Regulations of People's Republic of China (PRC) on Civil Aviation Safety and Security
Chapter I General Provisions Article 1 These Regulations are formulated for the purpose of preventing illegal interference with civil aviation activities, maintaining civil aviation order and ensuring civil aviation safety. Article 2 These Regulations shall apply to all civil aviation activities and units and individuals related to civil aviation activities in People's Republic of China (PRC).

These Regulations apply to civil aircraft with People's Republic of China (PRC) nationality engaged in civil aviation activities outside the territory of People's Republic of China (PRC); However, unless otherwise stipulated in international treaties concluded or acceded to by People's Republic of China (PRC). Article 3 Civil aviation security work shall follow the principles of unified management and division of responsibilities.

Civil aviation public security organs (hereinafter referred to as civil aviation public security organs) are responsible for unified management, inspection and supervision of civil aviation security work. Article 4 The relevant local people's governments and civil aviation units shall cooperate closely to safeguard the safety of civil aviation. Article 5 Passengers, consignors and consignees of goods and other persons entering the airport shall abide by the laws, regulations and rules of civil aviation safety management. Article 6 Civil airport operators and civil aircraft operators shall perform the following duties:

(a) to formulate the civil aviation security plan of this unit and report it to the competent civil aviation department of the State Council for the record;

(2) Strictly implement measures related to civil aviation safety and security;

(three) regular civil aviation safety training, timely elimination of hidden dangers endangering civil aviation safety.

A foreign civil aviation enterprise jointly operated with People's Republic of China (PRC) shall submit a civil aviation security plan to the competent civil aviation authority in the State Council. Article 7 Citizens have the right to report to the civil aviation public security organs premeditated hijacking, destruction of civil aircraft or other acts endangering civil aviation safety. Eighth units or individuals that have made outstanding contributions to the maintenance of civil aviation safety shall be rewarded by the relevant people's government or the competent civil aviation department of the State Council. Chapter II Safety and Security of Civil Airports Article 9 The construction, reconstruction and expansion of civil airports (including the civil part of military-civilian airports, the same below) shall conform to the provisions of the competent civil aviation authority of the State Council on the construction of safety and security facilities for civil airports. Article 10 When a civil airport is opened for use, it shall meet the following safety conditions:

(1) Having airport control areas and full-time security personnel;

(two) there are protective fences and patrol channels that meet the standards;

(3) Having a safety organization and corresponding personnel and equipment;

(4) Having a safety inspection agency, equipped with personnel and inspection equipment suitable for airport passenger flow;

(5) Having a full-time fire fighting organization, and being equipped with personnel and equipment according to the airport fire fighting level;

(six) emergency plan, equipped with the necessary emergency rescue equipment. Article 11 The airport control area shall be divided into waiting isolation area, baggage sorting and loading area, aircraft activity area, maintenance area and cargo storage area according to safety needs, and safety protection facilities and obvious signs shall be set up respectively. Twelfth airport control areas should have strict security measures, the implementation of closed zoning management. The specific administrative measures shall be formulated by the competent civil aviation authority of the State Council. Thirteenth people and vehicles entering the airport control area must wear the airport control area pass and be inspected by security personnel.

The airport control area pass shall be issued and managed by the civil aviation public security organ in accordance with the relevant provisions of the competent civil aviation department of the State Council. Fourteenth personnel and vehicles in the aircraft activity area and maintenance area must follow the prescribed route, vehicles and equipment must be parked at designated places, and all personnel and vehicles must avoid the aircraft. Fifteenth civil aircraft parked at the airport must be guarded by special personnel; All relevant departments and their staff must strictly implement the handover system of aircraft guards. Article 16 The following acts are prohibited in the airport:

(1) Climbing (drilling) over or damaging airport protective fences and other safety protection facilities;

(2) Hunting, grazing, drying grain and coaching and driving vehicles in the airport control area;

(3) Entering the airport control area without an airport control area pass;

(four) crossing the runway and taxiway at will;

(5) forcibly boarding or occupying an aircraft;

(six) lying about the danger and creating chaos;

(seven) other acts that disrupt the order of the airport. Chapter III Security of Civil Aviation Operation Article 17 When selling passenger tickets, carriers and their agents must comply with the relevant provisions of the competent civil aviation authorities in the State Council; Those who do not meet the requirements may not sell tickets. Article 18 The carrier must check the passengers and luggage when handling the transportation formalities. Article 19 When passengers board the plane, the carrier must check the number of passengers.

The luggage of passengers who have checked in but have not boarded the plane shall not be loaded or left in the aircraft.

When passengers stop traveling in the middle of the flight, they must unload their luggage. Article 20 The carrier must have a special person to supervise the storage and transportation of luggage and goods on the ground. Article 21 Units that prepare and load materials must ensure the safety of materials loaded on aircraft. Article 22 The pilot-in-command shall be responsible for the safety of the aircraft in flight.

Under the leadership of the captain, the aviation safety officer undertakes the specific work of safety and security.

The pilot-in-command, aviation safety officers and other crew members shall strictly perform their duties and protect the safety of civil aircraft and its personnel and property.
