Article 3 Intermediaries for foreign professionals to work in China as mentioned in these Measures (hereinafter referred to as intermediaries) refer to enterprises (excluding wholly foreign-owned enterprises) approved to engage in intermediary activities for foreign professionals to work in China. If the intermediary institution takes the form of a company, its establishment approval and registration shall be handled in accordance with the Regulations of the People's Republic of China on the Administration of Company Registration. Article 4 The examination and approval authority of intermediary institutions is the State Administration of Foreign Experts Affairs. Chapter II Examination, Approval and Registration of the Establishment of Intermediary Agencies Article 5 To apply for the establishment of an intermediary agency, in addition to the requirements of an enterprise as a legal person as prescribed by laws and administrative regulations, the applicant shall also meet the following requirements:

Article 6 To apply for the establishment of an intermediary institution, the following documents shall be submitted to the State Administration of Foreign Experts Affairs:

(2) A feasibility report on engaging in intermediary activities;

Chapter III Supervision and Administration of Intermediaries Article 9 After examination, approval and registration, intermediaries may engage in the following intermediary activities:

(4) Employment consulting service: providing clients with information on foreign professionals, providing clients with suggestions on hiring foreign professionals, and evaluating clients' employment plans.
(5) Employment-related services: entrusted by customers to handle the relevant procedures for hiring foreign professionals to work in China, and to be responsible for the reception and pre-job training of foreign professionals to work in China. Article 10 An intermediary institution shall engage in intermediary activities in accordance with the principle of voluntariness of the parties. Article 11 The standards for charging intermediary service fees by intermediaries shall be subject to the guidance and supervision of the State Administration of Foreign Experts Affairs and the price department. Article 12 Intermediaries shall submit annual business activity reports to the State Administration of Foreign Experts Affairs within the time specified by the State Administration of Foreign Experts Affairs, and accept the industry management of the State Administration of Foreign Experts Affairs. Thirteenth intermediary organizations to form trade associations must be approved by the State Administration of Foreign Experts Affairs and registered as social organizations. Chapter IV Punishment Article 14 Whoever, in violation of the provisions of these Measures, engages in intermediary activities of foreign professionals in China without permission within the territory of China shall be punished or banned by the State Administration of Foreign Experts Affairs in conjunction with the administrative department for industry and commerce. Fifteenth intermediary institutions have one of the following acts, the State Administration of Foreign Experts Affairs and the State Administration for Industry and Commerce shall be punished according to their respective functions and powers; If the circumstances are serious, the approval shall be revoked by the State Administration of Foreign Experts Affairs and the business license shall be revoked by the administrative department for industry and commerce:

Chapter II Principles for Hiring Foreign Professionals Article 7 The hiring of foreign professionals by schools and other educational institutions shall be conducive to implementing China's educational policy, developing China's educational undertakings and improving the quality of education. The employment of foreign professionals should follow the principles of employment on demand, quality assurance and efficiency. Article 8 Schools and other educational institutions that implement preschool education and nine-year compulsory education shall not employ foreign professionals in principle. If it is really necessary to hire foreign professionals to teach oral English due to special circumstances (such as foreign language schools, schools that implement sister city agreements, schools that undertake experimental tasks of teaching reform, etc.). ), they can apply on a case-by-case basis and strictly examine and approve. Article 9 Schools and other educational institutions that implement high school education, post-high school education, vocational education and adult education may employ foreign professionals according to their needs and conditions. The employment of foreign professionals in vocational education institutions can be used to strengthen language teaching, professional theory teaching, professional skills training, curriculum and teaching material research and development, and pay attention to learning international advanced vocational education theories, teaching models and methods. Adult education employs foreign professionals mainly for on-the-job training and on-the-job training. Article 10 It is strictly forbidden to recruit students by hiring foreign experts and foreign teachers as signs, charging high fees and profiteering. Article 11 Foreign professionals employed by schools and other educational institutions shall maintain an appropriate proportion with Chinese personnel in their own units. Twelfth schools and other educational institutions shall not employ foreign professionals as the main administrative leadership positions at all levels. Chapter III Conditions for Hiring Foreign Professionals Article 13 When schools and other educational institutions hire foreign professionals, they must meet the Criteria for Qualification of Hiring Foreign Cultural and Educational Experts:
First, the establishment of management institutions and personnel status of functional departments.
1. The employer must have an independent legal personality and be able to coordinate the employment of foreign professionals in the unit.

Chapter IV Application and Examination and Approval of Hiring Foreign Professionals Article 14 The foreign affairs departments of the education committees of provinces, autonomous regions and municipalities directly under the Central Government and the education administrative departments of ministries and commissions in the State Council are the competent departments for hiring foreign professionals in our university and other educational institutions, and the foreign affairs offices of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government are the centralized management departments for hiring foreign cultural and educational experts in their respective regions. Fifteenth schools and other educational institutions must meet the qualification standards for hiring foreign cultural and educational experts in China, and can only hire foreign professionals after obtaining the qualification certificate with the approval of the State Administration of Foreign Experts Affairs. Article 16 The application and approval of employing foreign professionals shall be conducted according to the following procedures:
1. Schools and other educational institutions that intend to employ foreign professionals shall apply to the education administrative departments or ministries of the provinces, autonomous regions and municipalities directly under the Central Government for accreditation.
Second, the foreign affairs departments of the education committees of all provinces, autonomous regions and municipalities directly under the Central Government or the education administrative departments of various ministries and commissions in the State Council are responsible for accepting applications for accreditation of foreign professionals put forward by schools and other educational institutions. After preliminary examination, the application materials shall be sent to the Foreign Affairs Office of the province, autonomous region or municipality directly under the Central Government where the applicant is located for qualification accreditation.
The education administrative departments of ministries and commissions in the State Council may entrust the education committees of relevant provinces, autonomous regions and municipalities directly under the Central Government to handle the qualification accreditation procedures for hiring foreign professionals in their schools and other educational institutions.
3. The foreign affairs offices of all provinces, autonomous regions and municipalities directly under the Central Government shall, jointly with the education and public security departments, examine the applicants in accordance with the procedures and relevant standards stipulated in the Measures for Determining the Qualification of Hiring Foreign Cultural and Educational Experts jointly issued by the State Administration of Foreign Experts Affairs, the Ministry of Foreign Affairs and the Ministry of Public Security, and report them to the State Administration of Foreign Experts Affairs for approval.
4. The State Administration of Foreign Experts Affairs shall examine and approve the applicant's qualification accreditation, issue qualification accreditation certificates, and jointly examine and approve with the State Education Commission when necessary.
Measures for the Employment of Foreign Professionals in Religious Colleges Chapter I General Provisions Article 1 In order to promote the academic exchange of religious culture between Chinese and foreign religious circles, standardize the employment of foreign professionals in religious colleges and improve the employment efficiency, these measures are formulated in accordance with the Regulations on the Administration of Religious Activities of Foreigners in People's Republic of China (PRC) and the Trial Regulations on the Work of Foreign Cultural and Educational Experts, with reference to the Measures for the Qualification of Foreign Cultural and Educational Experts. Article 2 These Measures shall apply to religious institutions established with the approval of the religious affairs departments of the State Council and the State Council and the provincial people's governments. The State Bureau of Religious Affairs is the competent department for recruiting foreign professionals in religious colleges and universities across the country. The religious affairs department of the provincial people's government is responsible for the daily management of the employment of foreign professionals in religious colleges and universities in the region. Chapter II Employment Principles Article 5 According to the principle of religious independence and self-management in China, teachers in religious institutions are mainly employed by religious groups and relevant institutions and research institutions in China.
In order to carry out academic exchanges with foreign religious cultures and enrich teaching contents, religious colleges may apply for hiring foreign professionals. Article 6 The employment of foreign professionals shall follow the principles of giving priority to myself, employing moderately, ensuring quality and paying attention to practical results. Article 7 Foreign professionals employed by religious colleges are mainly engaged in short-term teaching.
Short-term teaching time is limited to half a year, and long-term teaching time is limited to one year. Article 8 Religious institutions shall not employ foreign professionals to hold administrative leadership positions in their own institutions. Chapter III Application and Examination and Approval of Professional Qualification Article 9 Religious institutions shall meet the following conditions when applying for professional qualification:
(a) the academic system is more than three years, and the formal school term is more than four years;

National religious institutions not in Beijing shall be entrusted by the State Bureau of Religious Affairs to the religious affairs department of the local provincial people's government to accept their applications for professional qualifications and submit them for approval in accordance with the procedures stipulated in Article 11 of these Measures. The State Administration of Foreign Experts Affairs and the State Administration of Religious Affairs shall conduct annual inspections of religious institutions that have obtained qualification certificates in accordance with the Measures for the Accreditation of Foreign Cultural and Educational Experts. Religious institutions that have passed the annual inspection and obtained the qualification certificate registered by the State Administration of Foreign Experts Affairs in that year may continue to employ foreign professionals.
