First, the current situation of pneumoconiosis in China

1. Pneumoconiosis is the most harmful occupational disease in China. According to the data released by the National Health Planning Commission at the end of June, in 20 14 years, 23 152 cases of pneumoconiosis were reported in 30 provinces (autonomous regions and municipalities) except Tibet and Xinjiang Production and Construction Corps, accounting for 87.72% of the total reported cases of occupational diseases.

2. Migrant workers are the main victims of pneumoconiosis. According to the Investigation Report on the Living Conditions of Migrant Workers' Pneumoconiosis in China (20 14) issued by Aida Dust Clearing Fund of China Social Assistance Foundation, migrant workers account for 90% of pneumoconiosis patients. It is conservatively estimated that there are at least 6 million migrant workers with pneumoconiosis in China, and the mortality rate is as high as 22.04%, with more than 20,000 new migrant workers with pneumoconiosis every year. Its onset age is between 30 and 50 years old, accounting for more than 90% of the total number, and most of them are the breadwinners of the family.

Second, the status quo and obstacles of pneumoconiosis rescue

China has promulgated a series of laws and regulations to protect the legitimate rights and interests of pneumoconiosis workers, such as the Social Insurance Law, the Occupational Disease Prevention Law, the Industrial Injury Insurance Regulations, the Classification and Catalogue of Occupational Diseases, and the National Standard for Labor Ability Appraisal. However, due to the small coverage of the existing relief compensation system, the complicated procedures of occupational disease identification (industrial injury identification) and the difficulty in claiming compensation, the way for most pneumoconiosis patients to get relief is still difficult.

1. Most pneumoconiosis patients did not buy work-related injury insurance. The reality is that most pneumoconiosis patients have not signed labor contracts, not to mention enterprises buying industrial injury insurance for them. According to the 20 12 monitoring survey of National Bureau of Statistics, the proportion of migrant workers who have not signed labor contracts with employers or units is as high as 56.2%, so most pneumoconiosis patients cannot get insurance assistance.

2. The basic medical insurance does not cover pneumoconiosis. Because pneumoconiosis is a work-related injury, work-related injury insurance is responsible for medical treatment and rehabilitation expenses, so the basic medical insurance in most areas does not include pneumoconiosis at present. The Survey Report on the Living Conditions of Migrant Workers' Pneumoconiosis in China (20 14) points out that 82.4% of migrant workers' pneumoconiosis patients have not received medical assistance, and most migrant workers lack the most basic living and medical security.

3. Medical assistance can't solve the fundamental problem of later treatment. Although the current provisions "the employer no longer exists or can not confirm the labor relationship of occupational disease patients, can apply to the civil affairs department of the local people's government for medical assistance and life assistance". In fact, it is difficult for most pneumoconiosis patients to apply for medical assistance from the government. Even if they apply for certain medical assistance, it is difficult to solve their fundamental problems, which will also increase the burden on the government and encourage employers to evade their responsibilities.

It is difficult for patients to ask their former employers to fulfill their responsibilities. In reality, due to the high mobility of pneumoconiosis patients, they are often found sick after leaving their work units. As a vulnerable group, according to the provisions of the Law on the Prevention and Control of Occupational Diseases, it is difficult for them to find their original units to be responsible for them.

Three, the establishment of pneumoconiosis rescue full coverage security system.

1. Improve the existing industrial injury insurance system.

(1) Relevant departments should strengthen supervision and guidance on the signing of labor contracts, coverage of work-related injury insurance, working environment, etc., clarify corporate responsibilities, and strictly supervise dust-related enterprises, not only the payment of enterprise insurance, but also the implementation of production protection measures. In areas where the Law on the Prevention and Control of Occupational Diseases is poorly implemented, the responsibility of the relevant regulatory authorities must be investigated.

(2) Simplify the process of occupational disease identification of pneumoconiosis and implement the system of "first payment" for industrial injury insurance benefits. The procedure of dealing with work-related injuries is complicated and time-consuming. For pneumoconiosis patients, procedures such as occupational disease diagnosis, initial identification of occupational diseases and re-identification of occupational diseases have been added. It is suggested to simplify the process of occupational disease diagnosis and industrial injury identification of pneumoconiosis. Patients who are unable to determine the responsible enterprise shall be dealt with in accordance with the relevant provisions of the Social Insurance Law and the Interim Measures for Advance Payment of Social Insurance Funds.

2. Establish a system that pneumoconiosis is included in the basic medical security.

Drawing lessons from the experiences of Shuifu in Yunnan, Leshan in Sichuan, Xiushui in Jiangxi and Gulang in Gansu, and focusing on the actual research on the processes of payment, transfer, enjoyment, handling, fund management and value preservation and appreciation, we will comprehensively establish and improve the system of bringing pneumoconiosis into the medical security system.

3. Establish a multi-channel rescue fund for pneumoconiosis patients and improve the rescue channels for pneumoconiosis patients.

The government has increased its support, mobilized all social forces to establish a rescue fund for pneumoconiosis patients, and ensured the stability of the rescue fund for pneumoconiosis. According to the model of pneumoconiosis compensation fund in Hong Kong, the funds are mainly shared by dust-related enterprises and governments at all levels, and social charitable donations are advocated. The fund is mainly used to provide treatment expenses and basic living security expenses for pneumoconiosis patients who cannot get occupational disease treatment according to the current procedures. While improving the industrial injury insurance and basic medical security system for pneumoconiosis patients, it is also necessary to implement the responsibilities of the government and enterprises and establish a green channel for health departments, civil affairs departments and financial departments to provide medical assistance and life assistance to pneumoconiosis patients.
