The Labor Contract Law stipulates that if a worker violates the service period agreement, he shall pay liquidated damages to the employer in accordance with the agreement. The amount of liquidated damages shall not exceed the training expenses provided by the employer. The liquidated damages that the employer requires the laborer to pay shall not exceed the training expenses that should be shared for the unfinished part of the service period.
That is to say, first, the enterprise sets liquidated damages for employees, and employees leave the enterprise in advance during the service period, so employees must pay liquidated damages to the enterprise. Enterprises and workers can agree on the amount of liquidated damages. However, the maximum amount of agreed liquidated damages cannot exceed the actual training expenses paid by the enterprise.
