State functionaries refer to those who engage in public service in state organs, including those who engage in public service in state power organs, administrative organs, judicial organs, military organs and supervisory organs at all levels. Chapter 9 of the National People's Congress Standing Committee (NPCSC)'s Interpretation on the Application of the Subject of the Crime of Dereliction of Duty, dated February 28th, 2002, stipulates that a person who is engaged in public service in an organization that exercises the administrative functions and powers of the state according to laws and regulations, or who is entrusted by the state organ to exercise the functions and powers on behalf of the state organ, or who is not included in the establishment of the state organ but is engaged in public service in the state organ, is also regarded as a staff member of the state organ when exercising the functions and powers on behalf of the state organ. Personnel engaged in official business in China * * * organs and CPPCC township (town) or above organs shall be regarded as staff of state organs. State functionaries include state power organs at all levels, administrative organs at all levels, judicial organs at all levels, the armed forces, state-owned enterprises and state institutions, as well as other personnel engaged in public affairs according to law, managers in state-owned enterprises, managers appointed or appointed by government departments in companies and enterprises, personnel appointed by state-owned enterprises to exercise management functions and other personnel engaged in public affairs according to law.
