management of boarding passes of aircrew shall conform to the provisions of the competent civil aviation authority of the State Council.
Article 25 When checking identity and checked baggage, the carrier must check the passenger's identity certificate and checked baggage.
Article 26 Safety inspection before take-off. Before take-off, the carrier shall conduct safety inspection of the aircraft in accordance with the regulations.
Article 27 Control of Passengers and Baggage When boarding a plane, the carrier shall check the number of passengers.
