Online payment
Payment can be made in China Patent Electronic Application Network through the "Online Payment" column of "Login External Service". Users can pay by bank card, and users of patent agencies, enterprises and institutions can pay by enterprise account. You can use your (company's) electronic application account to pay patent fees for others.
(2) Other payment methods
1. Pay the patent fee directly to the Patent Office or its agency.
2. Remittance of patent fees through banks or post offices. When remitting patent fees through banks or post offices, the correct application number (or patent number), fee name (or abbreviation) and amount shall be stated in the postscript column of the remittance slip.
The payment time of the patent fee is as follows:
(1) application fee: the application fee shall be paid within two months from the date of application or within 15 days from the date of receiving the acceptance notice. The fees paid at the same time as the application fee also include publication printing fee and application surcharge. Where the priority is claimed, the priority claim fee shall be paid at the same time.
(2) Substantive examination fee for an application for a patent for invention: the time limit for paying the substantive examination fee is three years from the date of application (if there is a priority requirement, the earliest priority date shall prevail).
(3) Examination fee: The examination fee shall be paid within three months after the applicant receives the decision of the Patent Office to reject the application.
(4) Describe the engineering change fee, etc. : The payment period of the fee for changing the description item, the fee for requesting the patent evaluation report and the fee for requesting invalidation shall be within one month from the date of making the corresponding request.
(5) Claim fee for restoration of rights: the payment period of this fee is within two months from the date when the party concerned receives the notice confirming the loss of rights issued by the Patent Office.
(6) Request fee for extension of time limit: If the applicant requests to extend the time limit specified by the Patent Office, he shall submit a request for extension of time limit and pay the fee before the expiration of the original time limit.
(7) Patent registration fee, annual authorization fee, announcement printing fee and stamp duty: the payment period of the above fees is within two months from the date when the applicant receives the patent authorization notice from the Patent Office.
(8) Annual fee: the annual fee for the year when the patent right is granted shall be paid within the time limit specified in the notice of registration procedures issued by the Patent Office, and the annual fees for subsequent years shall be paid before the expiration of the previous year. The expiration date of the payment period is the corresponding date of the application date of the current year.
(9) Fees for the international phase of PCT application: Please refer to the information provided in the PCT business section of the official website of China National Intellectual Property Administration.
(X) Fees for PCT application to enter the national phase in China: When going through the formalities for entering the national phase in China, the application fee, publication and printing fee, application surcharge and grace fee shall be paid when necessary. Where priority is claimed, the fee for claiming priority shall be paid within 2 months from the date of application; When the applicant applies for the request to restore the priority in the national phase, he shall pay the priority restoration fee at the same time. Where the applicant proposes to modify the translation of the application documents, he shall pay the handling fee for translation error modification within the time limit for submitting the opinions on translation modification. If necessary, the repair fee shall be paid within the time limit specified in the notice of the Patent Office. The payment period of other fees is the same as the national application.
