Measures of Ningbo Municipality on the Administration of Training Institutions
Article 1 In order to standardize the school-running activities of training institutions, cultivate and promote the healthy development of the training market in our city, these Measures are formulated in accordance with the relevant laws and regulations of the state and the relevant provisions of the State Council, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the management of training institutions within the administrative area of this Municipality.

The term "training institutions" as mentioned in these Measures refers to organizations that face the society and provide training services for employers and individuals. Article 3 The municipal and county (city) district people's governments shall incorporate the training service industry into the national economic and social development plan, and cultivate and guide the development of training institutions in accordance with the principles of active encouragement, adaptation to demand, openness and fairness, opening wider to the outside world and management according to law.

City and county (city) District People's governments should actively promote the reform of training institutions affiliated to government departments, and gradually improve the market mechanism of equal competition for all kinds of training subjects. Fourth city and county (city) district personnel administrative department is responsible for the supervision and management of high-end talent qualification certificate training institutions, and specifically responsible for promoting the reform of professional training institutions and integrating various training resources.

City and county (city) district education administrative departments are responsible for the supervision and management of private training institutions that carry out preschool education, academic education, self-study exams and other cultural education.

City and county (city) district labor and social security administrative department is responsible for the supervision and management of private training institutions to carry out vocational qualification training and vocational skills training.

The personnel administrative department shall, jointly with the departments of education, labor and social security, civil affairs, industry and commerce, establish a coordination mechanism for the reform and development of training institutions. Finance, price, public security and other departments should assist in the management of relevant training institutions according to their duties. Article 5 A social organization applying for a training institution shall have the status of a legal person; Individuals applying for training institutions shall have political rights and full capacity for civil conduct.

If two or more social organizations or individuals jointly organize training institutions, they shall sign a joint school-running agreement, specifying the purpose, amount, method, rights and obligations of running schools. Article 6 The establishment of a training institution shall meet the following basic conditions:

(1) Having an organizational structure and articles of association;

(two) should be equipped with a full-time person in charge who meets the qualifications;

(three) should be equipped with full-time and part-time teachers and management personnel to adapt to the scale of running a school;

(four) there should be training places and teaching facilities suitable for the scale of running a school;

(five) there should be a syllabus, teaching plan and teaching materials corresponding to the training project;

(six) should have the necessary funds for running a school;

(seven) other conditions stipulated by laws, regulations and rules. Article 7 The name of a training institution shall conform to the relevant provisions of national laws and regulations, reflect the nature, level and type of the institution, use standardized names, and the names in Chinese and foreign languages shall be consistent. Article 8 An organization or individual applying for the establishment of a training institution shall provide the prescribed application materials to the examination and approval authority in accordance with the provisions of Article 6 of these Measures, and shall be responsible for the authenticity of the application materials.

For the newly applied training institutions, the examination and approval authorities shall organize experts to demonstrate and conduct on-the-spot investigations on their teaching venues, teaching facilities and equipment, teaching syllabus, teaching plans and teachers' conditions, and timely apply for the establishment of training institutions within the statutory time limit according to law. Article 9 Where a training institution applies for division, merger or change of name, training level and training category, it shall report to the examination and approval authority for approval.

Where a training institution changes its sponsor, it shall be proposed by the sponsor and reported to the examination and approval authority for approval.

If a training institution changes its school address or adds teaching points within the approved area, it shall report to the examination and approval authority for the record. Running schools across regions shall be handled in accordance with the procedures of newly established training institutions. Article 10 If a training institution is unable to carry out normal teaching activities for some reason or needs to be closed in accordance with the articles of association, it shall conduct property audit and liquidation according to law, and the examination and approval authority may approve the dissolution or closure only after the relevant matters such as students' on-campus training are properly solved. Eleventh training institutions shall, in accordance with the articles of association approved by the examination and approval authority, improve various rules and regulations, and carry out training and education activities in accordance with the commitments in the enrollment brochures and enrollment advertisements to ensure the quality of teaching.

Training institutions shall not arbitrarily reduce the training content and training hours. If it is really necessary to reduce the training content and training hours, it shall obtain the consent of the trainees, and record the reasons for reducing the training content and training hours and the consultation with the trainees so that the management department can check. Twelfth full-time teachers employed by training institutions should have the qualifications prescribed by the state.

Training institutions shall establish professional assessment files for teachers and conduct professional assessment for teachers on a regular basis.

Training institutions shall sign written contracts with the faculty and staff employed by them, and guarantee the salaries, welfare and social insurance benefits of the faculty and staff according to law. Training institutions shall employ foreign personnel in accordance with the relevant provisions of the state. Thirteenth training institutions should establish and improve the student management system, and record the basic information such as training content, academic performance, assessment and training certificate in the student status file. Fourteenth training institutions may, in accordance with the relevant provisions of the state, issue training certificates or certificates of completion to trainees according to their types, training time and academic achievements.

The training institution shall report the certification style to the examination and approval authority for the record.
