Chapter I General Principles

Article 1 In order to improve the service level of population and family planning management in urban areas of our city, these measures are formulated in accordance with the Population and Family Planning Law of the People's Republic of China, the Regulations of Henan Province on Population and Family Planning and other relevant laws and regulations, combined with the actual situation of our city.

Chapter II Organization and Team Building

Chapter III Statistics and Information Management

Organizations at all levels should establish and improve the family planning register of employees and married women of childbearing age, and master the residence and family planning situation of each employee of this unit. Computer management should be implemented if conditions permit.

Chapter IV Issuance of Birth Certificates

Article 28 The registration and issuance organ of the one-child birth certificate is the sub-district office (township people's government), and the approval and issuance organ of the two-child birth certificate is the county-level population and family planning administrative department.

The one-child birth certificate shall be registered and issued. After the husband and wife get married according to law, they will register with the issuing authority through the community neighborhood Committee of their current residence and receive the one-child birth certificate.

Approved the issuance of a two-child birth certificate. Those who meet the reproductive conditions shall be applied by both husband and wife. After investigation and examination by community neighborhood committees and streets (townships), it shall be reported to the county-level population and family planning administrative department for examination and approval, and pregnancy and delivery can be carried out only after holding certificates.

Article 29 Persons with permanent residence in cities and towns, whose spouse's household registration or woman's household registration is urban household registration, have a fixed residence in the central city of their current residence, have lived for more than half a year and have a tendency of permanent residence, can apply for a birth certificate by the township (town, street) or business unit of their current residence after obtaining the marriage and childbirth certificate.

If there are more than one residence or the residence is less than half a year, it shall be handled by the main residence or the street (township) where the family planning information is collected.

If you have a fixed residence in your current place of residence and have lived for more than two years, and the community neighborhood Committee has a clear understanding of marriage and childbirth, you don't need to ask the township (town, street) or the original place of residence to issue a marriage and childbirth certificate.

Thirtieth couples or women's household registration in the central city, but there is no fixed residence in the central city, according to the management of floating population, registered by the household registration.

Thirty-first couples are not in the central city or the woman's household registration is not in the central city, according to the floating population management, registration and certification by the household registration.

The woman is a floating population from other provinces, and the man is a registered population in his current residence. If the woman has moved to her current place of residence due to the fact of marriage and has lived in her current place of residence for more than 1 year, has a stable occupation and residence, and has a tendency to live permanently, and needs to apply for the one-child birth certificate, she can apply for it from her current place of residence in accordance with the requirements of Several Provisions of the National Population and Family Planning Commission on Family Planning Management and Services for Floating Population. In line with the conditions of having two children, the woman's domicile shall be handled in accordance with the relevant provisions of this province.

Thirty-second couples or women's household registration in agricultural registered permanent residence, in line with the conditions for the birth of an only child, the birth certificate of an agricultural only child shall be issued by the place where the household registration is located.

Thirty-third simplify the procedures for handling birth certificates. If the applicant for the one-child birth certificate meets the requirements, it shall be handled immediately, and the time for handling the two-child birth certificate shall not exceed one month.

For unqualified applications, inform the applicant in writing of the results and reasons for disapproval.

Article 34 Where a party requests the domicile, current residence and business unit to issue marriage and childbearing certificates, all units and organizations shall truthfully issue them, and shall not refuse them without justifiable reasons, and shall not take the opportunity to collect various fees.

To meet the reproductive conditions of the object, streets (towns), communities and family planning technical service institutions shall not deliberately make things difficult, prevaricate or take the opportunity to increase conditions, increase inspection items, and shall not charge a ride to increase the burden on the masses.

Units and staff who issue false certificates shall be held accountable.

Article 35 If a pregnant woman holding a birth certificate terminates her pregnancy due to medical needs, she must hold a certificate issued by a medical and health institution or a family planning technical service institution recognized by the provincial health administrative department that she is not suitable for continuing her pregnancy. The one-child holder shall go to the street (township) family planning office, and the two-child holder shall issue a letter of introduction to the county-level population and family planning administrative department to agree to terminate her pregnancy.

County, street (town) should have a detailed record of the termination procedure for pregnant women.

Thirty-sixth matters not specified in this chapter shall be implemented in accordance with the Management Rules for the Issuance of Birth Certificates in Nanyang City (Wan Family Planning [2003] No.73) and the relevant provisions of the Municipal Population and Family Planning Commission.

Chapter v administration according to law

For family planning cases reflected and reported by calls, letters and visits from the masses, streets (townships) and communities must be carefully registered, all of which shall be filed with the administrative departments of population and family planning of counties and cities, which shall handle or entrust the relevant streets (townships) to handle them. If the county has no jurisdiction, it shall be transferred to the county population and family planning administrative department with jurisdiction.

It is strictly forbidden to handle cases without authorization or across regions. Without the approval of the record, the relevant procedures issued by the unit without jurisdiction are invalid. Once found, the responsibility of the illegal handling unit and related personnel will be strictly investigated.

Article 40 After the administrative departments of population and family planning in counties and cities or the streets (towns) entrusted by them put on record for investigation, if the parties intentionally move to other places to avoid the investigation, in principle, there are still the original units that put on record for investigation and handling, and the administrative departments of population and family planning in the place where they moved shall cooperate. Under special circumstances, the case can also be transferred to the jurisdiction of the newly moved place through consultation between the two parties.

Forty-first disputes over the jurisdiction of family planning cases between two or more parties shall be settled through consultation. If negotiation fails, it shall be submitted to the superior population and family planning administrative departments of both parties for ruling within 15 days.

Forty-second collection of social maintenance fees should be carried out in accordance with the standards, and it is not allowed to levy more or less, and the first collection rate should reach more than 70%.

Forty-third floating population social maintenance fee collection should be strictly in accordance with the provisions of the State Council "social maintenance fee collection and management measures" fifth. In another place that has been dealt with in one place, it shall not be dealt with again because of the same fact.

Forty-fourth administrative law enforcement files should be filed in a timely manner, and designated person in charge. The files should be neat and unified, with one volume for each case, and each volume should have the original letters and visits, the filing approval form, the inquiry record, the closing report, the administrative collection decision, the receipt of service, the copy of the invoice, the installment plan, the proof of birth control measures, the party and government disciplinary action, etc.

The population and family planning administrative departments of counties and urban areas shall classify and summarize the administrative law enforcement cases within their respective jurisdictions every quarter and report them to the municipal population and family planning administrative departments for the record.

Chapter VI Openness of Government Affairs

Sub-district offices (Township People's governments) and community neighborhood committees should publicize the population and family planning policies, reward and assistance policies and penalty-limiting policies in a conspicuous position; Items, standards, procedures and payment of public fines, social maintenance fees and administrative fees (exemption); Public birth certificate, certificate of marriage and childbearing of floating population, certificate of honor for parents of only child, identification of disabled children and other procedures, processing time, reporting conditions and examination and approval results; Publicize the number of births in that year and the list of two-child birth certificates; Open offices, procedures, locations, processing time, consultation telephone number, supervision and complaint telephone number, etc.

Forty-ninth community neighborhood committees shall, in accordance with the principles of scientificity, rationality, operability and effectiveness, formulate and publish the family planning autonomy convention or articles of association, and strengthen democratic management and supervision.

Fiftieth street offices (township people's governments) may entrust community neighborhood committees to sign family planning contracts with family planning service objects in their respective jurisdictions on the basis of voluntariness and equality, and use the contracts to promote the standardized management of family planning.

Chapter VII Management of Floating Population

Article 53 An information declaration system shall be implemented for the inflow population. Article 55 Sub-district offices (township people's governments) shall, within 15 days after the floating women of childbearing age arrive at their current residence, timely check the marriage and childbearing certificates of floating population. It is necessary to check the recorded marriage and birth control situation with my actual situation, affix the relevant inspection seal and register. Those who do not hold the certificate of marriage and childbearing of floating population shall be ordered in writing to reissue it within a time limit. Concerned about the production and life of the floating population, the relevant departments should provide preferential services for the floating population families who implement family planning in employment, medical treatment, children's nursery, school and other aspects.

Chapter VIII Technical Services

Fifty-ninth community neighborhood committees should rely on family planning technical service institutions or community health resources to carry out family planning services.

For streets and communities with technical service conditions, technical services should be provided in the community. Do not have the technical service conditions, the streets should be designated city, county, district family planning service stations or community health care institutions to provide services.

Community family planning technical services should be carried out in accordance with the principle of proximity and convenience for the masses. Actively carry out humanized service, door-to-door service and other activities.

(a) do a good job in the publicity and consultation of contraceptive knowledge and reproductive health care services for people of childbearing age in this area, guide the masses to choose safe and reliable contraceptive methods, and carry out informed choices.

Article 64 Improve the distribution network of contraceptives, keep the free distribution channels unblocked, and enhance the availability and desirability of contraceptives by expanding distribution points and setting up condom vending machines.

Chapter IX Supervision and Evaluation

Article 65 In accordance with the principle of combining step-by-step assessment with territorial assessment, this Municipality conducts step-by-step assessment of population and family planning work in counties, cities and streets (towns and villages), and streets guide, supervise and inspect the population and family planning work of communities and organizations at all levels within their jurisdiction.

Article 66 In combination with the reality of urban population and family planning work, the contents and indicators of urban population and family planning work assessment shall be formulated, and the urban population and family planning work in counties and cities shall be assessed separately every year, and the results shall be included in the total scores of counties and cities in proportion. Street (township) all belong to the urban area, according to the urban population and family planning assessment methods; There are both urban and rural areas, and the results are comprehensively evaluated according to the evaluation methods of urban and rural areas and the ratio of urban population to rural population.

Sixty-seventh streets (towns) are responsible for the assessment of units directly under the city, county and city, and report the results to the county and city population and family planning administrative departments. Chapter X Supplementary Provisions

Article 73 The term "urban areas" as mentioned in these Measures refers to the central urban areas, counties and towns of Nanyang.

Article 75 These Measures shall be implemented as of the date of promulgation.
