Employees who have worked continuously in this enterprise for six months and whose main source of income is wages have the right to join and organize trade unions according to law. Article 3 Where a trade union in a township enterprise meets the legal person requirements stipulated in the General Principles of the Civil Law of People's Republic of China (PRC) and the General Principles of the Civil Law of People's Republic of China (PRC), it shall obtain the legal person status of a social organization according to law from the date of approval of the trade union at a higher level.
Trade unions in township enterprises must abide by the Constitution, laws and regulations, and work independently in accordance with the articles of association of the China Trade Union. Article 4 Trade unions in township enterprises shall enjoy the following rights:
(a) the trade union has the right to put forward opinions on the behavior of enterprises infringing on the legitimate rights and interests of employees, and require enterprises or township enterprises and labor administrative departments to deal with them in time. Where an enterprise violates labor laws and regulations, the trade union has the right to demand correction;
(two) when the enterprise studies and discusses major issues such as development planning, production and operation, labor and employment, unproductive expenses, and matters involving the vital interests of employees such as wages, welfare, safety in production, labor protection and labor insurance. Trade union representatives shall attend and listen to the opinions of the trade union;
(3) Trade unions help and guide employees to sign labor contracts with enterprises, and sign collective contracts with enterprises on behalf of employees. The draft collective contract shall be submitted to the workers' congress or the workers' congress for discussion and adoption;
(4) An enterprise shall seek the opinions of the trade union in advance when it terminates the labor contract with the employees or disposes of the employees. If the trade union thinks that it is inappropriate for an enterprise to terminate the labor contract or dispose of its employees, it has the right to put forward opinions and ask for re-handling.
When the enterprise really needs to lay off employees, it should explain the situation to the trade union in advance and listen to the opinions of the trade union;
(five) to participate in the mediation of labor disputes in enterprises.
The labor dispute mediation committee or mediation team established by township enterprises according to law shall be headed by a trade union representative;
(six) to participate in the investigation of industrial accidents and other accidents that seriously endanger the health of employees, and put forward suggestions. When finding the situation that endangers the life safety of employees, we should advise the enterprise to make a decision in time and help organize employees to evacuate from the dangerous scene. Article 5 Trade unions of township enterprises shall perform the following obligations:
(a) to support the enterprise management according to law, safeguard the legitimate rights and interests of enterprises, and promote the healthy development of enterprises;
(two) to mobilize and educate employees to participate in labor as masters, to care for enterprise property, to abide by labor discipline and enterprise rules and regulations, and to mobilize and organize employees to complete production (work) tasks;
(3) Educate employees in patriotism, collectivism and socialism, strengthen education in legal system and professional responsibility, professional ethics, professional discipline and safety in production, organize employees to learn cultural and scientific knowledge, carry out amateur cultural and sports activities beneficial to their physical and mental health, improve their ideological, cultural and professional qualities, and make them become workers with ideals, morality, culture and discipline;
(4) Organizing employees to carry out mass scientific and technological activities such as rationalization proposals, labor competitions, technological innovation and technical cooperation, and technical training around the production and operation of enterprises, so as to improve the technical quality of employees and promote the technological progress and economic benefits of enterprises;
(five) seriously listen to and reflect the opinions and demands of employees, care about the lives of employees, urge enterprises to rationally use employee incentive funds and welfare funds, and assist enterprises to run the collective welfare of employees;
(six) responsible for the selection, recommendation and management of advanced producers (workers) and model workers. Article 6 Township enterprises shall establish a system of workers' (representatives') congress according to law, and guarantee the workers' rights to exercise democratic management and supervision according to law. The trade union is the working body of the workers' (representatives') congress, responsible for the daily work of the workers' (representatives') congress, and inspecting and supervising the implementation of the resolutions of the workers' (representatives') congress. Article 7 The board of directors and managers (factory directors) of township enterprises shall support trade unions to carry out activities according to law; The trade union shall support the board of directors and the manager (factory director) to exercise their functions and powers according to law. Article 8 When a township enterprise terminates, the trade union organization shall be revoked accordingly and reported to the trade union at the next higher level for the record.
If the trade union organization of township enterprises is revoked or merged without legal procedures, the superior trade union has the right to investigate and ask the government and its administrative departments of township enterprises to deal with it in time. Article 9 The legitimate rights and interests of trade unions in township enterprises shall be protected by law.
Township enterprises have the right to reflect the situation and put forward opinions to the higher-level trade unions for trade unions that fail to perform their obligations and incompetent trade union staff. Article 10 The trade union committee of township enterprises shall be democratically elected in accordance with the articles of association of the trade union.
When the term of office of the chairman, vice-chairman and director of the trade union women workers' committee expires and needs to be adjusted, the consent of the trade union committee at the same level and the trade union at the next higher level shall be obtained. Eleventh township enterprises trade union activities in accordance with the "People's Republic of China (PRC) Trade Union Law" and "Hubei Province, the implementation of the" People's Republic of China (PRC) Trade Union Law "approach" for. At the same time, it is subject to the review of the fund review committee of the enterprise's trade union and the guidance and supervision of the superior trade union.
