Recently, more than 80 leading cadres in Xiaoxian County, Anhui Province have been dismissed: from CPPCC, the chairman and vice chairman of the county, the deputy director of the Standing Committee of the county people's congress, the deputy magistrate and other members of the county leadership team, to the leaders of more than a dozen county-level units such as the finance director, the transportation director and the education director; Nearly 20 party and government "top leaders" in 23 townships in the county were exempted.

The fall of these cadres is related to one person: Wu Baoliang, former secretary of the county party committee. Wu Baoliang's case has gone through a long judicial process since March 20 12 was "double-regulated". Recently, the Anhui Higher People's Court upheld the original judgment: Wu Baoliang was sentenced to life imprisonment for accepting bribes and deprived of political rights for life for illegally accepting other people's property190,000 yuan.

In the indictment against Wu Baoliang, nearly 300 people gave him gifts, and public officials accounted for more than half. These "gift-giving cadres" are divided into three categories: the first category is cadres who have paid bribes to Wu Baoliang and have their own corrupt behaviors, such as Shan Yanfa, the former police chief of Xiaoxian County, who has been dealt with separately; The second category is cadres who have paid bribes but the amount is not large and can take the initiative to explain; Third, the court held that they gave Wu Baoliang a "small amount" of property on New Year's Day, which was used to "connect feelings and improve relations". Although it is not excluded that they have the intention to seek care, they did not explicitly ask for it until the incident, so they were identified as "illegal gifts", but they were not punished as crimes, and such funds were not included in the amount of bribes.

More than 80 cadres removed from office in Xiaoxian County belong to the latter two situations, especially the third category.

According to the investigators, Xiaoxian's "giving gifts to cadres" has four characteristics: First, there are a large number of people and a wide range of objects, from county leaders to county leaders, township leaders and even retired cadres; Second, focusing on festivals and marriages, in the name of "human relations"; Third, there are many times and a long time span. Many "gift-giving cadres" in Xiaoxian said that on the one hand, they were trying to "befriend Wu Baoliang, get a good relationship and get care at work", and on the other hand, they were "following the crowd": "All units do this during the Spring Festival and Mid-Autumn Festival", and many people gave gifts on behalf of their units, and the expenses were reimbursed by their units.

"Xiaoxian was such an atmosphere at that time. Everyone sent it, and I didn't send it well." Some dismissed cadres feel "wronged", especially some people "only paid three or five thousand" and even thought that they were "handled too heavily"

Wu Baoliang described Xiaoxian's "gift giving" as follows: "When I was a county magistrate and secretary, as long as I was in the office during the Spring Festival and Mid-Autumn Festival, many heads of township and county-level organs would give money in the name of reporting their work. If the office can't deliver it, it will be delivered home. Not before the festival, but after the festival. The court found that Wu Baoliang received the gift money 1000 times in10, which was objectively influenced by the external atmosphere, but the main reason was his "submission", "obedience" and even "use" to the gift-giving atmosphere in his mind.

Wu Baoliang, 54, graduated from Nanjing Aviation College in his early years, and later served as the head of a winery in Suzhou, Anhui Province, which brought this long-term loss-making state-owned enterprise back to life and became a big profit and tax collector. At that time, as a young cadre with educational background, ability, achievement and bright future, Wu Baoliang was unexpectedly elected to the Standing Committee of the District Committee, and was allegedly evaluated as "unsociable and low prestige".

According to investigators, in 2003, Wu Baoliang was transferred to the position of executive deputy magistrate of Xiaoxian County. In order to learn the lesson of losing the election, he tried to build good relations with cadres at all levels, and took eating, drinking and being invited to send him as a way to close the relationship between superiors and subordinates, improve his work and enhance his prestige, and began to accept bribes in a "harmonious" atmosphere.

After 2007, Wu Baoliang was promoted to Xiaoxian county magistrate and county party secretary. The success of his career gave him a taste of the "sweetness" of giving gifts, and later he felt that it was a "proof of relationship." According to his own account, some cadres didn't come to give gifts during the holidays, and he would wonder if he had a problem with himself. "I didn't put my heart down until this cadre made up the gift money after the festival."

A cadre who gave gifts to Wu Baoliang in Xiaoxian told reporters that for many local cadres, whether the county party secretary accepts his own gifts and how much he receives has, in a sense, become a symbol of whether he is regarded as "one of his own" or "brother", whether he is accepted by the core power circle, and even whether he has a future.

"Swinging mentality" in corruption: "Pay while collecting" to avoid responsibility.

Wu Baoliang's gift collection is characterized by "paying while collecting". From 2006 to 20 12, the received17.9 million yuan was deposited in the county investment promotion bureau and the county party Committee office for official expenses. In handling the case, this part of the money "is not a bribe" has become the focus of controversy.

According to the court's analysis, the time and amount of Bao Baoliang's "collection" and "payment" over the years were wrong, and they were not handed over to the discipline inspection department and the clean government account in time, but were handed over to subordinate departments that were easy to control, with very few insiders. Generally speaking, Wu Baoliang constitutes all the elements of the crime of accepting bribes. As for some of the property he accepted by taking advantage of his position, it is a way to deal with the stolen money after the crime is completed, which does not affect the nature, but only serves as a discretionary factor in sentencing.

This seemingly unreasonable "paying while paying" is actually the product of Wu Baoliang's "swinging mentality" in the face of corruption. He explained that in the later period of his tenure, his power increased, he received more and more gifts, and his heart became more and more fearful. Under the struggle of three complex mentality: greed, fear and luck, I came up with a set of methods to escape the blow, hide people's eyes and ears and comfort myself.

Since it has been handed over, why not hand it over to the discipline inspection department? Wu Baoliang's relatives said, "He is worried that if he publicly reports to the Commission for Discipline Inspection and breaks the' hidden rules', he will be secretly isolated and affect his work and personal development."
