(4) Unable to do the job, and still unable to do the job after being trained or adjusted;
(5) Being investigated for criminal responsibility according to law.
2. If Party B has any of the following circumstances, Party A may terminate the labor contract, but it must notify Party B 30 days in advance:
(1) Being sick or injured for other reasons, and unable to engage in the original work or other appropriate work arranged by the employer after the medical treatment expires;
(2) The objective conditions on which this contract was concluded have changed greatly, which makes the original contract unable to be performed, and both parties cannot reach an agreement on changing the contract through consultation.
3. In any of the following circumstances, Party B may terminate this contract:
(1) Party A fails to perform its obligations under this contract or infringes upon the legitimate rights and interests of Party B;
(2) To perform civic obligations and approve enlistment.
(3) Termination of the contract
1. Upon the expiration of this contract, the employment contract shall be terminated.
2. During the contract period, if Party B is sentenced, reeducated through labor, dismissed or rescinded, the labor contract will be automatically terminated from the date of decision.
3. During the contract period, if the contract cannot be performed due to force majeure, the contract will be automatically terminated.
(4) Contract renewal
Due to work needs, either party can notify the other party within 30 days before the termination of this contract, and the contract can be renewed with the consent of the other party.
If the contract has not been renewed after the expiration of the contract, but the factual employment relationship still exists, it shall be regarded as the renewal of the contract with the same term as the original contract, and the renewal procedures may be reissued.
Seven. Other terms agreed by both parties.
1. Party A shall provide Party B with corresponding housing, house purchase subsidies, settling-in expenses, scientific research start-up expenses, etc. according to the academic qualifications, teaching and scientific research level of the introduced outstanding talents and the relevant provisions of the Interim Measures for the Administration of the Introduction of Outstanding Talents in Shaanxi Education College.
2. During the employment period, Party B shall strictly perform the obligations stipulated in this contract. If Party B violates this Agreement, it shall refund the relevant expenses to Party A and pay Party A the compensation for the employment period and liquidated damages as agreed.
Eight. responsibility for breach of contract
The terms signed in this contract must be strictly implemented by both parties, and no breach of contract is allowed. If either party breaches the contract and causes economic losses to the other party, it shall pay compensation. Measures for determining compensation shall be implemented in accordance with relevant state regulations.
Nine. settlement of dispute
In case of a dispute between the two parties, if both parties fail to negotiate or one party is unwilling to negotiate, an application for mediation of personnel disputes in Shaanxi Education College shall be submitted in accordance with relevant national laws, regulations and provisions, or mediation or arbitration shall be applied to the labor dispute arbitration department or personnel dispute arbitration department in Shaanxi Province.
The term of this employment contract is not limited by the change of the legal representative.
Matters not covered in this contract shall be negotiated separately by both parties or implemented in accordance with relevant national laws and regulations.
This contract shall come into effect after being signed and sealed by both parties.
This contract is made in triplicate, one for each party.
This contract is invalid if it is signed or modified without legal authorization.
