At present, most comrades engaged in anti-corruption research can realize that in order to effectively curb corruption, prevention and punishment must be carried out simultaneously, because prevention and punishment are organically unified and complement each other and promote each other in anti-corruption work. If we only pay attention to punishment but not prevention, we will "press the gourd and float the ladle", which will make the cost of anti-corruption work higher. If we only pay attention to prevention and not punishment, it will condone corruption and is not conducive to preventing corruption. More people especially emphasize the need to strengthen prevention and nip in the bud, which will help reduce the cost of anti-corruption work and get twice the result with half the effort. In this regard, I think the view is correct, but it is obviously not enough to stay at this level of understanding. Effective prevention is not only a matter of how to take measures to prevent it, but also a means of serious investigation. Investigation is not only a means of punishment afterwards, but also an effective means to deter corruption and prevent it. As the saying goes: no one does business at a loss, and some people do business by beheading. In this sense, investigation itself is also a kind of prevention, and effective investigation is a powerful means of prevention. If our anti-corruption organs can persistently investigate and deal with corruption, no matter who or what phenomenon it is, and effectively make corruption lose money, it will play a good warning role and effectively curb corruption. Therefore, in the specific anti-corruption work, we must intensify the investigation and give full play to the deterrent effect of punishing corruption.
The Politburo Standing Committee (PSC) of the Communist Party of China and Wu Guanzheng, secretary of the Central Commission for Discipline Inspection, pointed out in his speech at the training class for discipline inspection and supervision cadres in August this year that the discipline inspection departments should continue to maintain a high-pressure situation in investigating cases, dig deep into corrupt elements, deter corrupt elements, and make them politically discredited, financially bankrupt and ideologically regretful. By then, the cost of investigation will increase by dozens or hundreds of times. If we don't let go of corruption today, no one will dare to commit it again tomorrow. If those corrupt elements gain ill-gotten wealth and become rich and expensive, they will not only endanger the cause of the party and the people, but also corrupt the social atmosphere. Therefore, it is necessary to change the current phenomenon of attaching importance to political discipline and life ethics while ignoring economic issues when dealing with the party member issue. Anyone who violates the party discipline and state law, whether politically, economically or morally, must be investigated and punished in strict accordance with the law and regulations, so as to truly achieve the effect of punishing a very small number of educational majority.
To intensify the investigation and give full play to the deterrent effect of punishing corruption, we must adhere to the concept of keeping pace with the times, improve the methods and methods of handling cases, and improve the ability to use high-tech means to break through cases. At the same time, it is necessary to find out the causes of some typical corruption cases and formulate corresponding preventive measures according to their causes, so as to combine investigating cases with system construction and play a constructive role in preventing corruption.
2. Give play to the role of the media and create a good atmosphere of public opinion supervision. Experience at home and abroad fully shows that sunlight is the best preservative. Public opinion supervision is an important part of socialist political civilization, a powerful weapon to restrict and supervise power, the main way for people to supervise civil servants, and an important embodiment of people being masters of their own affairs. The report of the 16th National Congress of the Communist Party of China pointed out that it is necessary to "strengthen organizational supervision and democratic supervision, and give play to the role of public opinion supervision". The most important feature of corruption is secret trading, and its behavior process is carried out in secret. Therefore, in the anti-corruption work, we must adhere to the party's mass line, rely on the people, give play to the role of the media, and create a good atmosphere of supervision by public opinion. Practice has proved that education is the foundation, legal system is the guarantee and supervision is the key to carry out anti-corruption work. However, whether it is education, legal system or supervision, it is inseparable from the strong support of the news media.
Public opinion supervision, especially news supervision, has the characteristics of wide radiation and high transparency, and plays a unique role in combating corruption and promoting honesty. First of all, it can directly exert great political and psychological pressure on corrupt elements, so that the broad masses of party member cadres can receive profound education. In our country, no matter what level of corrupt elements, their behaviors are similar, that is, they are often afraid of internal notification, public newspaper publishing, demotion and news exposure. In real life, it is often that once the misdeeds of corrupt elements are exposed by the news media, they will be "highly valued" by the relevant departments and eventually investigated.
Secondly, public opinion supervision can effectively reduce the anti-corruption costs of major functional departments. We emphasize that anti-corruption agencies should intensify their anti-corruption efforts. Once corruption is discovered, we must stick to it. Some people may say, can you find out with the current working mode? The investigation cost may be too high for the relevant functional departments to bear. We should really see that if we find and investigate corruption according to the current working mechanism and mode and in the conventional way, the cost is really high. However, if we can play the role of the media and take public opinion supervision as an important means of anti-corruption, we can effectively reduce the anti-corruption costs of major functional departments. First, the transparency and openness of news supervision can effectively scare off many people who want to be corrupt, thus greatly reducing the number of corrupt people; Second, the supervision of news and public opinion can fully mobilize the masses to fight corruption and promote honesty. Once the people's anti-corruption enthusiasm is mobilized, the cost paid by relevant functional departments to discover and expose corruption cases can be greatly reduced.
At present, the role of news media supervision in curbing corruption is mostly limited to revealing the truth, rather than directly supervising those who exercise power, and the disclosure of this truth is mostly based on the fact that the parties have behaved badly and are hopeless. Strictly speaking, this kind of news supervision by public opinion has very limited effect on curbing corruption. To change this situation, at present, party committees and government leaders at all levels must correctly treat the supervision by public opinion of the news media, regard criticism as love, regard supervision as motivation, and consciously accept the supervision by public opinion. Discipline inspection and supervision organs at all levels should strengthen contact with news organizations and timely report on the building of a clean and honest party style and anti-corruption work. The relevant news media should set up a column on building a clean and honest party style, actively carry out supervision by public opinion, dare to criticize and expose all kinds of unhealthy trends, especially the outstanding problems strongly reflected by the masses, and even dare to speak out. The press law should be promulgated as soon as possible so that people can enjoy full freedom of public opinion, and any news involving corruption can be disclosed. In this regard, some people may worry about trouble, but there is no need to worry, because there are corresponding laws and regulations, which can effectively restrain irresponsible random dissemination and random reporting. If the relevant media reports are too inaccurate, they will lose their prestige and living conditions; If it is framed or slandered, it will be punished as framed and framed, and its legal responsibility will be investigated. So no one dares to report it, and no one dares to spread it around.
3. Improve the working mechanism and establish a responsibility system to investigate and deal with corruption. In view of the low efficiency and high cost of the current multi-head anti-corruption system, it is necessary to learn from the successful experience of Hong Kong, and the four organs of discipline inspection, supervision, anti-corruption and auditing can be merged to form an anti-corruption institution with higher authority, similar to the Hong Kong Independent Commission Against Corruption, to form a joint force with respective powers and responsibilities. Moreover, this anti-corruption agency is only responsible to the highest authority. At the same time, in order to ensure that this anti-corruption agency can effectively perform its duties, it is necessary to prevent its abuse of power and its inaction, and it must be placed under the dual supervision of the highest authority and the people. In the revised party constitution, the 16th National Congress of the Communist Party of China clearly assigned the responsibility of "organizing and coordinating anti-corruption work" to the Commission for Discipline Inspection. Under the existing political system, this anti-corruption institution should be the unity of the party and the government. Under the unified leadership of the Party's Commission for Discipline Inspection, its vertical leadership, funds and personnel are completely independent, and it is only responsible to the Party's National Congress.
In view of the lack of responsibility system and accountability mechanism, we must take Scientific Outlook on Development as the guide in anti-corruption work, establish a scientific and operable mechanism to investigate and deal with corruption, ensure the implementation of the responsibility system for building a clean and honest party style, truly form the leadership pattern and work situation of the whole party in fighting corruption and promoting honesty, and build a punishment and prevention system at all levels. In this regard, I believe that in order to establish a practical accountability system for corruption, we should scientifically divide the responsibilities of the responsible subjects at three levels:
The first is the responsibility of the main leaders. For a long time, we often simply emphasized that the main leaders of the party and government should take overall responsibility, and overemphasized the so-called leadership responsibility that should be borne by corruption cases in their own units or regions. We should see here that the main leaders of some units or regions are not necessarily responsible for corruption cases, because there are too many cadres to be appointed and promoted through his hands. If there is responsibility, there is also a difference between light and heavy, especially in some places where management is seriously out of touch with management. It is not responsible to let the main leaders be responsible at every turn. This is not only not conducive to eliminating corruption, but will cover up or even condone corruption, because once a corruption case occurs, the main leaders of their regions or departments first think of how to reduce or exempt themselves from their responsibilities, so as to keep their jobs, which is objectively beneficial to corrupt people. Therefore, when a corruption case occurs, we should not simply investigate its so-called "leadership responsibility", but should focus on two aspects: first, whether there are problems in the employment of major leaders, such as using people who know they can't use them; Second, whether the main leaders cover up corruption cases and refuse to investigate and deal with them, especially those corruption cases that have been clearly reported by subordinates, but as the main leaders, they do not agree or cover up, and their responsibilities must be strictly investigated.
The second is the responsibility of the leaders of the anti-corruption department. At present, the Party's Commission for Discipline Inspection, as the main anti-corruption functional department, has achieved certain results in playing the role of organization, coordination and special supervision, but it seems that the implementation of its responsibility system is not in place. Although some reported clues or cases have entered the scope of discipline inspection, for some reasons, such as for stability or economic development, as the main leader of the party Committee or discipline inspection, it is mainly possible to make a decision to shelve first and then investigate. However, how to ensure that the case will not go away after being shelved, and there is a lack of corresponding responsibility measures. Therefore, it is necessary to strengthen the responsibility of the leaders of the anti-corruption department and establish the corresponding responsibility system for handling cases on the basis of strengthening the main leadership responsibilities of the party Committee. When receiving clues to report or finding a case, no matter what level of leadership within the discipline inspection department, it is necessary to file a case or clue, so that it can be reflected, handled and echoed. And these processes should be recorded, no matter which link goes wrong, they should be recorded to prevent people from shirking their responsibilities.
The third is the responsibility of the specific case handlers. In real life, it seems to be a common phenomenon that different investigators have different results in the same type of corruption cases. If the same type of corruption case, the results of different investigators are only different in degree, which is understandable, because it is still within the reasonable error range allowed by "discretion". However, if the investigation results here are not different in degree, but in nature, which leads to a person who should have been dealt with by the party discipline and state law, but escaped punishment because of the "intentional" or "incompetent" of the case handlers, it is not a reasonable mistake allowed by the specific case handlers to exercise their "discretion". To this end, it is necessary to strengthen the responsibilities of specific case handlers. Whether it is "intentional" or "incompetent", corrupt elements are at large. Once verified, it must be strictly investigated. For each case, we must strictly implement the file system, so that some key evidence or clues that appear in the process of investigating cases will not be disposed of by relevant personnel, so as to prevent some case-handling personnel from withdrawing relevant evidence after practicing favoritism and malpractice, so as to avoid accountability afterwards.
4. Strengthen team building and improve the level of discipline inspection and supervision. As the saying goes, to build an efficient and powerful punishment mechanism, strictly investigate and deal with the responsibility system of corruption, and effectively play a deterrent role in punishing corruption, it is inseparable from the high-quality discipline inspection and supervision cadres. In view of the vague understanding of some law enforcement and discipline personnel, they are afraid of offending people by earnestly performing their duties and lack enthusiasm and initiative in their work. We must pay equal attention to education and management, and strengthen the ideological and political quality and sense of responsibility of discipline inspection and supervision cadres. At present, it is especially necessary to seriously study Comrade Hu Jintao's important speech at the Sixth Plenary Session of the Central Commission for Discipline Inspection on June 6, 2006, strengthen party constitution's consciousness, enhance the consciousness of learning from party constitution, observing party constitution, implementing party constitution and safeguarding party constitution, and set an example of strict political discipline and strengthening supervision; We should firmly establish the consciousness that "strengthening supervision is our duty, neglecting supervision is dereliction of duty, and being bad at supervision is incompetence" and earnestly perform the duties of inspection and supervision. Through education, every discipline inspection and supervision cadre can focus on the cause of the party and the people, and can realize that whether to perform their duties seriously is related to the life and death of the party, so as not to be disturbed by other thoughts, trapped by family ties, unmoved by personal interests, and earnestly perform their duties. In view of some law enforcement and discipline personnel's poor ability in investigating and handling cases, they can't complete the task of law enforcement and discipline well, thus allowing corrupt elements to indulge and causing unnecessary losses to the party and the people. It is necessary to strengthen the professional quality training of relevant discipline inspection and supervision personnel to ensure and improve their quality and level of law enforcement and discipline. It is necessary to study the Constitution, laws, party constitution and other inner-party regulations, train and learn professional knowledge of discipline inspection and supervision, and improve the comprehensive quality of law enforcement and discipline.
Reform the current system of discipline inspection and supervision cadres, and stipulate that discipline inspection and supervision personnel must pass the professional training examination according to the requirements of professional posts before they can have the qualification of law enforcement and case handling, and must hold relevant certificates. At the same time, in order to optimize the working and living environment of discipline inspection and supervision personnel, under the current system, we can consider setting their administrative levels according to their professional level to improve their social status and work enthusiasm.
At the same time, it is necessary to optimize the working environment of discipline inspection and supervision cadres, establish and improve the work guarantee mechanism, so that their noble professional dignity can be guaranteed not only politically, but also economically, so that they can really join the anti-corruption work without worries.
