(2) The auditing organ shall complete the auditing work within 20 days from the date of receiving the application materials. During the audit, on-site inspection shall be conducted on the business premises, processing and storage facilities, inspection facilities and instruments. Meet the prescribed conditions, sign the audit opinion and report it to the examination and approval authority; If the audit fails, it shall notify the applicant in writing and explain the reasons.
(three) the examination and approval authority shall complete the examination and approval within 20 days from the date of receiving the examination opinions. To meet the conditions, issue a seed business license; Do not meet the conditions, returned to the audit authority and explain the reasons. The auditing organ shall notify the applicant in writing of the reasons for disapproval. When the examination and approval authority deems it necessary, it may conduct on-the-spot examination.
(four) issued a "crop seed business license", and served on the applicant within the prescribed time limit.
Legal basis: Article 11 of the Measures for the Administration of Crop Seed Production and Business License shall submit the following materials when applying for a seed production and business license:
(1) Application form for seed production and operation license (see Annex1for the style);
(2) Basic information such as the nature of the unit and the ownership structure, a copy of the company's articles of association and business license, and an explanation of the establishment of branches, the entrustment of seed production, the entrustment of seed sales and the purchase and sale of seeds;
(three) the basic information of professional and technical personnel in seed production, processing, storage and inspection, and a copy of the social security certificate paid by the enterprise, the list of legal representatives and senior managers of the enterprise and their resumes engaged in seed industry;
(four) proof materials of ownership or assets of seed inspection rooms, processing plants, warehouses and other facilities; A copy of the ownership certificate or lease contract of the office; List of seed inspection and processing equipment and copies of purchase invoices; Description of relevant facilities and equipment and real-life photos;
(five) a copy of the variety approval certificate; If the seeds of authorized varieties are produced and operated, a copy of the certificate of new plant variety right and the written consent certificate of the variety owner shall be submitted;
(six) a copy of the seed production contract or a description and proof of the self-organized seed production;
(seven) the quarantine certificate of the seed production site;
(8) Other materials as prescribed by the Ministry of Agriculture.
Thirteenth seed production and operation licenses shall be approved and issued at different levels.
(a) engaged in the production and operation of conventional seeds of major crops and non-major crops, the local agricultural authorities at or above the county level where the enterprise is located shall issue a seed production and operation license;
(2) A seed enterprise engaged in the production and operation of hybrid seeds of major crops and their parents, and the combination of breeding, production and operation, whose effective area is the national seed production and operation license, shall be examined and approved by the county-level agricultural authorities where the enterprise is located and issued by the agricultural authorities of provinces, autonomous regions and municipalities directly under the Central Government;
(three) engaged in the import and export business of crop seeds, the seed production and operation license shall be audited by the competent agricultural department of the province, autonomous region or municipality directly under the central government where the enterprise is located and issued by the Ministry of Agriculture.
Fifteenth audit institutions shall audit the materials submitted by the applicant, and conduct on-the-spot investigation on the applicant's office space and facilities and equipment for seed processing, inspection and storage, and check the original relevant application materials.
Audit institutions shall complete the audit work within 20 working days from the date of accepting the application. In accordance with the provisions of these measures, the signing of the audit opinion, reported to the nuclear.
Issuing authority; If the audit fails, it shall notify the applicant in writing and explain the reasons.
Article 16 The issuing authority shall complete the issuing work within 20 working days from the date of accepting the application or receiving the examination opinions. When the issuing authority deems it necessary, it may conduct on-the-spot investigation and check the original. In line with the conditions, the seed production and operation license shall be issued and announced; Do not meet the conditions, notify the applicant in writing and explain the reasons.
The seed production and operation license with the combination of production and operation and the effective area of the whole country shall be publicized in China Seed Industry Information Network for five working days before it is issued.
