How China Enterprises Deal with Anti-dumping
The so-called anti-dumping means that the importing authorities take compulsory measures against dumped products from foreign countries in order to protect their own industries, so as to raise the selling price of dumped products in the domestic market of the importing country or limit the import quantity. However, anti-dumping countries often abuse anti-dumping measures to protect trade in the name of anti-dumping. Since the reform and opening up, with the rapid development of China's economy and the continuous expansion of China's exports, there have been more and more foreign anti-dumping charges against China.

Measures:

(A) improve product quality, enhance brand awareness, out of the shadow of low prices.

China enterprises should vigorously improve product quality, strengthen after-sales service and establish their own brands. Don't just rely on price competition as the main means of competition, but win with quality and service. This can not only meet the domestic market demand, but also improve the quality of export products, thus changing the original product image. The improvement of product quality can not only increase the export price of products through the increase of costs, but also increase the added value of products through the establishment of brand image. Because anti-dumping is mainly aimed at the low price of products, China enterprises should strive to get out of the trough of low quality and low price, reduce the incentives for foreign anti-dumping and prevent giving orders.

(2) Responding to anti-dumping with the help of overseas direct investment.

Overseas direct investment can not only effectively bypass foreign trade barriers and greatly reduce the probability of being sued for dumping, but also has the following three advantages: first, it can transfer excess domestic production and technological capabilities; Second, learn the latest foreign technology, management, information, experience and marketing to exercise and enhance the competitiveness of enterprises; Third, to meet the requirements of economic globalization, we should build a global production, R&D and marketing network for enterprises and accelerate the development of multinational companies in China. In China, the most typical case of foreign capital circumventing anti-dumping is Haier's investment in the United States.

(3) Training professionals and actively responding to anti-dumping.

According to statistics, in 480 anti-dumping cases against China, at least 50% of China enterprises chose to give up responding. Some of them don't know how to respond to the lawsuit because they don't understand international trade laws and regulations and lack international business talents. At present, there are 2,000 anti-dumping professionals in the United States, while there are only 20 in China, which is only 1% of the United States. There are 200 anti-dumping investigators in the EU, and less than one tenth of them are engaged in anti-dumping investigations in China. Therefore, enterprises should cultivate outstanding international business talents with high knowledge and professional quality in economy, law and foreign languages from a strategic perspective, and provide strong human resources support for the victory of responding to anti-dumping.

(4) Take the initiative to take up anti-dumping weapons to protect the legitimate rights and interests of China enterprises.

This will not only counteract foreign anti-dumping against China, but also eliminate foreign unreasonable competition in China and protect China's industrial security. For example, after nine newsprint producers, including Jilin Paper Group Co., Ltd., filed anti-dumping complaints against newsprint imported from Canada, South Korea and the United States, WISCO sued Russia for dumping cold-rolled silicon steel sheets, and six companies, including DuPont, sued Korean companies for dumping polyester films. But on the whole, there are few cases of foreign dumping in China's enterprise litigation. This is not to say that there is no dumping against China by foreign businessmen, but that China enterprises lack the awareness of taking anti-dumping as a legal means. Therefore, China's export enterprises should also take the initiative to take up anti-dumping weapons, deal with a man as he deals with you and safeguard their legitimate interests.

(E) Change marketing concepts and implement diversified international marketing strategies.

China enterprises should develop from single trade in goods to technology trade, at the same time, improve the scientific and technological content of products, reduce conflicts between domestic enterprises and avoid the situation of low-price competition. In terms of commodity structure, China enterprises should increase investment in scientific research and change "winning by cheap" into "winning by quality". In the increasingly fierce international competition, we must strive to improve the scientific and technological content and added value of export commodities. In the long run, we should speed up the system reform, adjust the economic structure, upgrade the industrial level, improve the export structure, optimize the export structure and improve the export efficiency. In the market structure, it is necessary to change from over-concentration of the target market to market diversification. While consolidating the existing European and American markets, we should actively explore overseas emerging markets to reduce the risks caused by excessive market concentration and avoid anti-dumping investigations. In terms of means of competition, we should change simple price competition into various means of competition. In the mode of operation, it is not only beneficial to the transfer of domestic excess capacity, but also to improve the internationalization of enterprises to change simple export commodities into foreign direct investment.

(six) standardize the internal management of enterprises.

Enterprises in China should speed up the unified accounting management, in line with international standards. These data will become an important source of evidence for anti-dumping litigation. Enterprises should not only adopt international standards, but also understand the relevant systems of major exporting countries and pay attention to the differences between them. In this way, our accounting statements will be more standardized, with stronger probative force and credibility. (7) Domestic enterprises should unite and be consistent with the outside world.

Some domestic enterprises are often unable to cooperate or actively cooperate with other enterprises in the same industry when encountering anti-dumping lawsuits, and quite a few enterprises have the psychology of "hitchhiking". Once the foreign anti-dumping lawsuit against China is successful, China's similar products and similar products will be hit hard in this market, and may even withdraw from this market completely. This will have a great impact on China's foreign trade in this industry. Therefore, domestic enterprises should unite to safeguard the legitimate rights and interests of enterprises, should unite to raise funds, and give all-round support and encouragement to enterprises involved in litigation and other enterprises in the same industry.

(eight) to strengthen contact and cooperation with foreign enterprises.

In anti-dumping cases, the interests of the prosecution are often diversified and multifaceted. Therefore, in foreign trade, China enterprises should promote in-depth understanding and cooperation between the two sides of the trade, and reach relevant agreements, so that when China products are accused of dumping, some relevant domestic enterprises can participate in the litigation, provide relevant certificates in our favor, and even persuade the prosecution to withdraw the lawsuit. This has been one of the important ways to solve the anti-dumping investigation.

(nine) to deepen the legal understanding of the importing country and expand the information channels.

China enterprises should train a group of professional legal talents as soon as possible and actively respond to anti-dumping. China enterprises don't respond to anti-dumping, to a great extent, they don't dare to respond, but they don't know international trade laws and regulations, lack international business talents and don't know how to respond. Therefore, enterprises should cultivate outstanding international business talents with high knowledge and professional quality in economy, law and foreign languages from a strategic perspective, and provide strong human resources support for the victory of responding to anti-dumping. At the same time, some overseas institutions and overseas enterprises that export foreign capital can learn about the national laws, regulations and policy trends, and feed them back to relevant institutions and enterprises in China in time to form a fast and efficient information network and improve China's early warning mechanism.

(10) Protect your legitimate rights and interests through anti-dumping.

The momentum of foreign anti-dumping charges against China is more and more fierce, while the anti-dumping charges filed by China are few. This does not mean that foreign manufacturers do not dump China, but that China enterprises do not know that anti-dumping is a legal means of protection. Due to the reform of tax administration and tariff reduction in China, the market access conditions have been greatly improved, and the lack of corresponding strict management has led many foreign companies to enter China one after another. They did not hesitate to dump their products by lowering prices or even selling them at a loss. Therefore, while China's export enterprises actively respond to foreign anti-dumping allegations, the production enterprises directly threatened by dumping must take the initiative to use anti-dumping measures to protect their own interests from damage.

Generally speaking, in the face of numerous international competitors, China enterprises are still at an obvious disadvantage. Therefore, enterprises in China should deeply realize the harmfulness of this situation, adjust their business ideas in time, improve the enterprise system, and fundamentally improve their competitiveness. Only in this way can we effectively avoid or deal with foreign anti-dumping behavior. At the same time, starting from the enterprise itself, enterprises should seize the opportunity and immediately start to strengthen enterprise management, with the focus on management according to law and strict management. Build the standards into the corporate culture, so that employees can gradually develop good work likes under the influence of the corporate culture and form the corporate culture. In addition, enterprises should realize that only in strict accordance with the requirements that development is the first priority, science and technology are the first productive force and human resources are the first resource, adhere to the road of rejuvenating the city through science and education, innovate constantly and carry out all kinds of work pragmatically, can they be in an invincible position in the market competition.
