Provisions on safety training of production and business units

Article 1 In order to strengthen and standardize the safety training of production and business units, improve the safety quality of employees, prevent casualty accidents and reduce occupational hazards, these Provisions are formulated in accordance with the Safety Production Law and relevant laws and administrative regulations. Article 2 These Provisions shall apply to the safety training for employees of industrial, mining, commercial and business production and business operation entities (hereinafter referred to as production and business operation entities). Article 3 Production and business operation entities shall be responsible for the safety training of employees. Production and business units shall establish and improve the safety training system in accordance with the safety production law and relevant laws, administrative regulations and these Provisions. Article 4 The employees that a production and business operation entity should receive safety training include the principal responsible person, safety production management personnel, special operators and other employees. Employees of production and business units shall receive safety training, be familiar with relevant safety production rules and regulations and safety operation procedures, have necessary knowledge of safety production, master the safety operation skills of their posts, and enhance their ability to prevent accidents, control occupational hazards and respond to emergencies. Employees who have not passed the safety production training are not allowed to work at their posts. Article 5 state administration of work safety guides the national safety training, and supervises and manages the national safety training according to law. The relevant departments in charge of the State Council shall guide and supervise the safety training in this industry according to their respective responsibilities, and formulate implementation measures according to these Provisions. The State Administration of Coal Mine Safety shall guide, supervise and inspect the national coal mine safety training. Safety production supervision and management departments at all levels and coal mine safety supervision institutions (hereinafter referred to as safety production supervision and supervision departments) shall, according to their respective duties, supervise and manage the safety training of production and business units according to law. Chapter II Safety Training for Principal Officials and Safety Production Management Personnel Article 6 Principal officials and safety production management personnel of production and business operation entities shall receive safety training, and have safety production knowledge and management ability suitable for their production and business operation activities. The main person in charge and safety production management personnel of coal mines, non-coal mines, dangerous chemicals, fireworks and other production and business units must receive special safety training. Only after the safety production supervision and supervision departments have passed the examination of their safety production knowledge and management ability and obtained the safety qualification certificate can they take up their posts. Article 7 The safety training for the principal persons in charge of production and business operation entities shall include the following contents: (1) National guidelines and policies on safety in production and relevant laws, regulations, rules and standards on safety in production; (two) the basic knowledge of production safety management, production safety technology and professional knowledge of production safety; (three) the relevant provisions on the management of major hazard sources, the prevention of major accidents, emergency management and rescue organizations, and the investigation and handling of accidents; (4) Occupational hazards and preventive measures; (5) Advanced experience in safety production management at home and abroad; (6) Analysis of typical accidents and emergency rescue cases; (seven) other contents that need training. Article 8 The safety training for the safety production management personnel of production and business operation entities shall include the following contents: (1) National safety production policies and laws, regulations, rules and standards related to safety production; (two) knowledge of safety production management, safety production technology and occupational health. ; (3) Statistics and reports of casualty accidents and investigation and handling methods of occupational hazards; (four) the contents and requirements of emergency management, emergency plan preparation and emergency disposal; (5) Advanced experience in safety production management at home and abroad; (6) Analysis of typical accidents and emergency rescue cases; (seven) other contents that need training. Article 9 The first safety training time for the principal responsible persons and safety production management personnel of production and business operation entities shall not be less than 32 hours. The annual retraining time shall not be less than 12 class hours. The safety qualification training time for the main person in charge and safety production management personnel of coal mines, non-coal mines, dangerous chemicals, fireworks and other production and business units shall not be less than 48 hours; The annual retraining time shall not be less than 16 hours. Article 10 The safety training of the main persons in charge of production and business operation entities and safety production management personnel must be implemented in accordance with the safety training outline formulated by the safety production supervision and supervision department. The safety training plan and assessment standards for the main persons in charge and safety production management personnel of non-coal mines, dangerous chemicals, fireworks and firecrackers and other production and business units shall be formulated by state administration of work safety. The safety training syllabus and assessment standards for the main person in charge of coal mines and the safety production management personnel shall be formulated by the State Administration of Coal Mine Safety. Safety training plans and assessment standards for the principal responsible persons and safety management personnel of production and business units other than coal mines, non-coal mines, dangerous chemicals and fireworks and firecrackers shall be formulated by the safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government. Eleventh coal mines, non-coal mines, dangerous chemicals, fireworks and other production and business units, the main person in charge and safety production management personnel safety qualification training, must be recognized by the safety production supervision and supervision departments with corresponding qualifications of safety training institutions. Twelfth coal mines, non-coal mines, dangerous chemicals, fireworks and other production and business units, the main person in charge and safety management personnel, after passing the safety qualification training and assessment, the safety production supervision and supervision department issued a safety qualification certificate. The main person in charge of other production and business units and the personnel in charge of production safety shall be trained by the supervision and supervision department of production safety, and the training institutions with corresponding qualifications shall issue corresponding training certificates.

Thirteenth coal mines, non-coal mines, dangerous chemicals, fireworks and other production and business units must carry out compulsory safety training for temporary workers, contract workers, laborers, rotation workers, contract workers and so on. , and ensure that they have the knowledge and skills needed for safe operation, self-help and mutual rescue and emergency response before arranging post work. Fourteenth other employees of processing, manufacturing and other production units must go through three levels of safety training and education in factories (mines), workshops (workshops, districts, teams) and teams before taking up their posts. Production and business units can conduct safety training for other employees according to the nature of their work to ensure that they have the knowledge and skills of safe operation and emergency response in their posts. Fifteenth new employees of production and business units, pre-job training time shall not be less than 24 hours. The safety training time for new employees in coal mines, non-coal mines, dangerous chemicals, fireworks and other production and business units shall not be less than 72 hours, and the annual retraining time shall not be less than 20 hours. Article 16 Pre-job safety training at the factory (mine) level shall include: (1) the safety production situation of the unit and the basic knowledge of safety production; (two) the safety production rules and regulations and labor discipline of the unit; (three) the rights and obligations of employees in production safety; (4) Relevant accident cases, etc. The factory (mine) level safety training for coal mines, non-coal mines, dangerous chemicals, fireworks and other production and business units shall include the above contents, and the contents of accident emergency rescue, accident emergency plan drills and preventive measures shall be added. Article 17 Pre-job safety training at workshop (section, district and team) level shall include: (1) working environment and risk factors; (2) Occupational injuries and casualty accidents that this type of work may suffer; (three) the safety responsibilities, operating skills and mandatory standards of the type of work; (four) self-help and mutual rescue, first aid methods, personnel evacuation and on-site emergency treatment; (five) the use and maintenance of safety equipment and facilities and personal protective equipment; (six) workshop (section, area, team) safety production status and rules and regulations; (seven) measures to prevent accidents and occupational hazards and safety matters that should be paid attention to; (8) Relevant accident cases; (nine) other contents that need training. Article 18 Pre-job safety training at the team level shall include: (1) post safety operation procedures; (2) Safety and occupational health problems between posts; (3) Relevant accident cases; (four) other contents that need training. Article 19 Employees of production and business operation entities who adjust their posts or leave their posts for more than one year to re-take up their posts shall re-receive safety training at workshop (workshop, area, team) level and team level. When the production and business operation entities implement new processes, technologies or use new equipment and materials, they shall conduct targeted safety training for relevant employees again. Article 20 Special operators of production and business operation entities must receive special safety training in accordance with the provisions of relevant national laws and regulations, and can only take up their posts after passing the examination and obtaining the qualification certificate for special operations. The scope of special operations personnel and management measures for training and assessment shall be formulated separately.

Article 21 The State Administration of Work Safety shall organize, guide and supervise the safety training of the principal responsible persons and safety production management personnel of the production and business operation entities (group companies and general factories) managed by the central government. The State Administration of Coal Mine Safety shall organize, guide and supervise the safety training of the main persons in charge and safety production management personnel of the coal mine enterprise group company (head office) managed by the central government. Provincial production safety supervision and management departments shall organize, guide and supervise the training of provincial production and business units and branches and subsidiaries of industrial, mining and commercial production and business units managed by the central government, and the main persons in charge of production safety management personnel; Organize, guide and supervise the training of special operators. Provincial coal mine safety supervision institutions shall organize, guide and supervise the safety training of the main persons in charge, safety production management personnel and special operators (including operators of special equipment for coal mines) of coal mining enterprises within their jurisdiction. City and county safety production supervision and management departments shall organize, guide and supervise the safety training of the main persons in charge and safety production management personnel of other production and business operation entities except central enterprises and provincial production and business operation entities within their respective administrative areas. The production and business operation entity shall organize the implementation of safety training for employees other than the main person in charge, safety production management personnel and special operators. Twenty-second production and business units with safety training conditions should focus on independent training; Safety training institutions with corresponding qualifications may be entrusted to conduct safety training for employees. Production and business units that do not have safety training conditions shall entrust safety training institutions with corresponding qualifications to conduct safety training for employees. Twenty-third production and business units shall incorporate safety training into the annual work plan. Ensure the funds needed for safety training of the unit. Twenty-fourth production and business units shall establish and improve the safety training files of employees, and record the training and assessment in detail and accurately. Twenty-fifth production and business units shall pay employees the wages and necessary expenses during the safety training period.

Twenty-sixth production safety supervision departments shall supervise and inspect the safety training of production and business units according to law, and urge the production and business units to carry out safety training in accordance with relevant national laws and regulations and these Provisions. The departments of the local people's governments at or above the county level responsible for the supervision and administration of coal mine safety production shall supervise and inspect the safety training of underground coal mine workers. Coal mine safety supervision institutions shall supervise and inspect the safety training of coal mine special operators and their certificates. Article 27 The supervision and supervision departments of production safety at all levels shall supervise and inspect the safety training of production and business units and their certificates, mainly including the following contents: (1) The formulation and implementation of safety training systems and plans; (two) the main person in charge and safety production management personnel of coal mines, non-coal mines, dangerous chemicals, fireworks and other production and business units hold safety qualification certificates; Training of the principal responsible persons and safety production management personnel of other production and business units; (three) the situation of special operations personnel holding certificates; (4) Establishing safety training files; (five) other contents that need to be checked. Twenty-eighth production safety supervision departments of coal mines, non coal mines, dangerous chemicals, fireworks and other production and business units, the main person in charge, safety management personnel should be strictly assessed in accordance with the provisions and issued safety qualification certificates. The assessment shall not be charged. The relevant personnel in charge of examination and certification in the supervision and supervision department of production safety shall not neglect their duties or abuse their powers.

Article 29 Where a production and business operation entity commits any of the following acts, the safety production supervision and management department shall order it to make corrections within a time limit and impose a fine of less than 20,000 yuan: (1) Failing to incorporate safety training into the work plan of the entity to ensure the funds needed for safety training; (2) Failing to establish and improve the safety training files for employees; (three) the employees did not pay the wages during the safety training and bear the safety training expenses. Thirtieth production and business units have one of the following acts, the safety production supervision department shall order them to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be ordered to suspend production and business for rectification, and a fine of less than 20,000 yuan shall be imposed: (1) The principal responsible persons and safety management personnel of production and business units such as coal mines, non-coal mines, dangerous chemicals, fireworks and firecrackers fail to pass the examination in accordance with these provisions; (two) non coal mines, dangerous chemicals, fireworks and other production and business units did not conduct safety training for other employees in accordance with the provisions; (three) non coal mines, dangerous chemicals, fireworks and other production and business units did not truthfully inform the employees about the safety in production; (4) The special operators of production and business operation entities have been working on the job without being trained by special safety training institutions and obtaining the qualification certificate of special operators. Where the department in charge of the supervision and administration of coal mine safety production of the local people's government at or above the county level finds that the coal mine fails to conduct safety training for underground workers in accordance with these provisions, it shall be ordered to make corrections within a time limit and be fined between 65,438+10,000 yuan and 500,000 yuan; Overdue correction, shall be ordered to suspend production and business for rectification. Coal mine safety supervision institutions found that coal mine special operations personnel without certificates, shall be ordered to make corrections within a time limit, and be fined 6,543,800 yuan to 500,000 yuan; Overdue correction, shall be ordered to suspend production and business for rectification. Article 31 Where a production and business operation entity commits any of the following acts, the safety production supervision and management department shall give it a warning, revoke its safety qualification certificate and impose a fine of less than 30,000 yuan: (1) fabricating safety training records and files; (2) defrauding the safety qualification certificate. Article 32 If the relevant personnel of the safety production supervision and management department neglect their duties and abuse their powers in the examination and certification work, the superior safety production supervision and management department or the administrative supervision department shall give administrative sanctions of demerit and gross demerit.

Article 33 The principal responsible person of a production and business operation entity refers to the chairman and general manager of a limited liability company or a joint stock limited company, and the factory directors, managers and directors (including actual controllers) of other production and business operation entities. Safety management personnel of production and business operation entities refer to the persons in charge of production safety of production and business operation entities, the persons in charge of production safety management institutions and their management personnel, and the full-time and part-time safety management personnel of production and business operation entities that have not set up safety management institutions. Other employees of the production and business operation entities refer to all personnel engaged in the production and business operation activities of the entity except the principal responsible persons, safety production management personnel and special operators, including other responsible persons, other management personnel, technicians, workers in various positions and temporary employees. Thirty-fourth provinces, autonomous regions and municipalities directly under the central government safety production supervision and management departments and provincial coal mine safety supervision institutions can formulate detailed rules for implementation according to these provisions, and report them to the State Administration of Work Safety and the State Administration of Coal Mine Safety for the record.
