Measures for the administration of examination and approval of forest land use in construction projects

Article 1 In order to standardize the examination and approval of the use of forest land for construction projects, strictly protect and rationally utilize forest land, and promote the development of ecological forestry and people's livelihood forestry, these Measures are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Administrative Licensing Law of People's Republic of China (PRC) and the Implementation Regulations of the Forest Law of People's Republic of China (PRC).

Article 2 The term "use of forest land for construction projects" as mentioned in these Measures refers to the construction of permanent and temporary buildings and structures on forest land, and other construction behaviors that change the use of forest land. Including:

(a) the exploration and exploitation of mineral resources and the occupation of forest land by various construction projects.

(two) the temporary occupation of forest land by construction projects.

(three) forest management units occupy forest land by building engineering facilities that directly serve forestry production in the forest land they operate.

Article 3 Construction projects shall not occupy or occupy less forest land. If forest land must be used, it shall conform to the forest land protection and utilization plan and make rational, economical and intensive use of forest land. The use of forest land for construction projects shall be subject to total control and quota management. Construction projects restrict the use of forest land in ecologically important and fragile areas, restrict the use of natural forests and forest land with high volume per unit area, and restrict the use of forest land in commercial construction projects.

Fourth occupation and temporary occupation of forest land construction projects shall comply with the provisions of forest land classification management:

(a) all kinds of construction projects shall not use protected forest land.

(two) the construction projects approved and agreed by the State Council, the infrastructure, public utilities and people's livelihood construction projects approved by the relevant departments of the State Council and the provincial people's governments and their relevant departments, can use and protect the forest land below.

(three) national defense and diplomatic construction projects, can use and protect the forest below.

(four) infrastructure, public utilities and people's livelihood construction projects approved by the people's governments of counties (cities, districts) and cities and autonomous prefectures with districts and their relevant departments can use and protect the following forest land.
