Some time ago, I read several ethics books, which gave many leading explanations to the headache problem of "the relationship between happiness and law". So what is the law? When it comes to law, those of us who don't study law often think of high-rise buildings in courts, procuratorates, police stations, lawyers in suits and ties, high-ranking judges and so on. It is very difficult to explain what a law is, so change your mind. We humans live by our bodies, which bring endless and growing desires. Desire makes us have two sides. It is precisely because each of us has the dual character of devil and angel that we need laws and moral norms to restrain us. Law, morality and religious history are the three most important constraints. Compared with the other two, law is based on the moral value evaluation of a certain behavior and is a norm to adjust social relations. Whether it should be the standard is the public interest of the society, and the adjustment involves his behavior.
So what is happiness? Happiness is a subjective coexistence between the external environment and itself. From the perspective of ethics, happiness is not only a subjective feeling, but also a subjective feeling for people to meet their objective needs. In our life, the needs of physiology and survival are the low stage of happiness; Love each other. Being loved and giving love is the advanced stage of happiness.
In these books, ethical law is based on moral judgment. The view of law depends on the view of society, and the view of society depends on the outlook on life. The purpose of life is the purpose of society, and the purpose of society is the purpose of law. Therefore, the purpose of life is the purpose of law. The purpose of life is called "supreme goodness" in ethics, and "supreme goodness" is divided into instrumental goodness and purposeful goodness. What we call happiness is a kind of purposeful goodness. * * * Good is the highest purpose of law. There is always a sanction force behind the norms, which allows us to realize our personal needs on the basis of mutual help. Since the realization of happiness needs cooperation, happiness needs to be based on * * * goodness and basic goodness. The purpose of law is to safeguard everyone's basic dignity and equal rights, and it is the pursuit of freedom, justice, equality and efficiency. Law, as a code of conduct and a restraint mechanism, restricts the right of all people with superior resources to abuse resources. In a word, among many characteristics of law, restricting and restraining the abuse of power is one of its most important characteristics. Generally speaking, only under the constraints and restrictions of the law can the dignity and equal rights of ordinary people be truly realized.
According to my reading experience, we regard the basic goodness as the purpose of law, * * * as the purpose of society, and the ultimate goodness as the purpose of life, and the ultimate goodness cannot be a means to achieve other goodness, so we can regard the basic goodness as the basis of all good existence like a ladder. As a system guarantee, law allows all of us to cooperate and establish contracts under the condition of consistent interests, and the realization of happiness usually requires the existence of cooperation, so it is the basis and guarantee of happiness in the history of law. Of course, happiness in the legal and ethical sense is often ideal. After all, happiness as a subjective feeling is difficult to demonstrate accurately.
