China has strengthened the protection of criminal victims' rights in legislation and judicature. The Criminal Procedure Law of People's Republic of China (PRC) revised by 1996 established the status of the victim as a party, broke through the long-term imprisonment that the criminal victim could not be a litigant, improved the litigation rights of the victim to a certain extent, and made the litigation rights of the victim and the defendant obviously unbalanced in the past legislation. However, due to the economic level, judicial system, cultural tradition and backward research, there are still many regrets and deficiencies in the legal provisions and judicial practice of protecting the rights of criminal victims in China, and the rights of victims have not been fundamentally and effectively guaranteed. The victim's rights in criminal proceedings are not only related to the protection of the victim's rights, but also related to the allocation of litigation rights, the construction of litigation structure and other major issues. In the process of pursuing the dual purpose of punishing crimes and protecting human rights, it is inevitable to seek relief and protection for the injured interests of victims, which is an unavoidable mission of a country ruled by law.
