1. If the published article is only received and to be published, or the publication date of your article (the publication date is based on the date given by CNKI, and the publication online date given by foreign journals is based on the date given by journals) is later than or equal to your patent application date, your article will not affect the novelty or creativity of your patent. In this way, your article will not conflict with your patent. Your article does not belong to the existing technology (existing technology refers to the technology known to the public at home and abroad before the application date), and your article cannot affect the novelty or creativity of your patent (for the definition of novelty and creativity, see the second and third paragraphs of Article 22 of the Patent Law).
2. If the publication date of your article is earlier than the filing date of your patent application (not including the same day), your article can affect the novelty and creativity of your patent. At this time, unless you can continue to improve the content of the article on the basis of the article to meet the requirements of novelty and creativity, your own article will become the existing technology for evaluating your patent. Your patent will be rejected because it does not conform to the provisions of Article 22, paragraph 2, or Article 22, paragraph 3 of the Patent Law.
