Legal analysis: not illegal, but illegal. Paid remedial classes have always been one of the difficult problems in China's educational governance. Although the Ministry of Education and other ministries and commissions have begun to introduce a number of norms from the aspects of reducing students' burden, quality education, building professional ethics and standardizing fees, the problem of making up lessons has not been effectively managed. Recently, the Ministry of Education issued the "Regulations on Prohibiting Primary and Secondary School Teachers and In-service Primary and Secondary School Teachers from Making Up Lessons Paid" (hereinafter referred to as the "Regulations"), which clearly stipulated for the first time that it was forbidden for primary and secondary school teachers and in-service teachers to make up lessons paid. The "Regulations" clarify that the six behaviors of primary and secondary schools and in-service teachers constitute paid remedial classes. The "Regulations" limit the implementation subject of paid remedial classes to primary and secondary schools and in-service primary and secondary school teachers. In-service primary and secondary school teachers are prohibited from making up lessons with compensation because of their specific professional requirements. Retired teachers no longer continue to perform their educational and teaching duties in schools, and their behavior is not within the scope of adjustment of the Regulations. There are three situations in which primary and secondary schools constitute paid remedial classes: first, organize and require students to participate in paid remedial classes; Second, make paid remedial classes jointly with off-campus training institutions; Third, provide education and teaching facilities or student information for off-campus training institutions, and make up lessons with compensation. There are also three kinds of paid remedial classes for in-service primary and secondary school teachers: one is to organize, recommend and induce students to participate in paid remedial classes inside and outside the school; The second is to participate in paid remedial classes organized by off-campus training institutions or other teachers, parents and parent committees; Third, introduce students and provide relevant information for off-campus training institutions.
