Basic principles of extradition
Legal analysis: (1) Double criminality principle: refers to the act of the person sought, which must be regarded as a crime by both the requesting country and the requested country and can be prosecuted, otherwise extradition cannot be carried out.

(2) Principle of specific charges: Also known as the principle of the same crime, it means that after the requesting country extradites the extradited person to China, it must try or punish him for the charges he held when requesting extradition, and it is not allowed to try or punish him for other charges different from the extradition charges.

(3) The principle of non-extradition of political prisoners.

(4) The principle of non-extradition of nationals.

Legal basis: Article 7 of the Extradition Law of People's Republic of China (PRC), the extradition request made by a foreign country to People's Republic of China (PRC) must meet the following conditions before extradition can be granted:

(1) According to the laws of People's Republic of China (PRC) and the requesting country, the act indicated in the extradition request constitutes a crime;

(2) Where extradition is requested for the purpose of instituting criminal proceedings, according to the laws of People's Republic of China (PRC) and the requesting country, the crime indicated in the extradition request may be sentenced to fixed-term imprisonment of more than one year or other heavier punishment. If the extradition request is made after the execution of the penalty, the sentence of the person sought has not been served for at least six months when the extradition request is made.
