Provisions of Guangzhou Municipality on the Administration of Blood Donation
Chapter I General Principles
Article 1 In order to ensure the need and safety of blood for medical clinical use, and to ensure the health of blood donors and blood users, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on Blood Donation and the actual situation of this Municipality.
Article 2 These Provisions shall apply to blood donation, blood collection, blood supply and blood for medical and clinical use within the administrative area of this Municipality.
Article 3 This Municipality shall implement the system of voluntary blood donation according to law.
Advocate1healthy citizens aged 8 to 55 to donate blood voluntarily.
Encourage national staff, active servicemen and college students to take the lead in donating blood.
Chapter II Organization and Management
Fourth people's governments at all levels shall lead the blood donation work within their respective jurisdictions, formulate blood donation work plans, and ensure the funds for blood donation work.
The Municipal People's Government Blood Donation Working Committee is responsible for formulating the annual blood donation work target and issuing it step by step according to the annual blood use plan.
Blood donation committees of people's governments at all levels are responsible for organizing, coordinating and urging relevant departments and units to jointly do a good job in blood donation, organizing education and publicity of blood donation laws and regulations, popularizing scientific knowledge of blood and blood donation, and mobilizing and organizing all units within their respective jurisdictions to carry out blood donation work.
The office of the blood donation working committee of the people's governments at all levels (hereinafter referred to as the blood donation office) is responsible for the daily work of blood donation.
Fifth city, district, county-level city health administrative departments are the supervision and management departments of blood donation, blood collection, blood supply and medical clinical use.
The municipal public health administrative department is responsible for examining and approving the annual blood use plan; Formulate blood management system; Formulate the adjustment plan of blood collection and supply; Preliminary examination of the establishment of blood stations (including blood centers, central blood stations, grass-roots blood stations or central blood banks), and report to the competent department for examination and approval step by step; Supervise and manage the practice activities of blood stations; Formulate emergency blood collection and blood supply plans for major disasters and accidents.
The health administrative department of the district or county-level city shall be responsible for the supervision and management of blood donation, blood collection, blood supply and medical clinical blood use in the local area, and prepare and report the annual blood use plan in the local area.
Sixth government departments at all levels should actively assist in their respective duties and jointly do a good job in blood donation.
Radio and television, press and publication, culture and other administrative departments and news media shall, according to the requirements of the government's blood donation work, do a good job in the publicity and reporting of unpaid blood donation.
The administrative department of finance shall, jointly with the administrative department of health, supervise the use of blood donation funds.
The administrative department of education shall incorporate the publicity of blood donation laws, regulations and blood physiological knowledge into the contents of school health education.
The planning administrative department shall incorporate the setting of blood donation points into urban planning.
Public security, personnel, labor and social security, industry and commerce, price, statistics and other administrative departments shall do a good job in blood donation according to their respective responsibilities.
Red Cross Societies at all levels shall participate in and promote blood donation according to law.
Article 7 State organs, social organizations, enterprises and institutions, residents' committees and villagers' committees within the administrative area of this Municipality shall, according to the government's annual blood donation work objectives, formulate blood donation work plans for their own units and their respective jurisdictions, and promptly mobilize and organize healthy citizens (including foreigners who have lived temporarily for more than three months) in their own units or areas to participate in blood donation.
Chapter III Blood Donation and Blood Collection and Supply Management
Article 8 A blood station is a non-profit public welfare organization established according to law and responsible for collecting and providing blood for clinical use.
Except for women's blood stations established according to law, no other unit or individual in this Municipality may engage in blood collection and supply business.
Blood stations that flow to organs, enterprises, institutions, schools or other public places to collect blood according to actual needs shall abide by the provisions of relevant laws and regulations and inform the municipal public health administrative department.
Article 9 Blood collection and supply in blood stations shall strictly abide by laws, regulations and relevant technical operating rules and systems for blood collection and supply.
It is forbidden to collect blood from people who have not undergone health examination or who do not meet the health examination standards for blood donors formulated by the health administrative department of the State Council.
It is forbidden to provide blood that has not been tested or failed to pass the test to medical institutions.
Article 10 Citizens may donate blood directly to blood stations or blood collection points set up by blood stations with valid identity documents.
After citizens donate blood, the blood station will issue a unified blood donation card to the health administrative department of the State Council, and the unit where they work can give appropriate subsidies and rewards.
Eleventh units shall, in accordance with the provisions of article seventh, do a good job in mobilizing and organizing blood donation. If the number of blood donors reaches the prescribed proportion of the government's annual blood donation target during the year, it will be issued by the blood donation office (annual mutual blood donation card), valid for one year.
Article 12 It is forbidden to forge, alter, lend, lease, buy, sell, copy and transfer (blood donation certificate) and (annual mutual aid blood donation card).
Thirteenth any unit or individual is prohibited from organizing others to sell blood.
No unit or individual may hire others to donate blood as an impostor. Units that employ others to donate blood as imposters shall be regarded as failing to complete the annual blood donation target.
Chapter IV Management of Blood Use
Article 14 When citizens use blood for medical treatment and clinical use, medical institutions shall collect blood collection, storage, separation, inspection and transportation fees according to the standards set by the state.
Fifteenth unpaid blood donors, after blood testing, their spouses and immediate family members enjoy the following rights of clinical use of blood:
(1) Those who donate more than 200 milliliters of blood without compensation may be exempted from the expenses of blood collection, storage, separation, inspection and transportation;
(2) Those who donate more than 600 ml of blood without compensation, their spouses and immediate family members are exempt from the above fees when using blood for clinical purposes.
After donating blood, unpaid blood donors who fail to pass the blood test may be exempted from the expenses of blood collection, storage, separation, inspection and transportation according to the amount of blood donated.
Article 16 Blood donors or their spouses or immediate family members who use blood in this city shall be exempted from paying blood collection, storage, separation, inspection and transportation fees in accordance with the provisions of Article 15 of these Provisions, and shall go through the formalities in the medical institution where they see a doctor in accordance with the following provisions:
(1) If a voluntary blood donor uses blood himself, it shall be handled with his valid identity certificate and (voluntary blood donation certificate);
(two) the spouse and lineal relatives of the blood donor donate blood, with the valid identity documents of the blood donor and (blood donation card), the valid identity documents of the blood donor and the valid proof of the relationship with the blood donor.
Blood donors or their spouses or immediate family members who use blood in different places shall be exempted from the expenses of blood collection, storage, separation, inspection and transportation in accordance with the provisions of Article 15 of these Provisions, and the blood donors shall go through the reimbursement procedures at the blood donation office with the documents and certificates prescribed by previous fraud and the blood use certificate and blood use charge documents issued by medical institutions.
Blood donation offices and medical institutions shall settle accounts regularly.
Article 17 This Municipality implements the system of mutual assistance in blood use.
Non-blood donors with work units cannot show their spouses or immediate family members when using blood.
Non-blood donors with work units need to show their blood when using blood (the unit helps each other on the blood donation card every year), and the unit should cooperate.
Non-blood donors who have no work unit can't show their spouses or immediate family members (blood donation certificate) when using blood, they shall pay blood mutual aid in accordance with the provisions of the second paragraph of this article.
Blood mutual fund is calculated at three times the cost of blood collection, storage, separation, inspection and transportation.
Article 18/kloc-Citizens under 0/8 years old and over 55 years old who use blood in medical institutions with their valid identity documents and 9 local household registration books are exempt from paying blood mutual funds.
Revolutionary honorary soldiers use blood in medical institutions with valid identity certificates, and those who are brave enough to do good deeds use blood with certificates or confirmation certificates from public security organs, and are exempt from paying blood mutual aid funds.
Nineteenth emergency patients and critically ill patients can use blood first, and if they fail to show themselves or their spouses or immediate family members (unpaid blood donation certificate) or their units (blood donation card annual mutual fund) when they leave the hospital, they will pay blood mutual fund according to the provisions of Article 17 of these Provisions.
Article 20 If a unit obtains (the annual mutual blood donation card of the unit) or a blood donor without a unit obtains (the unpaid blood donation card) within six months from the date of issuing blood mutual funds, the blood donation office shall return the principal and interest of the paid blood mutual funds.
If the unit fails to receive (the annual mutual aid blood donation card of the unit) or the blood donor without the unit fails to receive (the unpaid blood donation certificate) within the time limit, the blood mutual aid funds paid will not be refunded and all will be turned over to the finance at the same level for the development of blood donation in this city.
Article 21 Blood mutual funds shall be registered in the special account set up in the blood donation office, incorporated into the financial special account management at the same level in accordance with the regulations, and two lines of revenue and expenditure shall be implemented for special purposes.
The blood donation office shall accept the supervision and inspection of the administrative departments of price, finance and auditing at the same level.
Twenty-second medical institutions for clinical use of blood must comply with the following norms:
(a) the use of blood provided by blood stations established in accordance with the law in this Municipality shall not be used to transfer blood from other places;
(2) The storage and transportation of blood must meet the hygienic standards and requirements stipulated by the state;
(three) in accordance with the relevant provisions of the project, to check the blood for clinical use. Without verification or verification does not meet the national standards, shall not be used for clinical;
(four) strictly implement the technical norms and systems of blood transfusion, use blood scientifically and rationally, and put an end to waste and abuse of blood;
(five) shall not engage in blood collection and supply business or collect blood for medical use;
(six) shall not sell blood or use raw plasma for clinical purposes;
(seven) in accordance with the provisions of national, provincial and municipal projects and standards to collect blood fees, shall not be arbitrarily increased.
Medical institutions shall formulate norms and standards for clinical blood use and implement responsibility management.
Twenty-third medical institutions should actively promote blood transfusion according to the actual needs of medical treatment.
Twenty-fourth in order to ensure the needs of citizens for clinical emergency blood, patients undergoing elective surgery are instructed to store their own blood.
Chapter V Reward and Punishment
Twenty-fifth units and individuals who have made remarkable achievements in blood donation and clinical blood use shall be commended and rewarded by the Municipal People's Government and the Municipal Red Cross Society:
(a) units and individuals who actively participate in emergency blood donation in major disasters and public health emergencies;
(two) units and individuals that have made remarkable achievements in the publicity, mobilization, organization and education of blood donation;
(three) units and individuals that have made remarkable achievements in the research and promotion of new technologies for blood use in medical clinic.
Twenty-sixth individuals who donate more than one thousand milliliters of blood without compensation shall be commended and rewarded by the Municipal People's Government and the Municipal Red Cross Society in accordance with the following provisions:
(1) If the cumulative amount of unpaid blood donation reaches 1000 ml, the third prize of unpaid blood donation will be awarded;
(two) blood donation reached 2000 ml, awarded the second prize of blood donation;
(3) If the cumulative blood donation reaches 3,000 ml, the first prize of blood donation will be awarded;
(4) If the cumulative blood donation reaches 4,000 ml, a special blood donation award will be awarded.
Twenty-seventh in violation of the provisions of the second paragraph of Article 8 of these regulations, illegal blood collection, the district, county-level city health administrative department shall order it to make corrections, confiscate the illegal income, and may impose a fine of one hundred thousand yuan; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-eighth blood stations in violation of the provisions of the first paragraph of Article 9, in violation of the relevant operating rules and systems to collect blood, the municipal public health administrative department shall order it to make corrections; Damage to the health of blood donors shall be compensated according to law, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-ninth blood stations in violation of the provisions of the third paragraph of Article 9, to provide medical institutions with blood that does not meet the standards prescribed by the state, the municipal health administrative department shall order it to make corrections; If the circumstances are serious, resulting in the spread of blood-borne diseases or serious risk of spread, rectification shall be made within a time limit, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 30 Whoever, in violation of the provisions of Article 12 of these Provisions, forges, alters, lends, rents, buys, sells, copies or transfers (blood donation certificate without compensation) or (the unit helps blood donation card each year), shall be given a warning by the administrative department of public health of the district or county-level city, and the certificate shall be confiscated, and may also be fined 100 yuan or more 1000 yuan or less; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 31 Whoever, in violation of the provisions of the first paragraph of Article 13 of these Provisions, illegally organizes others to sell blood shall be banned by the administrative department of public health of the district or county-level city, the illegal income shall be confiscated, and a fine of less than100000 yuan may be imposed; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 32 Whoever, in violation of Article 16 of these Provisions, uses false identity documents to defraud preferential blood use shall be fined 100 yuan or more 1000 yuan or less by the health administrative department.
Thirty-third medical institutions in violation of the provisions of article twenty-second, blood for patients who do not meet the national standards, the district, county-level city health administrative department shall order it to make corrections; If the patient's health is damaged, it shall be compensated according to law, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 34 Where a blood station or medical institution sells blood donated without compensation, the municipal public health administrative department shall order it to make corrections, confiscate its illegal income, and may impose a fine of100000 yuan; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 35 Where the administrative department of health, the blood donation office and their staff neglect their duties in blood donation, blood collection, blood supply and blood for clinical use and their supervision and management, causing serious consequences and constituting a crime, they shall be investigated for criminal responsibility according to law; If it does not constitute a crime, it shall be given administrative sanctions according to law.
Chapter VI Supplementary Provisions
Thirty-sixth before the implementation of these provisions, I donated blood for free in this city, and I or my spouse or immediate family members need blood for medical clinic, in accordance with these provisions.
Thirty-seventh "blood donation card" and "annual mutual aid blood donation card" as mentioned in these Provisions refer to "blood donation card" and "annual mutual aid blood donation card" issued by blood donation offices at all levels in this Municipality.
Thirty-eighth these Provisions shall come into force as of June 6, 2004.
