How to properly handle the contradictions and disputes in the current land contract transfer is a problem that organizations at all levels, especially at the township (town) and village levels, must attach great importance to. On the basis of investigation and study, the author thinks that to deal with such contradictions and disputes, we must adhere to a series of policies and regulations, such as "People's Republic of China (PRC) Rural Land Contract Law" and "Jiangsu Rural Collective Land Transfer Measures", so as to develop rural economy, safeguard farmers' interests and stabilize rural society. It is necessary to protect and mobilize farmers' enthusiasm for farming, safeguard farmers' rights and interests in land contracting, seek truth from facts and properly handle them to prevent more and greater social contradictions.
1. Collective economic organizations should first do a good job in ideological work and encourage migrant farmers to continue to engage in secondary and tertiary industries if they have stable employment and permanent residence. If farmers really need land, and the original contracted land has been professionally contracted, in principle, the contracted land will be returned after the expiration of the professional contract. If the land contracted by farmers has been evenly distributed to other members of the collective economic organization, it can be solved in the floating land. If there is no floating land, we should try our best to help farmers acquire land through land circulation. If it cannot be solved, it will be solved in the next small land adjustment. At present, it can be dealt with by giving appropriate subsidies. For empty hanging households, pocket households and other personnel who require land contracting, in principle, it shall be handled at the location of the original account. If the original contracted land has been contracted out, it will be returned after the expiration of the contract. If the original contracted land has been subcontracted equally, in principle, it will be implemented when the land is slightly adjusted next time. When returning and implementing the contracted land, it is necessary to pay back the tax arrears.
2. In the process of land transfer, if the land transfer contract is not directly signed with the farmers, it shall be completely reissued, or the entrusted transfer procedures shall be improved. If there is no land transfer contract but there is an agreement, it shall be signed according to law; The original circulation contract is not standardized, especially for contracts with large opinions from the masses, low compensation standards and long circulation time, the compensation standards and methods should be adjusted according to the situation. For forcing farmers to transfer land, we must first do detailed work to passivate contradictions and improve the necessary procedures after gaining the understanding and support of the masses. If it is really necessary to return the land without the consent of the masses, the land should be returned through consultation in principle. Collective economic organizations or other organizations that intercept or deduct the proceeds from land transfer shall return them to farmers in full.
3, to divide the "grain ration field" and "responsibility field" as an excuse, to recover the contracted land for farmers to engage in bidding and contracting, in principle, to maintain the seriousness of the bidding and contracting contract, and continue to perform, but the bidding income will be dealt with separately from now on as the case may be. Collective economic organizations without additional investment in transformation, in principle, all returned to farmers. Collective economic organizations transformed by increasing investment should be rationally distributed between collectives and farmers on the basis of consensus. For those who have received the contract payment at one time and used it for debt repayment and work, they should be patiently and carefully explained and not returned. Collective debt is high, it is really necessary to continue to use contracted funds to pay off debts, we must fully solicit the opinions of the masses, and they can only be carried out after they agree and sign and seal. After the expiration of bidding contract, the right to contracted management of land must be reconfirmed.
4, due to the heavy burden on farmers, low food prices, inconvenient farming and other reasons, and some groups voluntarily hand over the land at the regiment level to the village level and deduct relevant taxes and services accordingly, we must deal with it realistically. If all farmers signed and sealed at that time, they should register the change of land ownership in accordance with the regulations. If the farmers didn't sign or seal at that time, or only the team leader signed, it is necessary to improve the procedures and register the change of land ownership after it is in place. At that time, most people disagreed. Now, if the land is still managed collectively and farmers need it, they must return the land to the group level and re-establish the right to the household. If the land has been contracted out and cannot be returned temporarily before it expires, the contracted income will be returned to the Group from now on. Collective economic organizations invest more to improve production conditions, and after consultation, the contracted income is reasonably distributed among villages, groups or farmers; If the village-level collective economic organizations do not increase the input of cultivated land, all the contracted income should be returned to the group or farmers. If the contract money has been collected and used in one lump sum at the time of awarding the contract, the group-level income due should be recorded in the group accumulation year by year, and then returned when the village-level collective economic organization has the ability. After the expiration of the professional contract, the right to contracted management of land shall be returned to the group or entrusted to the collective economic organization for re-contracting. In principle, the seriousness of the original contract should be maintained, and the main body of the contract is still the village-level collective economic organization, but the benefits should be reasonably distributed between villages and groups according to the investment situation at the village level.
