Measures of Ningxia Hui Autonomous Region for the implementation of "People's Republic of China (PRC) Fire Protection Law"
Chapter I General Provisions Article 1 In order to prevent and reduce fires, strengthen emergency rescue work, protect personal and property safety and maintain public safety, these Measures are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC) (hereinafter referred to as the Fire Protection Law). Article 2 These Measures shall apply to the fire safety work within the administrative area of the autonomous region. Article 3 People's governments at all levels shall be responsible for the fire control work within their respective administrative areas.

The public security organs of the people's governments at or above the county level shall supervise and manage the fire control work within their respective administrative areas, and the fire control institutions of the public security organs of the people's governments at the corresponding levels shall be responsible for the implementation.

Other relevant departments of the people's governments at or above the county level shall, within the scope of their respective duties, do a good job in fire control according to law. Article 4 Every year 1 1.9 is the autonomous region fire prevention publicity day. Chapter II Fire Safety Duties Article 5 The people's governments at or above the county level shall perform their duties as stipulated in the Fire Protection Law, incorporate the funds for the construction of public fire control facilities and fire control business into the fiscal budget at the corresponding level, establish a joint meeting system for fire control work, and do a good job in emergency rescue and aftermath of major fire accidents.

Township (town) people's governments and sub-district offices shall urge units and individuals within their respective administrative areas to do a good job in fire control, guide, support and help village (neighborhood) committees to formulate fire safety conventions, carry out fire safety inspections, and assist in the aftermath of fire accidents. Article 6 Fire control institutions of public security organs shall perform the following duties:

(a) to conduct fire design review and fire acceptance for special construction projects such as large-scale crowded places, and conduct spot checks on other construction projects that should be put on record;

(two) public gathering places put into use and fire safety inspection before opening;

(three) to take temporary measures to seal up major fire hazards that threaten public safety;

(four) the implementation of fire supervision and inspection, and urge the rectification of fire hazards;

(five) to undertake the fire fighting and emergency rescue work of major disasters and accidents, investigate the causes of fire accidents and count the losses of fire accidents;

(six) to determine and publish the key units of fire safety;

(seven) to guide the full-time fire brigade and volunteer fire brigade to carry out fire business training and drills;

(eight) to publicize the common sense of fire prevention, fire fighting and escape and self-help, and organize fire safety training;

(nine) to ensure the application of advanced fire fighting and emergency rescue technologies and equipment promoted and used by the state;

(ten) to guide and help organs, organizations, enterprises, institutions and other organizations to carry out fire safety work;

(eleven) other duties as prescribed by laws and regulations. Article 7 State organs, public organizations, enterprises, institutions and other organizations shall perform their duties as stipulated in Article 16 of the Fire Protection Law, determine full-time (part-time) fire safety administrators and key fire safety parts of their own units, set up fire prevention signs, and their legal representatives shall be fully responsible for the fire protection work of their own units.

The property service enterprises in residential areas shall maintain and manage the fire-fighting facilities within the management area, and the property units shall be responsible for the maintenance and management of the fire-fighting facilities in residential areas without property management.

Individual industrial and commercial households shall be responsible for the fire safety of their business premises, equipped with necessary fire-fighting equipment and ensure its effective use. Eighth village (neighborhood) committees shall determine the fire safety administrator and formulate the fire safety convention; Carry out publicity and education on fire prevention and extinguishing knowledge; Carry out fire safety inspection and cooperate with fire law enforcement; Report fire hazards in time and urge them to be eliminated; Carry out fire self-prevention and self-rescue, and assist in the aftermath of fire accidents. Article 9 Citizens shall abide by fire laws, regulations and rules and relevant fire safety regulations; Take care of public fire control facilities; Learn fire fighting knowledge and master the basic methods of fire prevention, fire extinguishing and alarm, life saving and escape; Safe use of coal, firewood, electricity, oil and natural gas; Do not pile up or misplace combustible materials, and do not block public passages; Conduct fire safety education for minors. Chapter III Public Fire Control Facilities Article 10 People's governments at all levels shall incorporate public fire control facilities such as fire safety layout, fire brigade (station), fire water supply, fire escape, fire communication and fire equipment into urban and rural construction planning, and be responsible for organizing their implementation. If the original public fire control facilities are insufficient or do not meet the actual needs, they should be built, added or technically transformed to meet the standards set by the state.

The examination and approval unit shall not approve projects that lack or are unreasonable in the overall urban planning, rural and market town construction planning. Eleventh people's governments at or above the county level shall guarantee the funds needed for the construction of public security fire brigade (station) and fire fighting equipment.

The newly-built large-scale construction project unit shall pay the construction fee for public fire control facilities. The specific scope, standards, use and management measures for the construction fee of public fire control facilities shall be formulated by the people's government of the autonomous region. Chapter IV Fire Protection Article 12 The following provisions shall be implemented in the examination and approval of fire safety matters:

(a) do not meet the requirements of urban and rural fire safety layout of construction projects, urban and rural planning departments shall not issue site submissions, construction land planning permits and construction project planning permits;

(two) the competent department of housing and urban and rural construction shall not issue a construction permit for a construction project that should be audited by the fire department of the public security organ according to law;

(three) the competent department of housing and urban and rural construction shall not issue the building ownership certificate to the construction project that should be subject to fire control acceptance according to law, and there is no fire control acceptance certificate in the completion acceptance data;

(four) without the approval of the fire department of the public security organ, the competent departments of education, health, culture, sports, industry and commerce shall not approve the fire safety conditions of public places where education, medical care, culture, sports, social welfare and other undertakings are to be held;

(five) the original examination and approval department shall revoke the approval document for the construction project that has obtained the approval document because it no longer meets the fire safety conditions due to the change of the building structure or the nature of use;

(six) the safety supervision department shall not issue a safety production license to enterprises that do not have the conditions for safe production, and shall not produce, store or transport dangerous goods.
