Article 2 Definition of Electric Bicycle The term "electric bicycle" as mentioned in these Provisions refers to a two-wheeled bicycle that conforms to the national safety technical specifications for electric bicycles, uses vehicle-mounted batteries as auxiliary energy, has pedaling function, and can realize electric boosting or electric driving function. Article 3 Scope of Application These Provisions shall apply to the production, sale, driving, parking, charging, supervision and management of electric bicycles within the administrative area of this Municipality. Article 4 The competent department shall be responsible for the filing of electric bicycles and the management of road traffic safety. The market supervision and management department is responsible for the supervision and management of the production and sales market of electric bicycles. The municipal housing construction department is responsible for the supervision and management of centralized parking and centralized charging places for electric bicycles. City planning land, transportation, environmental protection, economic and trade information, urban management, public security and fire control and other administrative departments, according to their respective responsibilities to do a good job in the management of electric bicycles. Article 5 Technical Specifications for Electric Bicycles Electric bicycles shall meet the requirements of the following technical specifications: (1) Having pedaling ability; (2) Having the function of electric drive or electric auxiliary; (3) When driving electrically, the maximum design speed shall not exceed 25 km/h; The motor shall not provide power output when the vehicle speed exceeds 25km/h during electric power-assisted driving; (four) the mass of the electric bicycle is less than or equal to 55 kg; (5) The nominal voltage of the battery is less than or equal to 48V；; (6) The rated continuous output power of the motor is less than or equal to 400W. Article 6 It is forbidden to assemble or modify electric bicycles, and no unit or individual may assemble electric bicycles or engage in other modification or installation activities that affect safety. Article 7 The production, sale and driving of electric bicycles that do not meet the requirements of Article 5 of these Provisions are prohibited within the administrative area of this Municipality. Unless otherwise stipulated by the state, such provisions shall prevail. Eighth record management of electric bicycles by the public security traffic management department for the record, before driving on the road. The municipal public security traffic control department issues a two-dimensional code containing the information of the vehicle and the driver to the electric bicycle to be filed as a filing certificate. Electric bicycles in specific industries must be equipped with vehicle identification chips issued by the public security traffic control department after filing. Article 9 The municipal public security traffic control department under unified management shall establish a unified management platform for electric bicycles, and incorporate the filing of electric bicycles and real-time supervision of electric bicycles in specific industries into the unified management platform. The specific measures shall be formulated by the municipal public security traffic management department. Article 10 The traffic administrative department of the municipal public security organ with districts may, according to the road traffic conditions and the coverage rate of public transportation, delimit the no-go zone, restricted zone and no-go zone for electric bicycles. (1) No-go areas refer to areas with high traffic coverage and large traffic flow, where electric bicycles are prohibited from passing, except for electric bicycles in specific industries that have been filed; (2) No-go area refers to an area with high traffic coverage and large traffic flow, and electric bicycles are prohibited on some roads in this area, except for electric bicycles in specific industries that have been filed; (3) Quasi-pedestrian zone refers to roads and areas with relatively low traffic coverage and good traffic conditions, and registered electric bicycles can travel in this area. Article 11 Zoning Procedure The municipal public security traffic control department shall openly solicit the opinions of the public and relevant departments when delineating the no-go zone, restricted zone and permitted zone of electric bicycles, and the time for soliciting opinions shall not be less than 10 day. The specific scope of the no-go zone, restricted zone and permitted zone shall be approved by the municipal government and implemented after being announced to the public. Article 12 Regionalization Adjustment The municipal public security traffic control department may, according to the changes of urban public transport coverage and traffic conditions, timely adjust the no-go zone, restricted zone and no-go zone, and the adjustment procedures shall be implemented in accordance with the requirements of Article 11 of these Provisions. Article 13 Scope of Specific Industries The specific industries mentioned in Article 10 of these Provisions refer to the following industries that are closely related to people's livelihood or provide public services: (1) Postal industry, express delivery industry and newspaper delivery industry; (two) emergency repair of public facilities; (three) take-away and bottled gas, bottled drinking water, milk delivery, etc. ; (four) other industries closely related to people's livelihood. The specific scope of specific industries in this Municipality shall be determined by the municipal transportation management department in conjunction with the municipal public security traffic control, economic and trade information, postal services and other relevant departments. Article 14 The municipal public security traffic control department that implements total amount control shall, jointly with the municipal transportation, economic and trade information, postal services and other relevant departments, evaluate and calculate the coverage rate of public transportation, traffic conditions and the development of specific industries in the no-go area and the restricted area, and determine the total amount of electric bicycles allowed to travel in specific industries in the no-go area and the restricted area. Article 15 Urban traffic management departments with industry distribution shall, jointly with public security traffic control, economic and trade information, postal services and other relevant departments, reasonably determine the number of vehicles filed in each specific industry according to social needs and the development of specific industries. Article 16 When allocating specific trade associations, enterprises should comprehensively consider the filing requirements, business scale, credit records and other factors, and rationally allocate the number of electric bicycles filed by enterprises in the industry. Specific trade associations shall follow the principles of fairness, openness, transparency, science and standardization when allocating the number of vehicles for the record, formulate specific allocation methods, and report to the municipal public security traffic control department for the record. Article 17 Procedures for filing applications in specific industries Electric bicycles in specific industries shall be uniformly organized and filed by industry associations. Enterprises should submit vehicle filing materials to local trade associations. After passing the examination, the trade association shall submit the filing materials to the municipal public security traffic control department through the unified management platform of electric bicycles. Those who pass the examination shall be put on record by the municipal public security traffic control department, and identification chips and filing vouchers shall be issued. Specific industry associations shall install vehicle identification chips on electric bicycles in specific industries that have passed the examination and been filed, and incorporate them into the supervision and management system of electric bicycles in this industry for dynamic supervision, and network with the unified management platform of electric bicycles of the municipal public security traffic control department. Article 18 When a specific industry applies for the filing materials of electric bicycles in a specific industry, the enterprise shall submit the vehicles to its industry association and submit the filing materials. The trade association shall inspect and review the vehicles and submit the following documents and vouchers to the municipal public security traffic control department: (1) the business license of the vehicle user; (2) The valid identity certificate of the driver of the vehicle. Shenzhen household registration provides resident identity cards, and non-Shenzhen household registration provides residence permits. If there is no residence permit, the enterprise shall issue an employment certificate; (three) the purchase invoice or other proof of the legal source of the vehicle; (four) the vehicle factory certificate; (5) Vehicle parameters and vehicle photos; (6) insurance certificate. Each electric bicycle in a specific industry can record up to two drivers. The actual driver and the registered driver should be consistent. Article 19 In case of any of the following circumstances of the electric bicycle in a specific industry, the vehicle user shall apply to the industry association to change the record: (1) The vehicle user changes its name and residence; (2) Changing the driving area; (3) Changing the driver of the vehicle; (4) Change the enterprise account. Twentieth electric bicycles need to cancel the record in a specific industry, the enterprise shall apply to the industry association. After the audit by the trade association, relevant information will be uploaded through the filing system. The municipal public security traffic control department shall go through the cancellation procedures after online examination and confirmation. Article 21 It is forbidden to rent, lend or transfer electric bicycles to enterprises or drivers in specific industries without authorization. It is forbidden to use electric bicycles for purposes other than filing matters. It is forbidden to rent, lend or transfer electric bicycles that have been filed without authorization to other enterprises or personnel. Article 22 A specific industry with a large scale of unified logo should use a special logo with uniform color and style on its electric bicycles, which is different from other industries. In addition to complying with the provisions of the preceding paragraph, different enterprises in the same industry shall use their own special signs and numbers, and paste or spray them on the obvious position of the car body. The specific management measures shall be formulated by the municipal public security traffic control department in conjunction with industry associations. Article 23 Non-industry-specific application for filing and change filing Non-industry-specific electric bicycles can pass in the quasi-line area after filing. When applying for the filing of electric bicycles in non-specific industries, the following materials shall be submitted to the municipal public security traffic control department: (1) the identity certificate of the motor vehicle owner; (two) proof of the origin of the vehicle, such as the purchase invoice; (3) Vehicle certificate or import certificate; The municipal public security traffic control department shall put on record the electric bicycles of non-specific industries that have passed the examination, and issue a record certificate. If the ownership of electric bicycles in non-specific industries is transferred, the driver of the vehicle shall bring his identity certificate and the vehicle to the original filing unit in time to handle the change filing. Article 24 To drive an electric bicycle in compliance with traffic rules, one should abide by the provisions of laws, regulations and rules on the passage of non-motor vehicles, obey the command of traffic lights, traffic signs and traffic markings, and obey the command of traffic police. Article 25 Road traffic management regulations for electric bicycles When driving electric bicycles on the road, the following provisions shall be observed: (1) No reverse driving is allowed; (2) The driver should be 16 years old; ; (3) It is forbidden to drink and drive; (four) shall not exceed the maximum speed prescribed by laws and regulations; (five) the number of passengers shall not exceed one, and the passengers shall ride in the forward direction behind the driver; (six) the height of the load shall not exceed 65438 0.5 meters from the ground, the width shall not exceed 65438 0.5 cm from the handlebar, the length of the front end shall not exceed the wheel, and the rear end shall not exceed 30 cm from the body; (seven) are not allowed to enter the highway; (eight) should get off when crossing the motorway; (9) Drivers and passengers should wear safety helmets; (ten) other provisions of non motor vehicle traffic management. Twenty-seventh charging safety electric bicycles should ensure safety when charging. When charging indoors, preventive measures such as isolation and monitoring should be implemented to prevent fire. Charging at night should be supervised by someone. It is forbidden to use public areas such as walkways, stairwells and safety exits in buildings to charge electric vehicles. Conditional residential quarters and buildings can be combined with the actual situation to set up centralized parking and charging places for electric vehicles. Centralized parking and charging places should be supervised by special personnel, and charging equipment should be inspected regularly. Twenty-eighth fire safety management responsibilities include residential quarters and buildings of property service enterprises or competent units, and property service enterprises and competent units shall implement fire safety management for the parking and charging of electric vehicles within the management area; If there is no realty service enterprise or competent unit, the sub-district office of the jurisdiction shall, according to the guidance, help the residents' committee to determine the fire safety management personnel for electric vehicle parking and charging, and implement the management responsibility. Twenty-ninth publicity and education, the municipal public security traffic management department shall formulate the code of conduct for safe driving of electric bicycles and announce it to the public. City public security traffic control departments, education departments, streets and other relevant units should strengthen the publicity and education of electric bicycle driving knowledge and traffic rules, and improve the traffic safety awareness of electric bicycle drivers. Encourage streets, communities and other units to organize and carry out training on driving skills and traffic rules for electric vehicle drivers. Thirtieth safety management system and training industry associations and enterprises should strengthen the management of electric bicycles and drivers, and formulate the safety management system of electric bicycles and their use in their own industries or enterprises. Enterprises should establish a punishment system for electric vehicle drivers who violate traffic rules under their management, conduct classified suspension management and laid-off training for drivers in specific industries who have repeatedly committed serious traffic violations and are responsible for traffic accidents, and inform the whole industry. Enterprises and electric bicycle drivers should fulfill the main responsibility of traffic safety. Industry associations and enterprises should strengthen the training of electric bicycle drivers, improve drivers' legal concept of traffic safety and traffic quality, and implement pre-job training system for all drivers. Article 31 Encourage Insurance Encourage owners of electric bicycles in non-specific industries to take out relevant liability insurance for electric bicycles. Article 32 Responsibility for Traffic Accidents If a traffic accident occurs while driving an electric bicycle, the driver shall bear the responsibility for the accident according to law. If the actual driver is inconsistent with the registered driver, the actual driver shall bear the responsibility for the accident. Registered drivers who rent, lend or transfer electric bicycles without authorization in violation of these regulations shall also bear corresponding responsibilities. Thirty-third legal liability in violation of the provisions of article sixth, assembly, modification or installation of electric bicycles, by the municipal public security traffic management department fined one thousand yuan to ten thousand yuan. Article 34 Legal Liability II Whoever, in violation of the provisions of Article 7 of these Provisions, produces and sells electric bicycles that do not meet the requirements within the administrative area of this Municipality shall be ordered by the municipal market supervision and management department to stop production and sales, confiscate the illegally produced and sold electric bicycles, and impose a fine of three times the value of illegally produced and sold (including sold and unsold) electric bicycles. If there are illegal gains, the illegal gains shall be confiscated. In violation of the provisions of article seventh, driving an electric bicycle that does not meet the requirements within the administrative area of this Municipality shall be detained by the municipal public security traffic management department and fined 1000 yuan. Article 35 Legal Liability III Anyone who drives an unregistered electric bicycle on the road in violation of Article 8 of these Provisions shall be detained by the municipal public security traffic management department and fined 2000 yuan. Article 36 Where an enterprise with legal responsibility violates Article 18 of these Provisions and provides false filing materials, the municipal public security traffic control department shall impose a fine of not less than 5,000 yuan but not more than 50,000 yuan, and record it in the enterprise credit file. In violation of the provisions of Article 23 of these Provisions, non-specific industry units or individuals who provide false filing materials shall be fined by the municipal public security traffic control department in 500 yuan. Article 37 Legal Liability V. If an enterprise rents, lends or transfers an electric bicycle without authorization in violation of Article 21 of these Provisions, the traffic administrative department of the public security shall impose a fine of 1000 yuan and record it in the credit record of the enterprise. Non-specific industry units or individuals who violate the provisions of the third paragraph of Article 23 and fail to go through the formalities for filing changes according to law shall be fined by the public security traffic management department in 200 yuan. Article 38 Legal Liability VI Whoever, in violation of the provisions of Article 22 of these Provisions, forges, alters or uses the forged or altered uniform logo of electric bicycles shall be detained by the municipal public security traffic management department and fined 5000 yuan. Thirty-ninth legal liability seven in violation of the provisions of article twenty-fifth of the first to eighth, shall be ordered to make corrections, and by the municipal public security traffic management department to give the driver a warning or a fine of 200 yuan. In violation of the provisions of Article 25 (9), if the electric bicycle driver or cyclist fails to wear a helmet, the municipal public security traffic management department shall impose a fine on the electric bicycle driver in 200 yuan. Article 40 Legal Liabilities VIII If relevant industry associations and enterprises violate the provisions of the first paragraph of Article 30 and fail to establish relevant safety management systems or punishment systems, the municipal public security traffic control department shall give them a warning or order them to make corrections, and incorporate them into the records of enterprise integrity files. If an enterprise violates the provisions of the second paragraph of Article 30 of these Provisions and fails to conduct pre-job training for electric bicycle drivers, the municipal public security traffic control department shall impose a fine of 2000 yuan. Forty-first management of electric tricycles in specific industries Except that electric tricycles in specific industries can drive in the quasi-traffic areas designated by this Municipality after filing, any electric tricycles are prohibited from driving on the roads in this Municipality. The management activities of electric tricycles in specific industries in this Municipality shall be implemented with reference to the relevant provisions on the management of electric bicycles. The specific administrative measures shall be formulated by the municipal public security traffic management department in conjunction with the relevant administrative departments.
