Measures for the administration of ship berthing points in Taiwan Province Province, Fujian Province
Article 1 In order to strengthen the management of ship berthing points in Taiwan Province Province, ensure the safety of ships coming to Taiwan, facilitate the exchange of compatriots in Taiwan Province Province, and promote the economic and cultural exchanges between Fujian and Taiwan, these measures are formulated in accordance with the Measures for the Administration of China Citizens' Exchanges in Taiwan Province Province and other relevant laws and regulations, combined with the actual situation of this province. Article 2 Ships from Taiwan Province Province entering the coastal areas of Fujian Province shall berth at the berthing point of Taiwan Province Province approved by the provincial people's government (hereinafter referred to as the berthing point). Article 3 Except as otherwise provided by laws and regulations, all ships in Taiwan Province Province and compatriots in Taiwan Province Province berthed at berthing points shall abide by these Measures when entering or leaving the country. Article 4 Ships in Taiwan Province Province are still sheltering from the wind in Taiwan Province Province approved by the provincial people's government due to force majeure such as typhoon. Once the force majeure is lifted, they should leave the port immediately. Article 5 The entry and exit of ships and their personnel, goods and luggage in Taiwan Province Province shall be supervised by frontier defense, customs, health and quarantine departments according to law.

After the ship in Taiwan Province Province enters the berthing point, the captain shall take the initiative to show the ship certificate, crew certificate or other valid documents to the public security frontier guards, explain the berthing reasons and berthing time, and assist the inspectors to inspect the hull, cargo and luggage. Article 6 The frontier defense department of public security shall not grant permission to disembark if it finds that the personnel on board have any of the following circumstances:

(a) there is no certificate to prove that he is a compatriot in Taiwan Province Province;

(2) Providing false certificates and other fraudulent acts;

(3) Deported persons shall not enter the country within the time limit;

(4) Unsupervised patients with serious infectious diseases and mental patients. Article 7 During the berthing of ships in Taiwan Province Province, the personnel on board shall abide by the following provisions:

(a) shall not adjust the berth without authorization;

(two) shall not hang or display signs that are detrimental to the reunification of the motherland;

(three) shall not be allowed to enable the radio station;

(four) no dumping of garbage into the harbour;

(five) shall not carry dangerous prohibited items ashore;

(six) shall not disturb the port order and engage in illegal and criminal activities;

(seven) shall not pick up mainland personnel to board the ship without authorization;

(eight) the ship must have enough crew on duty to ensure safety. Article 8 During the berthing of a ship in Taiwan Province Province, if the staff of the customs, health and quarantine departments need to board the ship for performing official duties, they shall notify the local public security frontier defense department in advance; Other personnel need to go through relevant formalities before boarding the ship. Ninth ships in Taiwan Province Province and compatriots in Taiwan Province Province shall be handled by the relevant departments and units in accordance with the provisions during their berthing in Hong Kong:

(1) Sheltering from the wind, seeking medical treatment, visiting relatives and friends, negotiating investment, offering sacrifices to ancestors, repairing boats for tourism, and supplying goods shall be received and handled by the Taiwan Province Affairs Office of the people's government where the berth is located;

(two) engaged in small-scale trade, by the Taiwan Province Affairs Office of the people's government where the berth is located, introduced to the Taiwan Province Trading Company approved by the Provincial Foreign Economic Relations and Trade Commission;

(3) If maritime and fishery disputes need to be handled, the Taiwan Province Affairs Office of the people's government where the berth is located shall contact fishery administration, port supervision and other departments for handling;

(4) If it is necessary to employ short-term fishermen, the Taiwan Province Affairs Office of the people's government where the berth is located shall introduce them to companies with the right to operate labor services cooperation with Taiwan approved by the provincial people's government.

Where the management of berthing points involves multiple departments, the Taiwan Province Affairs Office of the local people's government shall be responsible for coordination. Tenth Taiwan Province compatriots need to go ashore, should hold the crew certificate or other valid identity documents, to the local public security frontier defense department to apply for the "Taiwan Province compatriots ashore card" or "mainland travel permit for taiwan residents". Eleventh Taiwan Province compatriots should be in a limited range of activities.

Compatriots in Taiwan Province Province who hold the "Taiwan Province Compatriots Landing Certificate" can be active in the township where the anchorage is located; Taiwan Province compatriots can visit relatives, travel, invest and trade outside the town where the anchorage is located. Twelfth compatriots in Taiwan Province Province shall board the ship and leave the country within the validity period of the certificate.

The validity of the Taiwan Province Compatriots Landing Certificate and mainland travel permit for taiwan residents shall not exceed the sailing period of this voyage. Taiwan Province compatriots due to special reasons can not leave the country with the original ship or need to extend the residence period, should apply to the Taiwan Province Affairs Office of the people's government where the slipway is located within the validity period of the certificate, and the public security frontier defense department where the slipway is located will issue a new certificate after being audited by the Taiwan Province Affairs Office of the people's government of the province and the Frontier Defense Bureau of the provincial public security department. Thirteenth Taiwan Province compatriots should leave the country by the original ship from the original landing point.

Due to special reasons, if it is necessary to change from other berthing points in this province or leave the country by other ships in Taiwan Province Province, it shall apply to the Taiwan Province Affairs Office of the people's government where the berthing point is located or the Taiwan Province Affairs Office of the provincial people's government within the validity period of the certificate, which shall be examined and approved by the Taiwan Province Affairs Office of the provincial people's government in consultation with the Frontier Defense Bureau of the provincial public security department. Fourteenth Taiwan Province compatriots lost the "Taiwan Province compatriots landing permit", "mainland travel permit for taiwan residents", it should be reported to the original issuing department; After investigation and verification, it shall be reissued by the original issuing department. Fifteenth ships in Taiwan Province Province shall accept the inspection and inspection by the public security frontier forces, pay the inspection and guardianship fees in accordance with the regulations, and return the "Taiwan Province Compatriots Landing Certificate" or "mainland travel permit for taiwan residents" before leaving Hong Kong. Those who have gone through the departure formalities shall not stay without reason. Sixteenth ships in Taiwan Province Province and Taiwan Province Province in violation of laws and regulations, in accordance with the relevant laws and regulations; If there are no provisions in laws and regulations, the public security frontier departments of provinces, cities (prefectures) and counties (cities) shall handle them in accordance with these measures:

(a) in violation of the provisions of items (1), (2), (3), (4), (7) and (8) of Article 7 of these Measures, the captain and the person directly responsible shall be advised and ordered to make corrections. Refuses to correct, more than one thousand yuan, a fine of three thousand yuan;

(two) in violation of the provisions of eleventh, twelfth, thirteenth and fifteenth, a fine of three thousand yuan and five thousand yuan;

(3) Taiwan Province residents who rent ships to smuggle, alter, forge, falsely use other people's certificates to enter or leave the country or transfer their certificates to others for use shall be fined between 5,000 yuan and 10,000 yuan;

(four) Taiwan Province ships entering the coastal areas of this province are not berthed at the berthing point, and a fine of not less than ten thousand yuan but not more than thirty thousand yuan shall be imposed.

The punishment made by the public security frontier defense department in accordance with these measures shall fill in the award uniformly printed by the provincial public security department.

If the punished person refuses to accept the punishment decision, he may apply for reconsideration or bring a lawsuit to the people's court according to law.
